There is hereby created a Resident-Only Permit Parking Program
to benefit densely populated streets with limited parking for residents
of such streets or neighborhoods as applicable (the "Program").

The Town Council may permit resident-only parking by ordinance
and on the recommendation of the Cumberland Police Department.

The creation of resident-only parking areas shall be based on
neighborhood conditions, including density of the street or neighborhood,
the relative lack of driveways, amount of off-street parking available,
frequency of overnight parking, and other related conditions that
support restricting parking to residents.

Conditions of resident-only parking areas may include, but not
be limited to, hours of resident-only parking.

The Public Works Department shall provide appropriate signage
as directed by the Police Department.

A proposal for this Program shall be reviewed by the Traffic
Management Group and shall be reviewed substantially in conformance
with the Traffic Calming Policy's procedural requirements.

Upon establishing a resident-only parking area, the Police Department
shall be responsible for implementing and administering the Program
with appropriate procedures, policies, forms and identifying tags
or stickers.

Any person residing within a designated resident-only parking
area is eligible to participate in the Program, provided that they
meet the requirements for the specific area, which may include the
following:
(a) The vehicle must be registered to the address or verified to be assigned
to the resident if the registered owner is the resident's employer
or other evidence that a vehicle has a legitimate parking purpose
in the area; and
(b) The resident applying for a permit under the Program must provide
proof of residency; and
(c) All outstanding parking violations issued on the vehicle registration
must be paid; and
(d) The number of vehicles per residential dwelling unit that may be
eligible to receive a permit unless special circumstances are presented
and approved by the Police Department; and
(e) Commercial vehicles are not eligible to obtain a permit under this
Program unless an exception is made at the discretion of the Police
Department, e.g., for small business owners that use a small commercial
vehicle for business and personal use.

Guest parking may be permitted at the request of a permit holder
upon notice to the Police Department. Excessive requests may not be
approved by the Police Department.

Any person who parks without exhibiting a permit on a street or area obtained under this Program shall be subject to the penalties and fines provided in §
38-7 of this chapter.
