In accordance with M.G.L. c. 43C, there is established a department
of municipal inspections which shall be responsible for the coordination
and management of the inspection-related activities of the city assigned
by this chapter and for the coordination of all activities of all
other city agencies in relation to any inspection services.

There is created a director of municipal inspections who shall
oversee and manage the department of municipal inspections. The director
of municipal inspections shall be responsible to and appointed by
the mayor, subject to confirmation by the city council. The director
of municipal inspections shall serve for a term of four years coterminous
with the four-year term of mayor. Such director shall be a person
especially fitted by education, experience and training to perform
the duties of the office. The position of director of municipal inspections
shall be a "special municipal employee" position for purposes of M.G.L.
c. 268A. The director of municipal inspections may also serve as the
building inspector or health agent or gas/mechanical inspector, but
in not more than one such position. If the director of municipal inspections
serves as building inspector or health agent or gas/mechanical inspector,
the financial interest of the director of municipal inspections in
such positions shall be exempt from M.G.L. c. 268A, Section 20.

The department of municipal inspections, under the director
of municipal inspections, shall be responsible for and shall perform
the following functions:
A. Coordination
of all inspection functions carried out by any officer or employee
of the city;
B. Maintenance
in a central place of all records relating to inspections including
a common index;
C. Coordination
of enforcement actions for violations of any provision of the General
Laws, State Building Code, city ordinances, rules or regulations which
are subject to enforcement by any officer or employee or the city;
D. Development
of a single application form indicating all inspections which may
be necessary;
E. The
rendering of advice, assistance and guidance to all city offices and
agencies in any matter relating to city inspection services; and
F. The
rendering of advice, assistance and guidance to all members of the
public relating to city inspection services and the development of
user friendly systems for the convenience of the public;
G. Recommend
to the mayor means and methods for improving the management and efficiency
of the city's inspectional services operations.

The department of municipal inspections shall oversee and coordinate
all inspections performed by or under the authority of the building
inspector, board of health, inspector of gas piping and gas/mechanical
appliances, plumbing inspector, wire inspector, sealer of weights
and measures, zoning enforcement officer and every other local inspection
as may be authorized. The department of municipal inspections shall
consist of the following divisions:
A. The
division of building inspection and maintenance, which shall be responsible
for the enforcement of the State Building Code pertaining to buildings
and other structures and shall be responsible for the ordinary maintenance
of all city buildings;
B. The
division of health and sanitation, which shall be responsible for
enforcement of all provisions of the State Sanitary Code and the city's
health code and any other health regulations as are adopted from time
to time by the board of health;
C. The
division of gas, plumbing and mechanical, which shall be responsible
for the enforcement of all provisions of the State Building Code applicable
to gas, plumbing and mechanical fittings as well as water cross-connections;
D. The
division of wire inspections and maintenance, which shall be responsible
for the enforcement of all the provisions of the State Building Code
and other laws applicable to electrical wires and electrical fixtures
in the city; and
E. Notwithstanding any language to the contrary in Title
2, Chapter
2.39, Section
2.39.010, a division of weights and measures, which shall be responsible for the control and supervision of all the public scales in the city.

Any division heads and personnel performing work for any division identified in Section
2.40.040 above shall be subject to the administrative control and direction of the director of municipal inspections, except that such director shall have no authority to direct the activities of any such individuals when they are exercising their statutory duties.
