For the purposes of this chapter, the terms "livery" or "limousine" shall mean any vehicle utilized for the conveyance of persons for hire from place to place which is not referenced in Title 5, Chapter 5.44, Section 5.44.010. A taxicab with a taximeter is expressly excluded from this definition.

The chief of police shall have exclusive authority to make rules and orders for the regulation of liveries and limousines, including the authority to change the license fees set forth in Section 5.45.030. Such rules, regulations and ordinance changes shall not take effect until after public hearing no less than seven days after such rules, regulations or changes, and the date for public hearing, have been advertised in a newspaper of general circulation within the city.

A. 
License of driver. No person shall drive, operate or have charge of a livery or limousine for pickup of a passenger in the city unless licensed to do so by the chief of police. The chief of police shall determine the qualifications necessary to obtain such license. The fee per license for a driver shall be thirty dollars.
B. 
License for vehicle. No person shall drive, operate or have charge of a livery or limousine unless such livery or limousine itself has a livery certificate. For any person or entity seeking such livery certificates, the cost shall be one hundred dollars per year for the first vehicle and fifty dollars per year for any additional vehicles. Such certificates shall expire after one year. For a person or entity with only one livery vehicle the license fee shall be fifty dollars.
C. 
License limitations. No person or entity who operates a taxicab service or has a taxicab license shall be entitled to any livery certificate unless such person or entity has a separate staff, and separate telephone line, for its livery service.

No person operating a livery or limousine shall accept a fare or any money from a passenger except under the following conditions: the transportation must be arranged by reservation in advance of at least two hours.

The provisions of this chapter shall be enforced by the Revere police department.

Any person or entity violating any of the provisions of this chapter shall be subject to a fine of up to three hundred dollars per offense. Each day on which a violation exists shall be deemed to be a separate offense. In addition to any fine, any person or entity violating any provision of this chapter shall also be subject to forfeiture of a livery driver's license and/or livery vehicle certificates. The Revere police department shall also have the right to enforce this chapter pursuant to the non-criminal disposition procedures set forth in Chapter 1.12.
