[Adopted by Ord. No. 2001-6 (§§ 13-10.16 and 13-10.17 of the 1996 Revised General Ordinances)]
As used in this article, the following terms shall have the meanings indicated:
MULTIPLE DWELLING
Any building or structure and land appurtenant thereto containing three or more apartments rented or offered for rent to three or more tenants or family units.
OWNER
The owner, lessee, agent or other person who manages or controls any rented dwelling.
The owner of any multiple dwelling unit shall be required to have a building superintendent available on premises at all times. Tenants must receive notification of who that person is and how they can be contracted.
Any multiple dwelling containing 100 or more units shall have a management office on site. Such office shall have the hours of operation posted on both the door of the office and by the tenants' mailboxes. The management office must be open during reasonable hours to accommodate the needs of the tenants. During hours that the office is not open, there must be a contact number posted on the door where the building superintendent or other qualified management official may be reached for any emergencies.
Any multiple dwelling containing 150 or more units shall have a door attendant/twenty-four-hour security personnel in the lobby of such dwelling. The purpose of this person is to maintain security and assist residents with needs or concerns.
It shall be the responsibility of the owner of a multiple dwelling unit, any part of which is leased or rented, to register the name of the building superintendent with the office of the City Clerk upon forms prescribed and furnished by the City. Any multiple dwelling with 100 or more units must register with the City Clerk's office the phone number and mailing address of the management office, as well as the hours of operation. Further, any multiple dwelling with 150 or more units must register with the City Clerk's office the name(s) of the security company/personnel performing such duties.
This article shall apply to all multiple dwellings, whether already constructed, in the process of being constructed, or to be constructed in the future. All multiple dwellings currently in existence shall have 90 days to comply with the provisions of this article.
A. 
Where posted. It shall be the responsibility of the owner of a building, any part of which is leased or rented as a dwelling unit or business, to post permanently and prominently in view in the common area nearest the principal entrance to the building an ownership notice.
B. 
Information required in notice.
(1) 
If the owner is the sole proprietor, the notice must contain:
(a) 
The name, address and telephone number of the owner; or
(b) 
The name, address and telephone number of the person designated as the owner's agent who shall have the authority to authorize and provide for emergency repairs of the building.
(2) 
If the owner is a partnership, corporation or other business entity or the successor, assignee, executor or administrator of any of the above-mentioned types of owners, the notice must contain:
(a) 
The name, address and telephone number of the agent for the service of process.
(b) 
The name, address and telephone number of the person designated as the owner's agent who shall have the authority to authorize and provide for emergency repairs to the building.

A. 
A violation of any provision of this article shall be punishable according to the following schedule:
(1) 
First offense: fine of $500.
(2) 
Second offense: fine of $750.
(3) 
Subsequent offenses:
(a) 
Fine of $1,000; and/or
(b) 
Imprisonment for a period not exceeding 90 days; and/or
(c) 
A period of community service not exceeding 90 days.
B. 
Upon receipt of a notice of violation of this article, [Note: See Code of the City of Union City, Chapter 1, Article II, §§ 1-18 through 1-20.] an owner of a multiple dwelling shall have six days to correct the violation. For each day an owner fails to cure the violation, the owner shall be fined an additional $100.
C. 
If an owner fails to cure within the six-day period, on the seventh day, they shall be deemed to have committed an additional offense and will be charged pursuant to the above schedule. The offender shall then be given an additional six days to cure. For each day an owner fails to cure the violation, the owner shall be fined an additional $100. This process shall continue indefinitely until the owner cures the violation.
