There shall be a Department of Administration, the head of which shall be the Business Administrator. The Business Administrator shall be appointed by the Mayor with the advice and consent of Council. The Business Administrator shall be chosen solely on the basis of his or her executive and administrative qualifications, with special reference to his or her actual experience in, or his or her knowledge of, accepted practice in respect to the duties of his or her office. The Business Administrator shall either have a bachelor's degree from a recognized, accredited college or university and specialized training in public administration or at least five years of responsible experience in an executive or administrative position related to the duties of the position. During his or her tenure of office, he or she may reside outside the Township of Toms River if so approved by the Township Council.
The Business Administrator, under the direction and supervision of the Mayor, shall:
A. 
Assist in the preparation of the budget.
B. 
Administer a centralized purchasing system.
C. 
Be responsible for the development and administration of a sound personnel system.
D. 
Perform the duties set forth in § 40-4, below.
E. 
Provide for the operation of centralized data processing services for all departments and offices of the Township, including the maintenance of all Township computer hardware, software and services, including recommending any upgrades of the Township's computer system either by direct operation by the Township or by contract with third parties as authorized by Council.
F. 
Perform such other duties as the Township Council may prescribe.
The term of the Business Administrator shall be for the term of the Mayor appointing him or her and until the appointment and qualification of his or her successor. His or her annual compensation shall be fixed by Council in accordance with the current Salary Ordinance.
Pursuant to N.J.S.A. 40:69A-44, the Business Administrator shall, subject to the direction of the Mayor, supervise the administration of all Township departments. The Business Administrator shall have the power 1) to investigate the organization and operation of all Township Departments; 2) to prescribe standards and rules of administrative practice and procedure; and 3) to consult with the heads of all Township Departments; provided, however, that with respect to the Department of Law and Community Development and the Department of Finance, the authorization of the Business Administrator under this section shall extend only to matters of budgeting, personnel and purchasing.
A. 
Position created. There is hereby established the position of Assistant Township Administrator, who shall be appointed by the Township Business Administrator and who shall serve a term coterminus with that of the Business Administrator at an annual compensation to be fixed by the Township Council by ordinance.
B. 
Duties and responsibilities of Assistant Business Administrator.
(1) 
To assist the Township Business Administrator in the discharge of all duties assigned to the Business Administrator.
(2) 
To serve as Acting Business Administrator during the absence and/or disability of the Business Administrator.[1]

A. 
There is hereby established the position of Personnel Manager.
B. 
The Personnel Manager is hereby assigned the following duties and responsibilities:
(1) 
Developing and administering the Township's human resources program, including up-to-date job classifications and pay plans, active recruitment of needed personnel and in-service training programs.
(2) 
Designing, installing and maintaining personnel records for each Township officer and employee, including a job description and qualifications required, the education, training and experience of the employee, any professional or trade licenses held, all personnel actions taken with respect to the employee, compensation, pension status, the Merit System Board and any other such information deemed pertinent at the discretion of the Division Manager.
(3) 
Developing, installing and administering an orderly procedure for the consideration, review and adjustment of employee grievances, subject to any requirements in collective bargaining agreements.
(4) 
Coordinating the processes of appointment and removal of municipal employees within the various departments with other department heads and the Mayor, and to this end, reviewing and recommending proposed procedures.
(5) 
Maintaining a continuing review and analysis of budget operations, work programs and costs of municipal services.
(6) 
As directed by the Mayor or Business Administrator, assigning and transferring employees temporarily, from one department to another as efficient administration may require, provided that such assignment or transfer shall not affect classification within the state, Department of Personnel, status or compensation of any employee.
(7) 
Developing, prescribing and enforcing rules and regulations for the efficient management of the Township government, so as to avoid any duplication or overlapping of effort among the departments or among units within a department, and for the improvement of methods and procedures of administration.
(8) 
Assigning office space, furniture and facilities among and within departments.
(9) 
Conducting entrance and exit interviews of employees.
(10) 
Attending meetings and conferences at the request of Council.
(11) 
Monitoring labor relations and negotiations and regularly advising the Township Attorney of any labor issues.
(12) 
Monitoring and administering employee fringe benefit programs, as applicable.

A. 
Benefits Manager.
(1) 
There is hereby created the position of Benefits Manager. The Benefits Manager shall be under the direction and supervision of the Assistant Business Administrator.

(2) 
Duties and responsibilities. The Benefits Manager of the Division of Human Resources shall be responsible for:
(a) 
Responding to telephone inquiries, resolve service issues that may involve claims, enrollments, terminations and billing problems between active and retired Township employees.
(b) 
Maintaining personnel records for all Township officers and employees pertaining to medical benefits (major medical, prescription, dental, vision, etc.).
(c) 
Administering the Township's benefits program to comport with requirements of collective bargaining agreements.
(d) 
Maintaining a continuing analysis of the cost and projected costs of the entire Township benefits program.
(e) 
Acting as a liaison with health care providers, including attending meetings, conferences, and training relating to employee benefits programs.
(f) 
Responding to all inquiries relative to the Township benefits plan coverage.
(g) 
Maintaining a valid state health insurance license is optional, but preferred.
(3) 
The salary range for this position is $17 per hour to $25 per hour.
B. 
Manager of Information Technology.
(1) 
There is hereby created the position of Manager of Information Technology. The Manager of Information Technology shall be under the direction and supervision of the Assistant Business Administrator.

