A. 
There is hereby established in the Borough of Brooklawn a State Uniform Construction Code enforcing agency, to be known as the “Bureau of Code Enforcement,” consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Fire Subcode Official and Electrical Subcode Official and such other subcode officials for such additional subcodes as the Construction Commission of the Department of Community Affairs, State of New Jersey, shall hereinafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency.
B. 
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to N.J.S.A. 52:27D-119 et seq. and the regulations promulgated pursuant thereto, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to the aforementioned regulations. More than one such official position may be held by the same person, provided that such person is qualified pursuant to N.J.S.A. 52:27D- 119 et seq. and the regulations promulgated thereunder to hold each such position.
C. 
The public shall have the right to do business with the enforcing agency at one office location except for emergencies and unforeseen or unavoidable circumstances.
A. 
It shall be the responsibility of the owner, occupier and/or contractor performing work on any property within the Borough of Brooklawn to display any permit issued under the authority of the Uniform Construction Codes of the State of New Jersey and/or this chapter in a manner to place said permit in plain view and make said permit visible from the street or part of street from which the principal structure is designated or will be designated during such period of construction and/or work.
B. 
Except as otherwise provided, any owner, occupier and/or contractor performing work on any property within the Borough of Brooklawn who violates, refuses to comply or neglects to comply with any provision of this chapter or any rule, regulation or directive promulgated pursuant thereto shall be liable for a fine and/or penalty as provided in § 72-6 of this chapter.
The Borough Council of the Borough of Brooklawn establishes the Camden County Board of Appeals to hear all appeals from decisions of the enforcing agencies.

The fees for a construction permit shall be the sum of the subcode fees listed below and shall be paid.
A. 
The building subcode fees shall be as follows:
(1) 
New construction:
(a) 
Subcodes B, H, I-1, I-3, M, E, R-1, R-2, R-3, R-4, R-5, U, and I-2 shall be $0.045 per cubic foot of building or structure volume; minimum fee: $250.

Handicapped fees. Pursuant to the authority under N.J.S.A. 52:27D-12e, no construction permit fee shall be required for the construction, reconstruction, alteration, improvement or repair of a structure and related devices installed or erected for the sole purpose of promoting accessibility by the handicapped, "handicapped" being defined under N.J.S.A. 51-27d-126e, and conforming to the current N.J.A.C. 5:23.7 Barrier Free Code, and any subsequent amendments or additions thereto. Waiving of the fees in no way waives the right of the enforcing agency to request plans for the purpose of reviewing plans for code compliance.
(3) 
Additions shall be computed on the same basis as new construction.
(4) 
Auxiliary use buildings, sheds and carports: $95.
(5) 
Fees for combinations of renovations and additions shall be computed separately in accordance with Subsection A(1)(c).
(6) 
Surcharge fee for new construction: $0.00334 per cubic foot of volume of the new construction, to be remitted to the Bureau of Housing Inspections, Department of Community Affairs, on a quarterly basis in accordance with N.J.A.C. 5:23-2.28.
B. 
The general fees under the Construction Code shall be as follows:
(1) 
The fee for demolition or removal permit shall be $100 for Use Groups R-3 and R-5; the fee for all other use groups shall be $170.
(2) 
Removal of a building or structure from one lot to another or to a new location on the same lot for the new foundations and for the placement in a completed condition in the new location: $100.
(3) 
For elevators, escalators and moving walks requiring reinspection every six months, the fee shall be $75, except for each five-year inspection and witnessing of tests on elevators, for which the fee shall be $250. For dumbwaiters requiring re-inspection every 12 months, the fee shall be $26.
(4) 
Installation of elevators, dumbwaiters and moving walks: $200.
(5) 
Sign fees: $8 per square foot of surface area. Compute only one side for double-faced signs; minimum fee: $95.
(6) 
Temporary structures and all structures for which volume cannot be computed, such as swimming pools and open structural towers:
(a) 
Swimming pools:

