A. 
Access to the Municipal Parking Garage, vehicle access roads, and concourses of the Township Municipal Complex located at 33 Washington Street shall be restricted to individuals (i) lawfully operating a transportation device; (ii) traveling to and from a vehicle that is lawfully parked in the Municipal Parking Garage or (iii) traveling by foot to access services or meetings at the Municipal Complex or surrounding buildings;
B. 
No person shall obstruct any passageway—or cause their personal belongings to obstruct any passageway or parking space—of the Municipal Parking Garage, vehicle access roads, and concourses of the Township Municipal Complex;
C. 
No person or organization is permitted to store personal belongings or other items in the Municipal Parking Garage, vehicle access roads or concourses of the Township Municipal Complex, including boxes; bags; containers; clothes and clothing racks; food and drink supplies; shopping bags; beds; cots; sleeping bags; blankets; and other personal belongings;
D. 
If any of the items provided in Subsection C are stored in the Municipal Parking Garage or surrounding public grounds of the Township Municipal Complex, they shall be deemed as abandoned, and the Township reserves the right to collect and discard them in accordance with the procedures set forth in N.J.S.A. 40A:14-157;
E. 
Should a person or organization violate any of these conditions, they shall be warned of such by a peace officer or other Township official and shall have 24 hours to remediate the violation. Continual non-compliance with these conditions may result in the violator being charged as a defiant trespasser pursuant to N.J.S.A. 2C:18-3, Subdivision b.
These conditions to access the Municipal Parking Garage, vehicle access roads, and concourses of the Municipal Complex shall not apply to (i) any contractor or employee of the Township performing maintenance repairs, inspections, or other services of these premises at the request of the Township or (ii) any business invitee of the Township whose services could not practically be performed without violating the conditions provided in § 388-15.

In accordance with N.J.S.A. 40:49-5, any person or organization convicted of violating said rules and conditions shall be subject to a fine not exceeding $2,000 or imprisonment in the Ocean County Jail for a period not exceeding 90 days, or both.
B. 
Each and every day an individual or organization, whichever be the case, violates any of the conditions provided by this article shall constitute a separate violation with regard to the penalties imposed by the Toms River Township Municipal Court or other court of competent jurisdiction.
As used in Article VI of Chapter 388 (Peace and Good Order), the following terms shall have the meanings indicated:
CONCOURSE
A large open area inside or in front of a public building.
MUNICIPAL PARKING GARAGE
The three-level vehicle garage located at 33 Washington Street, including the stairwells connecting the three levels.
PASSAGEWAY
A walkway that connects one area of a building or land to another.
TRANSPORTATION DEVICE
A vehicle, motorcycle or bicycle.
VEHICLE ACCESS ROADS
The access roads to the Municipal Complex known as Wilsey Way and Horner Street, which intersect with Robbins Street and East Water Street, respectively.
