A voter of the borough who has been a resident of the borough for no less than three years prior to his candidacy for office is eligible to hold the office of the mayor.

The mayor is elected at-large and serves until a successor is elected and has qualified. The mayor serves a three-year term. The mayor's regular term begins on the first Monday following the election.
No person who has completed three consecutive full terms as mayor may serve another term or portion of a term until a period of 180 days has passed since the end of his or her third consecutive full term of office. A full term of office means the regular term of office for mayor and does not include portions of a term served by appointment or election to the remainder of an unexpired term vacated by another person.
Application of the ordinance codified in this section shall be prospective only. Terms served by the mayor prior to enactment of the ordinance codified in this section shall not be considered in determining future eligibility to hold office.

A. 
The mayor shall perform all duties required by the borough charter and assembly. The mayor acts as ceremonial head of the borough and executes official documents on authorization of the assembly. The mayor has veto power as written in AS 29.20.270 which may be overridden by a two-thirds vote of the assembly. The mayor, while attending assembly meetings, does not have a vote on any issue except to break a tie vote of the assembly.
B. 
The executive power in the borough is vested in the mayor. The mayor may hire necessary administrative assistants and may authorize an administrative official to appoint, suspend or remove subordinates in conformance with the borough's personnel ordinances. The borough mayor, as chief administrator, is responsible for the proper administration of all Denali Borough affairs. The mayor shall:
1. 
Appoint, suspend, and remove by written order Denali Borough employees and administrative officers, except as otherwise provided in the charter or by ordinance;
2. 
Supervise the enforcement of borough law and carry out the directives of the assembly;
3. 
Prepare and submit an annual budget and capital improvement program for consideration by the assembly, and execute the budget and capital improvement program adopted;
4. 
Make monthly financial reports and other reports on borough finances and operations as required by the assembly;
5. 
Report to the assembly at the end of each fiscal year on the finances and administrative activities of the Denali Borough;
6. 
Prepare and make available for public distribution an annual report of Denali Borough affairs;
7. 
Execute other powers and duties specified by state law or lawfully prescribed by the assembly;
8. 
Direct and supervise the business of the Denali Borough to assure that all ordinances and resolutions are executed;
9. 
Sign the special assessment rolls;
10. 
Act as ex officio chairman of the board of adjustments for matters of building and zoning regulations of the Denali Borough;
11. 
Act as ex officio chairman of the board of equalization for matters of taxation and special assessments;
12. 
Exercise custody over all real and personal property of the borough;
13. 
Serve as personnel officer, unless the assembly authorizes the mayor to appoint a personnel officer;
14. 
Serve as the disaster emergency coordinator; and
15. 
Perform such other duties as required by law or ordinance or lawfully prescribed by the assembly.

Should the office of the Denali Borough mayor become vacant or if the mayor is unable to perform his duties, the presiding officer of the Denali Borough assembly shall be named mayor pro tempore to serve until the mayor is able to resume his responsibilities or until a new mayor is elected according to DBC § 2.10.090.

Should the office of the mayor and mayor pro tempore become vacant or should both the mayor and the mayor pro tempore be absent or unable to perform the duties of the office of the mayor, the assembly shall elect one of their members who shall assume the office of the mayor pro tempore.

A. 
The position of mayor is a full-time position. The assembly shall set the salary of the mayor. The assembly may at any time during the mayor's term in office change the salary of the mayor; however, the change will become effective with the first meeting following the next regular election when the office of mayor is voted on.
B. 
The mayor may accept or receive remunerative employment from any other sources except those deemed to be in conflict of interest, as determined by the assembly, with his duties as mayor.

The mayor, before entering the duties of office, shall affirm orally and in writing an oath of office as provided for assembly members in DBC § 2.05.040. The oath is filed with the clerk.

A. 
The office of the mayor shall become vacant upon death, resignation, removal from office in any manner authorized by law or by this code or by the Denali Borough charter, or by forfeiture of his or her office.
B. 
The Denali Borough mayor shall forfeit his or her office if he or she:
1. 
Fails to comply with all qualifications prescribed by this code, or by the Denali Borough charter;
2. 
Fails to qualify or take office within 30 days after election or appointment;
3. 
Fails to attend three consecutive regular meetings of the assembly without being excused by the assembly;
4. 
Is physically absent from the Denali Borough for 90 consecutive days unless excused by the governing body;
5. 
Resigns and the resignation is accepted;
6. 
Is physically or mentally unable to perform the duties of office as determined by a two-thirds vote of the governing body;
7. 
Is convicted of a felony or of an offense involving a violation of the oath of office;
8. 
Is convicted of a violation of AS 15.13, State Election Campaigns;
9. 
No longer physically resides in the borough and the governing body by a two-thirds vote declares the seat vacant;
10. 
Is convicted of a felony or misdemeanor described in AS 15.56 and two-thirds of the members of the governing body concur in expelling the person elected.
C. 
Recall provisions of DBC § 2.05.090 apply to the office of mayor.

A vacancy in the office of the mayor occurring within six months of a regular election shall be filled by the assembly. The person designated shall serve until the next regular election and until a successor is elected and has qualified. If an assembly person is chosen, he or she shall resign his or her assembly seat. If a vacancy occurs more than six months before a regular election, the assembly shall call a special election to fill the unexpired term.

A. 
Responsibility Established. Executive and administrative duties are vested in the office of the mayor, who may appoint such other personnel as shall be found necessary to properly and safely accomplish the purpose of disaster emergency coordination.
B. 
Purpose. It is the desire of the borough to protect and preserve the lives, health, safety, and well-being of the people living in or visiting the borough. To this end, the disaster emergency coordinator shall be responsible for implementing the approved disaster emergency response plan and shall be the liaison with the state of Alaska Division of Homeland Security and Emergency Management.
C. 
Disaster Emergency Response Plan. The disaster emergency coordinator shall utilize the Denali Borough all-hazards plan.
D. 
No Governmental or Private Liability.
1. 
No disaster emergency coordinator or authorized emergency response personnel while in proper performance of his/her required duties shall be held liable for any damage sustained to persons or property as a result of emergency response activity except and unless gross negligence or willful misconduct is proven.
2. 
No person owning or controlling real property who allows the use of that property for disaster response activities shall be held liable for death or injury resulting from that use except and unless gross negligence or willful misconduct is proven.

A. 
The Denali Borough mayor shall submit a financial and business disclosure form in accordance with and as required by Chapter 1.30 DBC.
B. 
Participation in all borough governmental activities without the required disclosure by the mayor is prohibited.