(2) 
Duties and responsibilities. The Manager of Information Technology shall be responsible to or for:
(a) 
Lead IT Department operational and strategic planning, including fostering innovation, planning projects, and organizing and negotiating the allocation of resources.
(b) 
Manage the deployment, monitoring, maintenance, development, upgrade, and support of all IT systems, including servers, PCs, operating systems, hardware, software, peripherals and phone system.
(c) 
Benchmark, analyze, report on, and make recommendations for the improvement and growth of the IT infrastructure and IT systems.
(d) 
Provision of end-user services, including help desk and technical support.
(e) 
Work with department heads to define Township business and systems requirements for new technology implementations.
(f) 
Direct research on potential solutions in support of procurement efforts.
(g) 
Keep current with the latest technologies.
(h) 
Develop business case justifications and cost/benefit analyses for IT spending and initiatives.
(i) 
Approve and oversee IT projects and project portfolio.
(j) 
Develop and implement all IT policies and procedures, including those for architecture, security, disaster recovery, standards, purchasing, and service provision.
(k) 
Practice asset management for IT hardware, software, and equipment.
(l) 
Establish and maintain regular written and in-person communications with the Business Administrator, department heads, and end users regarding pertinent IT activities.
(m) 
Development and maintenance of audio and visual systems to live stream, record and archive Township meetings on Township website.
(3) 
The salary range for this position is $45,000 to $85,000 annually.
C. 
Administrative Assistant.

A. 
There is hereby established the Division of Purchasing, the head of which shall be the Purchasing Agent. The Purchasing Agent shall meet the qualifications necessary for Qualified Purchasing Agent pursuant to N.J.S.A. 40A:11-9. The Business Administrator shall administer the centralized purchasing system as established with the Division of Purchasing.
B. 
The Purchasing Agent shall:
(1) 
Prepare and enforce specifications for the purchase of materials and supplies.

(2) 
Advertise for bids and seek quotations on prices for the purchase of materials and supplies.
(3) 
Receive bids and quotations and make appropriate recommendations to the Township Council.
(4) 
Prepare contractual and related documentation for the approval of the Township Council and supervise the execution of the same.
(5) 
Administer the performance of all municipal contracts.
(6) 
Inspect or supervise the inspection of all materials and supplies and the rendition of contractual services and determine their quality, quantity and conformity with specifications.
(7) 
Manage any central storeroom or storerooms or warehouse or warehouses that exist or may be established by the Township.
(8) 
Purchase, store and distribute all materials and supplies and contract for all services required by any Township department, office or agency.
(9) 
Arrange and supervise the sale of Township personalty or personalty in the possession of the Township, pursuant to law.
(10) 
Supervise and administer all joint purchasing agreements between the Township and other contracting units of the State of New Jersey.
(11) 
Prepare pre-bidder specifications, regulations and standard questionnaires for bidders.

(12) 
Notify Township Council as to the "other factors" utilized to recommend the award of a contract to other than the lowest bid, proposal or quotation for any purchase over $10,000 up to the bid threshold.
C. 
Nothing contained herein shall require the Division of Purchasing or the Purchasing Agent to prepare specifications and contractual documentation or supervise the execution and performance of contracts for public works or improvements under the jurisdiction of the Township Engineer.
D. 
There is hereby created the position of Deputy Purchasing Agent. The Deputy Purchasing Agent shall assist the Purchasing Agent in fulfilling the functions enumerated herein.
E. 
The Purchasing Agent is authorized to prepare bid specifications and solicit bids for the purchase of materials and supplies and the retention of services for contracts in excess of the amounts specified in Subsection B(1) above, when an emergency affecting the public health, safety or welfare requires the immediate delivery of goods or the performance of services, in the following manner:

(1) 
The Township Business Administrator or his/her designee, upon the occurrence of an emergency, and with the approval of the Mayor if practicable, shall notify the President of the Township Council or his/her designee of the need for materials, supplies or services, the nature of the emergency, the time of its occurrence and the need for invoking this section. If the President of the Township Council is satisfied that an emergency exists, the President of the Council shall direct the Township Business Administrator to authorize the preparation of bid specifications and solicitation of bids for such purposes as may be necessary to respond to the emergent needs. Such notification shall subsequently be reduced to writing by the Township Business Administrator and filed with the Mayor, Council, Chief Financial Officer and Purchasing Agent as soon as practicable.
(2) 
Should the President of the Township Council not be available to authorize the preparation of bid specifications and solicitation of bids, the Township Business Administrator shall then seek authorization from one of the members of the Township Council in the following specific order: Chairman of the Township Council's Finance Committee; Chairman of the Township Council's Administration Committee; the next available Council member.
(3) 
Should the emergency constitute an imminent loss of life or limb, the Township Business Administrator or his/her designee shall have the authority to authorize the preparation of bid specifications and solicitation of bids. Should the Township Business Administrator not be available, the Township Chief Financial Officer shall act in his/her stead. Following authorization, the award shall be reduced to writing and filed with the Mayor, Council, Chief Financial Officer and Purchasing Agent as soon as practicable.
All purchases made and contracts awarded through the Division of Purchasing for any supplies or materials or contractual services shall be pursuant to a requisition from the Director of the Township department, office or agency whose appropriation will be charged. No purchase shall be made nor obligation incurred unless the Chief Financial Officer certifies that a sufficient unencumbered balance or appropriation is available to pay therefor. Purchase order requisitions shall be established and prepared by the Division of Purchasing in accordance with purchasing procedures and policies manual as adopted by resolution, no later than 90 days after the effective date of the adoption of this Code.
A. 
All purchases made by the Purchasing Agent shall conform to the requirements of N.J.S.A. 40A:11-1 et seq., and all specifications shall be drafted in a manner to encourage free, open and competitive bidding.
B. 
Whenever practicable, materials and contractual services shall be procured through the Division of Purchase and Central Services under state contract procedures.
A. 
The Purchasing Agent is authorized to advertise for and receive bids in connection with all purchases, contracts or agreements, in accordance with the provisions of the Local Public Contracts Law.[1] The Township Council shall be the contracting agent and shall award such contracts and purchases as may be recommended by the Purchasing Agent.

