The International Energy Conservation Code, 2021 edition, a copy of which is on file in the office of the city secretary, is hereby adopted as the building [energy conservation] code of the city.

The International Energy Conservation Code, 2021 edition, is amended to read as follows:
(1) 
C101.1 Insert: City of Liberty Hill, Texas.
(2) 
R101.1. Insert: City of Liberty Hill, Texas.
(3) 
C104.2 Schedule of permit fees. Where work requires a permit, the fees for work shall be indicated per City fee schedule.
(4) 
Section C104.5 Fee refunds. The code official shall authorize the refunding of fees as follows:
1. 
The full amount of any fee paid hereunder that was erroneously paid or collected.
2. 
Zero percent (0%) of the permit paid where work has not been done under a permit issued in accordance with this code.
3. 
Zero percent (0%) of the plan review fee has been paid is withdrawn or canceled before plan review efforts have been expended.
(5) 
Section C108 is deleted.
(6) 
Section C109.4 Failure to comply. Any person who continues any work after been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to fines not less than five hundred dollars ($500.00) or more than two thousand dollars ($2,000.00). Each day that a violation continues after due notice has been given shall be deemed a separate offense.
(7) 
A new subsection C407.4.1.1 is added:
C407.4.1.1. Such reports shall be prepared by the following qualified individuals:
(1) 
ICC Certified Individual with certificate designation 78 (Commercial Energy Plans Examiner) or 77 (Commercial Energy Inspector).
(2) 
Registered Design Professional bearing a seal applicable to the State where the project will be constructed.
a. 
Reports will be required to bear a digital seal and signature or wet seal and signature.
(3) 
RESNET or BPI certified individual.
(4) 
Any other representative approved by the AHJ or Code Official.
(8) 
Section R104.5 Fee Refunds. The code official shall authorize the refunding of fees as follows:
