It is the intent of the Town Board to regulate the conduct of amusement activities, such as carnivals, circuses, parades and outdoor assemblages, so as to preserve the public peace and good order and to assure the health and safety of the residents of the Town of Brookhaven surrounding the conduct of such amusement activities.

For the purposes of this chapter, the following terms shall be given the meanings set forth herein:
Any form of entertainment, except outdoor amplified music, open to the public and generally conducted in the outdoors with the presence of tents, booths or temporary structures erected for such purpose or any combination of the foregoing, including but not limited to the following forms of entertainment commonly known as "carnivals," "circuses," "outdoor shows," "fairs," "bazaars," "menageries" or "sideshows." Such forms of entertainment are deemed to be generally characterized by the presence of any of the following activities or any combination of activities thereof: mechanical rides, exhibitions of skill, animal exhibitions, displays, including but not limited to art and cars, games of skill or games of chance where otherwise permitted by local regulation.
An organized public process of people moving in an orderly, regular, or ceremonial matter upon the public right-of-way to mark or celebrate a special occasion. The roadway shall be closed to regular traffic. A parade can include decorated vehicles, floats, motorcycles and/or people on horseback. Excluding motorcades, funeral processions, and other similar processions.
Any outdoor assemblage of a private nature organized or conducted by the owner or lessee of the premises upon which the picnic or party is conducted or by a person with the consent of the owner or lessee of such premises. "Private picnic or party" shall further mean any gathering of persons conducting any lawful purpose, which such gathering is restricted to persons invited thereto and shall not mean any gathering which is open to the general public or intended in fact or in purpose to attract other members of the general public.
A publicly timed event wherein participants navigate a set course and/or cross a finish line, including but not limited to, marathons, triathlons, walks, and/or bike-a-thons. For the purposes of this section, group walks, group bicycle rides, jogs and runs organized by running clubs, athletic teams and similar groups shall not be deemed a race requiring a permit, so long as there is no obstruction to the flow of traffic and the amount of people involved is less than 30 persons.