B. 
The Purchasing Agent shall determine the method of presenting bids, except that such method shall be confined to either personal presentation at bid opening or by registered mail. In either case, the method shall be stated in the public advertisement, and if by registered mail, proper safeguards shall be provided to ensure the security of bids. Bids received after the time stated in the advertisement shall be considered as nonresponsive and shall be returned unopened to the sender.
C. 
All bids will be opened by the Purchasing Agent in public in accordance with the bid specifications and applicable law. A record shall be kept of the bid openings, and the same shall be available to the public.
D. 
Following review and evaluation of the bids, the Purchasing Agent shall recommend the lowest qualified bidder to the Township Council, which shall award the contract or take such other action as it deems proper.

A. 
Division of Roads. There is hereby created the Division of Roads, the head of which shall be the Division Manager of Roads. This position shall be appointed by the Mayor. The Division Manager shall report directly to the Township Business Administrator.
(1) 
The Division of Roads shall be responsible for:
(a) 
Constructing, repairing, and maintaining all Township streets and roads, including pothole repair, and the cleaning and repair of catch basins.
(b) 
Removing snow from Township streets and roads.
(c) 
Maintaining all signs, traffic markers, and streetlights which are owned or under the control of the Township.
(d) 
Maintaining all drainage facilities located upon Township property.
(2) 
The following bureaus full under the supervision and oversight of the Division of Roads:
(a) 
Bureau of Equipment/Maintenance. The Bureau of Equipment and Maintenance shall be responsible for:
[1] 
Maintaining automotive and radio equipment owned or controlled by the Township.
[2] 
Operating the centralized garage and motor pool.
[3] 
Undertaking performance analysis of Township equipment.
B. 
Division of Sanitation. There is hereby created the Division of Sanitation, the head of which shall be the Division Manager of Sanitation. This position shall be appointed by the Mayor. The Division Manager shall report directly to the Township Business Administrator.
(1) 
The Division of Sanitation shall be responsible for the collection and disposal of solid waste, including the operation and use of the Township Landfill.
(2) 
The following bureaus fall under the supervision and oversight of the Division of Sanitation:
(a) 
Bureau of Recycling. The Bureau of Recycling shall be responsible for:

Administering the recycling program of the Township of Toms River under Chapter 442 of the Township Code.
[2] 
Administering leaf collection throughout the Township.
[3] 
Organizing and maintaining the Toms River Township Convenience Center and leaf yard.
C. 
Other positions within the Divisions of Roads and Sanitation.
(1) 
Foreman. There is hereby created the position of Foreman. There shall be a Foreman for each the Division of Roads and the Division of Sanitation, whom shall be under the supervision of the respective Division Managers. Foremen shall organize and develop suitable work programs for the varied functions of each Division; supervise collection of solid waste and recycling; give suitable assignments and instructions to individuals and groups and supervise their work; as applicable to the Bureau assigned, supervise the cleaning and repair of streets and sewers, the paving of streets, the maintenance of piers and the maintenance and care of the garbage dumps; make investigations of complaints dealing with their respective Divisions and take proper action to see that needed repairs are made with a minimum of delay; prepare suitable reports; obtain, store, safeguard and supervise the proper use of needed equipment, materials and supplies; and keep needed records and files and perform such other related tasks as are required by the Director and Township Council.
(2) 
Assistant Foreman. The position of Assistant Foreman is hereby created. There shall be two Assistant Foremen assigned to the Division of Roads, and one Assistant Foreman assigned to the Division of Sanitation. The Assistant Foremen shall assist in the performance of the duties of, and other tasks assigned by, their respective Foremen.
(3) 
Recycling Foreman. There is hereby created within the Division of Sanitation the position of Recycling Foreman. The Recycling Foreman shall perform all duties of Recycling Foreman and be responsible for and have authority for enforcement of Chapter 232, Burning, Outdoor, and Chapter 442, Solid Waste, of the Code of the Township of Toms River.
(4) 
Laborer. There is hereby created the position of Laborer. Under the direction of the appropriate Division Foreman, the Laborer shall primarily perform varied types of manual and unskilled laboring work; may drive a truck in connection with laboring work on occasion; and do related work as required.
(5) 
Mechanic. There is hereby created the position of Mechanic. Under the direction of the appropriate Division Foreman, the Mechanic shall perform varied mechanical work involved in the repair, maintenance and servicing of motor vehicles and/or construction equipment working with various machines and hand tools common to the trade. The Mechanic shall do related work as required.
(6) 
Driver. There is hereby created the position of Driver. Under the direction of the appropriate Bureau Foreman, the Driver shall possess a valid commercial driver's license and shall drive a truck to transport materials, equipment or people, which includes, but is not limited to, Robo-garbage trucks and recycling trucks.
(7) 
Operator. There is hereby created the position of Operator. Under the direction of the appropriate Bureau Foreman, Operator shall perform such duties as required by the Division Managers.
(8) 
Clerical staff. There is hereby created the positions of Senior Secretary, Secretary, and Clerk-Bookkeeper for the Division of Roads and Sanitation, who shall perform such bookkeeping, payroll and clerical duties as required by the Division Managers.

