A. 
Residents and visitors of the Borough of Englishtown shall be permitted to and encouraged to enjoy the Borough’s attractions, parks, restaurants, shops and other public and private facilities. However, when groups of people have planned to gather together at a park, public street or place, or quasi-public private property, when the use may impact public safety or Borough services, the Borough requires that they submit a permit request under certain conditions to ensure that the gathering will not result in a public disturbance.
B. 
For the purposes of this article, the following definitions shall apply:
PUBLIC DISTURBANCE
A gathering of persons that results in blockage of pedestrian traffic, motor vehicle traffic, or is likely to result in increased police presence or overtime costs, or the need to incur costs and overtime associated with the Department of Public Works.
SPECIAL EVENT
A performance, show, entertainment, labor strike, party, political protests or other gathering of a group of people for a protracted period of time.
Organizers of events for which they intend to invite or encourage members of the public, or have invited or encouraged members of the public, to gather on the Borough’s streets or in its parks for a special event as defined in this article are required to submit to the Borough Clerk an application for a special event permit prior to conducting such a gathering.
Special event permits shall be approved by the Borough unless the Borough determines, after consultation with local, state and/or federal officials, that the gathering is likely to cause a public disturbance as defined in this article. An application for the permit will be kept on hand by the Borough Clerk and made available on the Borough’s website. Any application for a special event permit shall be accompanied by a charge of $50. The application and fee must be submitted to the Borough no later than seven days prior to the planned gathering. The Borough may conditionally approve a permit on subject to restrictions determined appropriate by the Police Department for safety and logistical reasons, including, but not limited to, requesting that the gathering be moved to a different location. The Borough shall not approve or disapprove permit applications except on a content-neutral basis determined solely by safety concerns and/or to prevent a public disturbance as defined in this article or violation of any other law of the Borough, County of Monmouth, State of New Jersey or United States of America.

The Borough’s Police Department shall have the authority to eject from the park or said area any person or persons acting in violation of this article. Any person who shall violate any provision of this article shall be summarily evicted from the public property, and may, at the discretion of the Police Department, be temporarily denied further admittance to the location where the gathering was held until crowds have been dispersed.
B. 
At the discretion of the Police Department, violations of any provision of this article may be cause for revocation of the special events permit and termination of the event. Any person violating any provision of this article may be cited by the Police Department for disorderly conduct as defined in Chapter 317 of the Borough Code.
The provisions of this article do not apply to recreational sports events or Borough-sponsored events such as the Easter Egg Hunt, Englishtown Day, and the like. This article is not intended to supersede or replace any other section or provisions of the Borough Code.