The fee for tents, in excess of 900 square feet or 30 feet in any dimension, shall be $150.
(8) 
Certificates of occupancy:

Computation: 10% of the new construction permit fee. Exception: one- and two-family residences less than 5,000 square feet in area and less than 30 feet in height.
(b) 
Minimum fee: $100; re-inspection fee: $50.
(c) 
Fee for certificate of continued occupancy: $120.
(d) 
Fee for a certificate of occupancy granted pursuant to a change of use group: $180.
(9) 
Pre-pour inspection for all new concrete flat work and for replacement of all existing sidewalks: pre-inspection is required prior to pouring the new concrete. The fee for such inspection is $95.
(10) 
The fee for an application for a variance in accordance with N.J.A.C. 5:23-10 shall be $594 for Class I structures and $120 for Class II and Class III structures. The fee for resubmission of an application for a variance shall be $229 for Class I structures and $95 for Class II and Class III structures.
(11) 
The fee for lead hazard abatement work shall be $150. The fee for a lead abatement clearance certificate shall be $50.
(12) 
Manufactured homes; trailers (include footings and foundations): $350.
(13) 
Modular homes (include footings and foundations): $650.
(a) 
Garages: $0.45 per cubic volume.
(b) 
Porches, etc.: $0.45 per cost of construction.
(14) 
Photovoltaic systems: flat fee of $200.
C. 
The plumbing subcode fees shall be as follows:
(1) 
Fixtures and stacks, including but not limited to all sinks, urinals, water closets, bathtubs, shower stalls, laundry tubs, floor drains, drinking fountains, dishwashers, garbage disposals, clothes washers, hot-water heaters or similar devices, each fixture: $20.
(2) 
Special devices: grease traps, oil separators, cross-connections, backflow preventers, water-cooled air-conditioning units, utility service connections, refrigeration units, double check valve assembly, reduced pressure zone, pressure vacuum breaker backflow preventers, steam boilers, hot water boilers (excluding those for domestic water heating) sewer pumps and interceptors, each device: $95.
(3) 
The fee for reconnecting gas appliances: $25.
(4) 
Fee for residential gas piping: $95; commercial: $125.
(5) 
For cross-connections and backflow preventers that are subject to testing requiring reinspection every three months: $35 for each device when it is tested (thrice annually) and $10 for each device when it is broken down and tested (once annually).
(6) 
In any case, minimum fee for any plumbing subcode permit, in part or total: $95.
(7) 
Plan review fee. 25% of the amount to be charged for a new construction plumbing permit as set forth above.
D. 
The electrical subcode fees shall be as follows:
(1)

A. 
The fee to be charged for an annual construction permit shall be charged annually. This fee shall be a flat fee based upon the number of maintenance workers who are employed by the facility and who are primarily engaged in work that is governed by a subcode. Managers, engineers and clericals shall not be considered maintenance workers for the purpose of establishing the annual construction permit fee. Annual permits may be issued for building/fire protection, electrical and plumbing work. Fees shall be as follows:
(1) 
One to 25 workers, including foreman: $425 per worker.
(2) 
Each additional worker over 25: $165 per worker.
B. 
Prior to the issuance of the annual permit, a training registration fee of $100 per subcode shall be submitted by the applicant to the Department of Community Affairs, Construction Code Element, Training Section, along with a copy of the construction permit (Form F-170). Checks shall be made payable to Treasurer, State of New Jersey.
The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Borough Council of the Borough of Brooklawn biannually a report recommending a fee schedule based on the operating expenses of the agency and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act.

Any person who violates any provision of this chapter shall, upon conviction in the Municipal Court of the Borough of Brooklawn or such other court having jurisdiction, be liable for fines and penalties as set forth in § 1-15 of the Code of the Borough of Brooklawn. Each day that a violation occurs shall be deemed a separate and distinct violation, subject to the penalty provisions of this chapter.