A. 
General requirements pertaining to change orders.
(1) 
Each change order request must be submitted in writing, numbered consecutively and appended to the original purchase order of the contract.
(2) 
Any item of work or any quantity of material contemplated by the change order cannot be performed or purchased until the change order is approved by resolution of the Township Council.
(3) 
A change order may be requested to change the number of units or items originally specified in the original contract only where unit and/or item prices, or a price methodology, were included in the original specification and the specification and contract included a provision that such unit and/or item prices or price methodology could be utilized to calculate the amount of the change order.
(4) 
A change order cannot be used to substantially change the quality or character of the item or work to be provided.
(5) 
A change order cannot be utilized to effectuate an escalator clause in the per-unit cost of an item.
(6) 
All change orders must be processed in a timely fashion during the course of the contract as the need arises and should not be withheld until the completion of the contract.
(7) 
No change order can be approved without a certificate from the Chief Financial Officer that funds are available.
(8) 
Change orders which reduce the original contract price may be approved by the Mayor or his designee without Township Council approval. However, the Mayor, or his designee, shall advise the Township Council of the reduction of the contract price as soon as practicable.
(9) 
All change orders must be in accordance with a schedule of rates and/or charges included in the original contract. Any changes in said rates and/or charges must be included in an amended contract to be approved by resolution of the Township Council.
(10) 
The cumulative amount of any change order or orders can not exceed 20% of the amount of the original contract, unless the procedures in N.J.A.C. 5:30-11.9 are complied with.
B. 
Procedure to approve change orders.
(1) 
Any Township official requesting authorization for a change order to an existing contract with a third-party vendor shall prepare a written request setting forth the reason(s) necessitating the change and the total cost of the same with a breakdown of the change in the number of units or items authorized by the original contract.
(2) 
Said document shall then be submitted to the Township Business Administrator for review and first preliminary approval of the Mayor or his designee.
(3) 
Upon preliminary approval, the Mayor or his designee shall submit the requested change order to the Chief Financial Officer of the Township. The Chief Financial Officer shall certify in writing the availability or lack thereof of adequate funds for the requested change order. Said certification shall specifically designate the line item appropriation(s) of the official budget to which the change order will be charged.
(4) 
Upon certification by the Chief Financial Officer, the Mayor or his designee shall direct the Township Attorney to prepare a resolution for presentment to the Township Council for final approval and authorization of the change order. Said resolution shall contain a provision from the Township Attorney that the change order has been preliminarily approved by the Mayor or his designee and that the proposed change order is in accordance with New Jersey regulations regarding the same. Said resolution shall also contain the certificate of the Chief Financial Officer relating to the availability of funds.
(5) 
No work on the requested change order shall be authorized until final approval by the Township Council.

In accordance with N.J.S.A. 40A:11-6, any contract may be negotiated or awarded on behalf of the municipality without public advertising for bids and bidding therefor, notwithstanding that the contract price will exceed the bid threshold, when an emergency affecting the public health, safety or welfare requires the immediate delivery of goods or the performance of services in the following manner:
A. 
The Township Business Administrator or his/her designee, upon the occurrence of an emergency, and with the approval of the Mayor if practicable, shall notify the President of the Township Council or his/her designee of the need for the performance of a contract, the nature of the emergency, the time of its occurrence and the need for invoking this section. If the President of the Township Council is satisfied that an emergency exists, the President of the Council shall direct the Township Business Administrator to authorize the award of a contract or contracts for such purposes as may be necessary to respond to the emergent needs. Such notification shall subsequently be reduced to writing by the Township Business Administrator and filed with the Mayor, Council, Chief Financial Officer and Purchasing Agent as soon as practicable.
B. 
Should the President of the Township Council not be available to authorize an emergency contract award, the Township Business Administrator shall then seek authorization from one of the members of the Township Council in the following specific order: Chairman of the Township Council's Finance Committee; Chairman of the Township Council's Administration Committee; the next available Council member.
C. 
Should the emergency constitute an imminent loss of life or limb, the Township Business Administrator or his/her designee shall be authorized to award a contract. Should the Township Business Administrator not be available, the Township Chief Financial Officer shall act in his/her stead. Following authorization, the award shall be reduced to writing and filed with the Mayor, Council, Chief Financial Officer and Purchasing Agent as soon as practicable.

