A. 
The provisions of this article shall apply except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device.
B. 
Any person violating the provisions of this section shall be guilty of a traffic infraction and upon conviction shall be punished and fined in accordance with Article III, § 143-40 of this chapter and as provided in the Vehicle and Traffic Law of the State of New York. In addition thereto, any motor vehicle parked in violation of this section shall be subject to removal or immobilization at the owner's expense pursuant to Article IV of this chapter.
A. 
Any police officer or peace officer, as defined in the New York State Criminal Procedure Law, any member of the Village of Wappingers Falls Police Department and any Code Enforcement Officer are authorized to issue a parking summons to a party found to be in violation of any statute, rule, regulation or ordinance pertaining to parking, which is contained in Article III of this chapter.
B. 
The parking summons shall be in a form acceptable to the Village of Wappingers Falls Board of Trustees, the Village Attorney and Village Justice Court.
C. 
Removal, immobilization and storage of vehicles. Any vehicle parked in violation of this section is subject to removal, immobilization or storage in accordance with the provisions of Article IV of this chapter.
A. 
Snow emergency, declaration and duration.
(1) 
A snow emergency shall automatically exist when the National Weather Service issues any of the following advisories for a forecast area that includes the Village of Wappingers Falls:
(a) 
Blizzard warning.
(b) 
Ice storm warning.
(c) 
Snow squall warning.
(d) 
Winter storm warning.
(e) 
Winter weather advisory.
(2) 
When the National Weather Service has not issued a winter advisory listed in Subsection A(1) above, the Mayor or their designee may declare a snow emergency for the Village of Wappingers Falls whenever road conditions become hazardous such that the free movement of emergency, fire, health, police or other vehicular traffic may become impeded by reason of snow, freezing rain, sleet or other natural causes.
(a) 
Upon the declaration of a snow emergency, the Village of Wappingers Falls shall contact the media and issue public announcements about the snow emergency by any reasonable means available.
(b) 
It shall not be a defense to a charge of violating snow emergency regulations that the vehicle operator or owner was unaware of any such snow emergency announcement.
(3) 
Duration of snow emergency.
(a) 
Any snow emergency declared as a result of a National Weather Service advisory described in Subsection A(1) above shall commence at the issuance of the weather advisory or one hour prior to the commencement of the warned time period stated in the NWS advisory and shall cease 48 hours after the expiration of the NWS advisory, unless otherwise extended or terminated by the Mayor or their designee.
(b) 
Any snow emergency declared by the Mayor or their designee shall commence within 30 minutes of the issuance of the declaration, or at such time stated in the declaration, and shall cease 48 hours after the issuance of the declaration of emergency, unless terminated earlier by the Mayor or their designee.
(c) 
Continuation of the emergency beyond the forty-eight-hour time period shall be conveyed to the public by the Mayor or their designee through the media and the Village of Wappingers Falls website.
B. 
No parking during snow emergency.
(1) 
No vehicle shall be left standing or allowed to remain parked upon any public highway of the Village of Wappingers Falls during a snow emergency.
No person shall stop a vehicle upon any of the streets or parts of streets described in Schedule XIII (§ 143-60), attached to and made a part of this chapter.
No person shall stand a vehicle upon any of the streets or parts of streets described in Schedule XIV (§ 143-61), attached to and made a part of this chapter.
No person shall park a vehicle between the hours specified in Schedule XV (§ 143-62), of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.
No person shall stop a vehicle during the times specified in Schedule XVI (§ 143-63), of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.
No person shall stand a vehicle during the times specified in Schedule XVII (§ 143-64), of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.
No person shall park a vehicle for longer than the time limit shown in Schedule XVIII (§ 143-65), at any time between the hours listed in said schedule of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.
No person shall park a vehicle upon any of the streets or parts thereof described in Schedule XIX (§ 143-66), attached to and made a part of this chapter, except at the angle designated and only within the painted stall lines. On all streets or portions thereof where angle parking is now or shall hereafter be authorized, all vehicles parked thereon shall be parked with the front thereof nearest the curb.
The locations described in Schedule XX (§ 143-67), attached to and made a part of this chapter, are hereby designated as loading zones.
The locations described in Schedule XXI (§ 143-68), attached to and made a part of this chapter, are hereby designated as taxi stands.
The locations described in Schedule XXII (§ 143-69), attached to and made a part of this chapter, are hereby designated as bus stops.
Any vehicle when stopped parallel to the curb shall be as near to the curb as practicable, with both front and rear wheels not more than six inches from the curb. This item applies to all parking near to a curb in the Village limits.
No vehicle shall stop with its left side to the curb, except in such streets as may be designated as one-way traffic streets and where road excavations or other legalized obstructions prevent the operation of this regulation.
The highways or parts thereof described in Schedule XXIII (§ 143-70), attached to and made a part of this chapter, are hereby established as special purpose parking zones, and it shall be unlawful for any person to park any vehicle or allow the same to remain parked in any such zone except as specifically provided for such zone.
No person shall park any vehicle in any area indicated as "No Parking Here To Corner" designated by signs, such locations described in Schedule XXIV (§ 143-71), attached to and made a part of this chapter.
Any street or a part of a street may be temporarily closed to parking for any length of time as deemed necessary by the Commissioner of Police for safety reasons not to exceed one day. Such situations would be fires, parades, events which draw excessive vehicles, weather conditions, etc. When such action occurs, the Commissioner of Police will notify the Mayor or his designee and advise the reason for the prohibition of parking and the length of time it will last.
No persons shall park any vehicle in a designated handicapped parking space without a special license plate issued by the Department of Motor Vehicles or handicapped parking permit issued by a municipality including, but not limited to, the locations described in Schedule XXV (§ 143-72), attached to and made a part of this chapter.
A. 
No person shall stop, stand, or park a vehicle other than an electric vehicle within any space marked or signed as reserved for "electric vehicle while charging."
B. 
It is unlawful to park or permit to be parked any electric vehicle in a space with an electric vehicle charging station that is marked as "electric vehicle while charging" if such electric vehicle is not in the process of charging.
C. 
No person shall park in a space designated as "electric vehicle while charging" space for more than four continuous hours regardless of whether or not the electric vehicle is in the process of charging.
D. 
Electric vehicles may be parked in any space designated for public parking, subject to the restrictions that would apply to any other vehicle that would park in that space.
E. 
The locations described in Schedule XXVII (§ 143-74), attached to and made a part of this chapter, are hereby designated as electric vehicle parking spaces at which only the parking of electric vehicles actively engaged in charging shall be permitted.
A. 
Any person who violates the parking provisions of this chapter shall be subject to a fine schedule as established by resolution of the Village of Wappingers Falls Board of Trustees. Such fine schedule may thereafter be amended from time to time by like resolution. The fine schedule will be on file with the Clerk of the Village of Wappingers Falls.
B. 
The penalty schedule for parking violations shall be structured for failure to answer a parking summons as follows:
(1) 
At 30 calendar days after the date of the summons, the fine is doubled.
(2) 
At 60 days after the date of the summons, the fine is tripled.
(3) 
At 90 days after the date of the summons, the fine is tripled, plus an administrative fee as set forth in the Village fee schedule set from time to time by resolution of the Village of Wappingers Falls Board of Trustees.