A. 
There is hereby created under the Department of Administration the Division of Community Development, the head of which shall be the Director of Community Development. The division head shall be either the Township Engineer or the Township Planner, as appointed by Business Administrator and report directly to the Business Administrator.
(1) 
Duties:
(a) 
He or she shall render to the Business Administrator and Governing Body such reports, recommendations, drawings or other documents as may be required, at regular-stated intervals or on special request therefor. He or she shall hold himself or herself available for consultation and advice to all municipal officials and municipal boards or commissions and shall prepare and present to the Mayor and Township Council short- and long-range recommendations for the improvement of the Township in the areas within the functions and duties of his or her division.
(b) 
Enforce the zoning ordinances of the Township of Toms River.
(c) 
Keep a record of all applications for permits and of all permits and certificates issued with a notation of all special conditions involved.
(d) 
File and safely keep copies of all proposed development plans submitted.
(e) 
Collect and record fees for zoning permits and flood letters.
(f) 
Prepare monthly reports for the Township Council summarizing all zoning permits and flood hazard letters issued by the Division, a copy of which shall also be given to the Tax Assessor.
(2) 
Within the Division of Community Development, the following bureaus are established:
(a) 
Bureau of Engineering;
(b) 
Bureau of Construction Services;
(c) 
Bureau of Zoning and Planning; and
(d) 
Bureau of Property Maintenance.
B. 
Bureau of Engineering.
(1) 
There is hereby created a Bureau of Engineering, the head of which shall be the Township Engineer, who shall serve as the Bureau Manager in addition to his or her duties as the Director of the Division of Community Development. The qualifications of the Township Engineer shall be as follows:
(a) 
Graduation from accredited college or university with a bachelor's degree.
(b) 
At least five years' experience in state, county, regional or municipal engineering or planning activities.
(c) 
Duly licensed as a professional engineer in the State of New Jersey for at least five years.
(2) 
Powers and duties of Township Engineer. The Township Engineer shall perform such duties as are prescribed by general law and ordinance and, in addition, shall:
(a) 
Prepare, or cause to be prepared, all plans, designs and specifications for public works and improvements undertaken by the Township;
(b) 
Provide and maintain surveys, maps, plan specifications and control records with respect to public works owned and operated by the Township;
(c) 
Provide technical and engineering advice and assistance to other Township departments, divisions and bureaus;
(d) 
Recommend to the Mayor and Council the undertaking of needed capital projects with the Township;
(e) 
Assist in the formation and implementation of the Township capital budget;
(f) 
Supervise and direct all inspection services and inspection personnel of the Township excluding those services, inspection and personnel under the authority of the Township Code Official;
(g) 
Assign, with the approval of the Mayor or Business Administrator, projects to these special consulting engineers authorized by the governing body, and supervise the same;
(h) 
Direct and supervise all personnel within the bureau;
(i) 
Direct and supervise the Township's Community Development Block Grant Program and related activities.
(j) 
Upon termination, all papers, documents, memoranda, reports and other materials relating to the administration of engineering duties of the Engineer shall be and remain the property of the Township. Upon termination of his or her services with the Township, the Engineer shall forthwith surrender to any successor all such property.
(3) 
Other positions created under the Bureau of Engineering. In addition to the Township Engineer, the following positions, together with the qualifications therefor, if applicable, are hereby created:
(a) 
Assistant Township Engineer. To qualify for appointment to this position, a person must have graduated from an accredited college with a degree in engineering or related field: have two years' experience in state, county, regional or municipal engineering activities; and be a duly licensed professional engineer by the State of New Jersey.
(b) 
Administrative Engineer. To qualify for appointment to this position, a person must have either graduated from an accredited college with a four-year degree in engineering or related field and have at least one year experience in state, county, regional or municipal engineering activities, or a two-year Associate Engineering Degree or four years' experience in state, county, regional or municipal engineering activities.
(c) 
GIS Specialist.
(d) 
Surveyor/Chief Inspector. To qualify for appointment to this position, a person must have at least four years' experience in a construction-related field.
(e) 
Engineering Inspector.
(f) 
Township Land Surveyor.
(g) 
Stormwater Management Coordinator.
(h) 
Clerical support staff.
(4) 
Special consulting engineers and planners. Whenever, in the opinion of the Township Engineer, special engineering or planning consulting services are necessary for a specific project or matter, the Township Engineer shall provide a recommendation in writing to the Business Administrator, who shall in turn notify the Mayor and Township Council. The contracts for special consulting engineers and planners shall be negotiated by the Mayor and presented to the Township Council for ratification by resolution. Only those special consulting engineers and planners authorized by the Mayor and Council may be employed by the Township Engineer.
(5) 
Disaster Recovery Ombudsman. Following a natural or man-made disaster causing widespread damage, the Business Administrator may appoint a Disaster Recovery Ombudsman to assist the general public and Township departments during the rebuilding and recovery process. The Disaster Recovery Ombudsman will act as the general public's liaison to the various state, federal, and local governmental agencies involved in, and receive and respond to the public's inquiries regarding, the rebuilding and recovery process.
(a) 
Appointment to this position shall be on an as-needed basis by the Business Administrator, and shall be rescinded when, in the determination of the Business Administrator, the ombudsman services are no longer necessary.
(b) 
This shall be a part-time position, the hours of which shall be established by the Business Administrator, or his designee, but in no case shall exceed 19 1/2 hours per week. The appointee's work schedule shall be established by the Business Administrator, or his designee, but the appointee shall be on duty mainly outside of normal Township business hours.
(c) 
The job duties and requirements shall be established from time to time by the Business Administrator, or his designee, based on the nature of the disaster prompting the appointment, and shall be kept on file with the Division of Human Resources.
(d) 
The requisite skills and qualifications shall be established from time to time by the Business Administrator, or his designee, based on the nature of the disaster prompting the appointment.
(e) 
The person appointed to this position shall not be considered a full-time employee and shall not be entitled to any of the benefits afforded to full-time employees.
(f) 
The appointee to this position shall report to the Director of the Division of Community Development.
C. 
Bureau of Construction Services.
(1) 
Establishment; duties; Construction Official. There is hereby created a Division of Construction Services, the head of which shall be the Construction Official, who shall report to the Business Administrator. The Construction Official shall be responsible for:
(a) 
Undertaking enforcement proceedings for all building, housing and related codes, property maintenance, issuing and administering permits issued thereby and reviewing all site and construction plans as specified by state statute or this Code.
(b) 
Inspecting real property and improvements thereon under the applicable code provisions, supervising the demolition of condemned buildings and the abatement of nuisances and performing such further duties prescribed by state statute or this Code.
(c) 
Administering the provisions of N.J.S.A. 52:27D-119 et seq., the State Uniform Construction Act, and N.J.A.C. 5:23-1 et seq., the regulations for the State Uniform Construction Code and the various subcodes providing therein, including but not limited to building subcode, plumbing subcode and electrical subcode.

There is hereby established a Bureau of Zoning and Planning, which shall be overseen by the Township Engineer. The powers and duties of Bureau Manager shall be as follows:
(a) 
Act as liaison to the Planning Board;
(b) 
Act as liaison to the Zoning Board of Adjustment;
(c) 
Act as liaison to the Rent Leveling Board;
(d) 
Act as liaison to the Township Environmental Commission;
(e) 
Act as liaison to any redevelopment entity;
(f) 
Act as liaison to the Township Business Improvement District;
(g) 
Supervise and advise the Township Zoning Officers;
(h) 
Supervise, direct and advise the support staff of the Township Planning Board, Zoning Board, Environmental Commission and Rent Leveling Board;
(i) 
Supervise and advise the support staff.
(2) 
Other positions created. In addition to the Division Manager, the following positions, together with the qualifications therefor, if applicable, are hereby created:
(a) 
Township Planner. To qualify for appointment to this position, a person must possess a bachelor's degree in the field of municipal planning or related field discipline from an accredited college; be duly licensed as a professional planner by the State of New Jersey; and have at least three years experience in the field of state, regional, county or municipal planning. The Township Planner may be either a full-time township employee or professional service contractor. The powers and duties of the Township Planner are as follows:

When authorized by the Director, attend meetings of the Township Planning Board, Zoning Board and Environmental Commission, and advise and counsel the members of said entities;
[2] 
Prepare and assist in the implementation of the Township Master Plan;
[3] 
Recommend and assist in the preparation of proposed amendments to the Township zoning and land development ordinances and regulations;
[4] 
Advise and assist the Township Zoning Officers;
[5] 
Advise and counsel the support staff of the Township Land Use Boards and Environmental Commission;
[6] 
Act as liaison to all state, regional and county agencies relating to municipal planning activities;

Assist in the preparation of all proposed redevelopment plans authorized by the Township Redevelopment entity;

Prepare and submit reports as required by the Mayor, Council or Business Administrator;

(b) 
Assistant Township Planner. To qualify for this position, a person must possess a bachelor's degree in the field of municipal planning or related discipline from an accredited college. The Assistant Township Planner shall assist the Township Planner in the discharge of all assigned duties. The Assistant Township Planner may also be a full-time township employee or professional service contractor.
(c) 
Township Zoning Officer.

Position created. There is hereby created the position of Zoning Officer of the Township of Toms River.
[2] 
Duties. The duties of Zoning Officer shall be as follows:
[a] 
To enforce the zoning ordinances of the Township of Toms River;
[b] 
To issue zoning permits;
[c] 
To issue flood hazard letters in writing when requested;
[d] 
To answer all inquiries with regard to zoning;
[e] 
To keep a record of all applications for permits and of all permits and certificates issued, with a notation of all special conditions involved;
[f] 
To file and safely keep copies of all plans submitted;
[g] 
To collect and record fees for zoning permits and flood letters;
[h] 
To prepare a monthly report for the Mayor and Township Council summarizing all activity of the previous months concerning the duties of the Zoning Officer.
[3] 
The Zoning Officer shall be deemed to be the administrative officer as defined in N.J.S.A. 40:55D-3, and shall also issue certifications on behalf of the Township of Toms River certifying whether or not a subdivision has been approved by the Toms River Township Planning Board, in accordance with N.J.S.A. 40:55D-56 and, in general, shall coordinate the efforts of the Planning Board of the Township of Toms River and have such other duties or responsibilities as may, from time to time, be imposed with regard to the Planning Board.
[4] 
The Zoning Officer shall conduct field inspections and special investigations to ensure compliance with various municipal ordinances, initiate and enforce rules and regulations in relation to enforcement of ordinances, initiate necessary legal action against violators of various municipal ordinances, prepare needed reports, establish and maintain the records and files and may assist in the promulgation of municipal ordinances.
(d) 
Planning Board support staff. For purposes of administration, the Planning Board Secretary and other clerical support staff of the Planning Board shall be under the auspices of the Division of Community Development.
(e) 
Zoning Board of Adjustment support staff. For the purposes of administration, the Zoning Board Secretary and other clerical support staff of the Zoning Board of Adjustment shall be under the auspices of the Division of Community Development.
(f) 
Rent Leveling Board support staff. For purposes of administration, the Rent Leveling Secretary and other clerical support staff of the Rent Leveling Board shall be under the auspices of the Division of Community Development.
(g) 
Affordable Housing Administrator.

Position created. There is hereby created the position of Affordable Housing Administrator of the Township of Toms River.
[2] 
Duties. The duties of the Affordable Housing Administrator shall be provided for pursuant to N.J.A.C. 5:80-26.18(d).
(h) 
Community Development Block Grant Support Staff: For purposes of administration, the employee assigned to administer the Township's Community Development Block Grant and related Township programs shall be under the auspices of the Division of Community Development.
(i) 
Deputy Zoning Officer. To assist and perform all duties assigned by the Zoning Officer and to serve as acting Zoning Officer in circumstances when the Zoning Officer is absent, incapacitated, or otherwise unable to carry out the duties of the office.
E. 
Bureau of Property Maintenance.
(1) 
There is hereby created the Bureau of Property Maintenance, which shall perform the following functions:
(a) 
Conduct field inspections and special investigations to ensure compliance with municipal ordinances.
(b) 
Initiate and enforce rules and regulations in relation to enforcement of ordinances.
(c) 
Initiate necessary legal action for violations of municipal ordinances.
(d) 
Perform any other such function as necessary to administer the Division's purposes.

There is hereby created under the Department of Administration the Division of Human Services, the head of which shall be the Director of the Division of Human Services, who shall be appointed by and report to the Business Administrator.
(1) 
Within the Division of Human Services, the following bureaus are hereby established:
(a) 
Bureau of Senior Services.
(b) 
Bureau of Animal Control.
B. 
Bureau of Senior Services. There is hereby created, within the Division of Human Services, the Bureau of Senior Services, the head of which shall be the Division Manager of Human Services, who shall report to the Business Administrator. The Division Manager of Human Services shall coordinate and develop senior citizens programs and activities in the Township. The Division Manager of Human Services may be assisted by the Deputy Bureau Manager of Senior Services, who will assist the Division Manager with respect to senior services matters.
(1) 
Powers and duties of Bureau of Senior Services:
(a) 
Develop programs and coordinate projects directed to the development of needed senior services in the Township.
(b) 
Act as liaison between the Township Council and various senior service agencies and programs, both public and private, on the local, state and federal levels.
(c) 
Actively seek out and advise Township Council of grants, funds and loans which may be available for senior services and related programs.
C. 
Bureau of Animal Control. There is hereby established within the Division of Human Services the Bureau of Animal Control, the head of which shall be the Bureau Manager of Animal Control, which may either be a full-time township employee or independent contractor. The Division of Animal Control is responsible for administering Chapter 165 (Animals and Animal Establishments), as well as other duties as directed by the Division Director of Human Services.
D. 
Officer of the Township Physician. There is hereby created the office of Township Physician. The Township Physician shall conduct all required physical examinations for all Township employees except for those of the Police Department, which examinations shall be conducted by the Police Physician or Police Surgeon. The Township Physician shall be appointed pursuant to law and shall receive such compensation and perform such duties as provided by law. There shall be no more than two individuals who shall hold the office of Township Physician.
E. 
Municipal Alliance Committee. There shall be established a Municipal Alliance Committee on Alcoholism and Drug Abuse within the Division of Human Services.
(1) 
Membership on the Municipal Alliance Committee shall be appointed by the Mayor with the advice and consent of Township Council and shall include, but not necessarily be limited to, representatives of the following groups:
(a) 
A Mayoral representative.
(b) 
The Chief of Police.
(c) 
The President of the School Board.
(d) 
The Superintendent of Schools.
(e) 
The Student Assistant Coordinator.
(f) 
A representative of the PTA.
(g) 
A representative of the local bargaining unit for teachers.
(h) 
A representative of the Chamber of Commerce.
(i) 
A representative of organized labor.
(j) 
A representative of the court system.
(k) 
A representative of a local civic association.
(l) 
A representative of a local treatment provider agency.

The Municipal Alliance Committee's purpose is as follows:
(a) 
To organize and coordinate efforts involving school, law enforcement, business and community groups for purposes of reducing alcoholism and drug abuse.
(b) 
To develop, in conjunction with the LEA, comprehensive alcoholism and drug abuse education programs for grades K through 12.
(c) 
To develop, in conjunction with the LEA, procedures for intervention, treatment/referral and discipline of students involved with substance abuse.
(d) 
To develop comprehensive alcoholism and drug abuse education, outreach and support efforts for parents.
(e) 
To develop a comprehensive alcoholism and drug abuse community awareness program.
F. 
Municipal Alliance Coordinator. There is hereby created the position of Municipal Alliance Coordinator for the Township of Toms River.
(1) 
To be appointed to the position of Municipal Alliance Coordinator for the Township of Toms River, an individual must possess the following qualifications:
(a) 
Currently serving as Director of the Division of Human Services; or
(b) 
Experience or training in the ATOD (Alcohol, Tobacco and Other Drugs Council) field and Experience in coordinating and managing programs in a related field.
(2) 
Duties. The Municipal Alliance Coordinator shall be responsible for the planning, promotion, development and supervision of the Municipal Alliance Program as follows:
(a) 
Coordinating and assuring the implementation of all Alliance ATOD programs as outlined in the approved grant. These programs shall include, but not be limited to, Project Graduation, the Senior Citizen Awareness Program, the Tobacco Awareness Program, Teen Coffee Shop Night and the Monthly Newsletter.
(b) 
Gathering information for the community needs assessment and making recommendations for future grant applications based on that information.
(c) 
Coordinating and managing Alliance volunteers by scheduling meetings, providing information and training, overseeing committees and maintaining pertinent records.
(d) 
Providing the community with information on ATOD prevention, resources and specific Alliance programs through a monthly newsletter, press and other media releases.
(e) 
Organizing fund-raising activities that will provide additional funds as needed.
(f) 
Preparing the annual grant application which shall require attendance at Ocean County grant-related meetings/training and the compilation of statistical and financial information.
(g) 
Coordinating activities with other municipal agencies and organizations, including the Board of Education.
(h) 
Maintaining and filing all records in a central office. Such records shall include, but not be limited to, minutes of monthly meetings, financial records, the annual grant and related documents, program descriptions and evaluations, copies of the newsletter, media releases, a video pamphlet library, correspondence with the County of Ocean and training and time records for Alliance volunteers.
(3) 
Compensation. The salary for the position of Municipal Alliance Coordinator shall be paid in accordance with the terms and provisions of the Salary Ordinance of the Township of Toms River. Said position shall also be funded by a grant from the Governor's Council on Alcoholism and Drug Abuse.

There is hereby established the Division of Recreation, the head of which shall be the Director of the Division of Recreation.

The Division of Recreation shall consist of four bureaus as follows:

Bureau of General Recreation. This division shall consist of all programs and events relating to Township playgrounds, swimming pools, athletic fields, and other Township recreational facilities, except the Bey Lea Golf Course and Winding River Ice Rinks.

Bureau of Beaches. This division shall consist of all programs and events relating to Township beaches, including Ortley Beach, Shelter Cove Beach, and Money Island Beach.

Bureau of the Bey Lea Golf Course Utility. This division shall consist of the Bey Lea Golf Course, Clubhouse and all programs and events relating to said facility.
(d) 
Bureau of the Winding River Ice Rinks Utility. This division shall consist of the indoor and outdoor ice skating rinks located at Winding River Park and all programs and events relating to said facilities.

Director of the Division of Recreation. The head of the Division of Recreation shall be the Director of Recreation, who shall be hired by and report to the Business Administrator. The Director of the Division of Recreation shall perform the following duties:

Administer the work of the Division and administer and operate all Township recreational facilities and recreation programs.
(b) 
Plan and develop additional public recreational areas and facilities.
(c) 
Cooperate with other municipal departments, service clubs, and organizations in furthering recreational and cultural interests in the Township.
(d) 
Adopt reasonable rules, regulations, and bylaws subject to the approval of the Business Administrator and Governing Body for the conduct of all persons participating in programs and activities or utilizing recreational facilities or equipment sponsored by the Division of Recreation.
(e) 
Attend meetings of the Recreation Committee of the Township Council.
(f) 
Study, investigate, develop, and recommend recreation programs.
(g) 
Conduct studies of the present and future recreational needs of the Township and develop immediate and long-range plans in consultation with the Recreation Committee for recommendation to the Mayor and the Township Council.
(h) 
Maintain such records as may be required to control division receipts, property and personnel, and provide information to the Business Administrator for budgeting and financing of recreational programs. Such records shall include time cards, or the equivalent Township-approved time tracking device, for part-time and seasonal personnel.
(i) 
Be responsible to the Business Administrator for the proper custody and preservation of the books, records and property under his or her control, and for the faithful performance of his or her duties.
(j) 
Submit to the Business Administrator monthly reports concerning the conduct and progress of the Division, including receipts and monies.
(k) 
Administer the expenditure of funds in accordance with the annual budget.
(l) 
Administer the management of the public golf courses and ice rinks.
(m) 
Operate programs related to Township beaches and boardwalks.
(n) 
Hire part-time and seasonal staff as needed, with the approval of the Business Administrator, to carry out the functions of the Division.
(4) 
General Recreation Program Manager. The Program Manager shall be hired by the Director of the Division and shall assist the Director in providing for the individual recreation programs and activities established in the Bureau of General Recreation and shall maintain accurate records relating to the attendance of participants and staff in said Bureau.
(5) 
Ice Rink Bureau Manager. The Bureau Manager shall be hired by the Director of the Division of Recreation with the approval of the Business Administrator and shall be responsible for the development, scheduling and oversight of the established ice hockey leagues, skating programs and other activities. The Bureau Manager shall coordinate with the Ice Rink Facility Manager to ensure the efficient operation of the ice rink facilities. This position may also serve as the Ice Rink Administrator, the primary contact for the ice rink utility, at the discretion of the Director of Recreation.
(6) 
Ice Rink Facility Manager. The Ice Rink Facility Manager shall be hired by the Director of the Division of Recreation with the approval of the Business Administrator and shall be responsible for the maintenance and/or repair of the Township ice rink facilities. The Ice Rink Facility Manager shall supervise and direct all maintenance workers, clerical, and custodial staff assigned to the ice rink facility. The Ice Rink Facility Manager shall coordinate activities with the Bureau Manager to ensure the efficient operation of the ice rink facilities. This position may also serve as the Ice Rink Administrator, the primary contact for the ice rink utility, at the discretion of the Director of Recreation.
(7) 
Ice Rink Assistant Manager. The Ice Rink Assistant Manager shall be hired by the Director of the Division of Recreation and shall assist the Ice Rink Facility Manager in the maintenance and/or repair of the Township ice rink facilities and assist the Ice Rink Program Manager with the coordination of all programs and activities. This position shall also provide support to the Bey Lea Golf Course utility at the discretion of the Director of Recreation.
(8) 
Golf Course Facility Manager. The Golf Course Facility Manager shall be appointed by the Director of the Division of Recreation with the approval of the Business Administrator and shall be responsible for the care, maintenance and repair of the grounds of the Bey Lea Golf Course. The Golf Course Facility Manager shall direct and supervise all senior grounds-persons and grounds-persons assigned to the Bureau. The Golf Course Facility Manager shall coordinate with the Clubhouse Manager to ensure the efficient operation of the golf course. This position may also serve as the Golf Course Administrator, the primary contact for the golf course utility, at the discretion of the Director of Recreation.
(9) 
Golf Course Clubhouse Manager. The Golf Course Clubhouse Manager shall be appointed by the Director of the Division of Recreation with the approval of the Business Administrator and shall be responsible for all programs and activities conducted at the Bey Lea Golf Course and shall be responsible for the scheduling of all tee times, tournaments and other events. The Clubhouse Manager shall direct the Assistant Clubhouse Manager and all clerical staff and seasonal employees assigned to the Bureau who are not assigned to the Golf Course Superintendent. The Clubhouse Manager shall coordinate with the Golf Course Superintendent to ensure the efficient operation of the golf course. This position may also serve as the Golf Course Administrator, the primary contact for the golf course utility, at the discretion of the Director of Recreation.
(10) 
Golf Course Assistant Clubhouse Manager. The Assistant Golf Course Clubhouse Manager shall be appointed by the Director of the Division of Recreation and shall assist the Clubhouse Manager.
(11) 
Golf course assistant manager. The Golf Course Assistant Manager shall be hired by the Director of the Division of Recreation with the approval of the Business Administrator and shall be responsible for the development and coordination of all golf programs. The Golf Course Assistant Manager shall also support the Golf Course Facilities Manager and the Golf Course Clubhouse Manager with all golf course facility and clubhouse functions. This position shall also provide support to the Winding River Ice Rink utility at the discretion of the Director of Recreation.
