Chapter 238 Vehicles and Traffic

§ 238-2 Authorization for the closing of any street.

Editor's Note: This ordinance superseded former Ch. 238, adopted 10-17-1995 by Ord. No. 13-95, as amended. This article was approved 6-12-2002 by resolution of the Morris County Board of Chosen Freeholders and 9-19-2003 by the New Jersey Department of Transportation.

§ 238-1 Definitions.

Words and phrases. Whenever any words and phrases are used in this article, the meanings respectively ascribed to them in Subtitle I of Title 39 of the Revised Statues of New Jersey shall be deemed to apply to such words and phrases used herein.

Official time standard. Whenever certain hours are named in this article, they shall mean either Eastern standard time or Eastern daylight saving time as may be in current use.

The Chief of Police of this municipality is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.

Any regulations promulgated by the Chief of Police and in accordance with Subsection A above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.

Any violation of this regulation promulgated hereunder shall be punished by a fine not to exceed $50.

Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

§ 238-3 Tow-away.

Any vehicle parked in violation of this article shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace office may provide the removal of such vehicle. The owner shall bear the reasonable cost of removal and storage which may result from such removal before regaining possession of the vehicle.

§ 238-4 Penalties. [1]

Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this article or any supplement or attachment thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days, or both.

§ 238-7 Traffic controls for street and highway construction and maintenance operations for roadways under municipal jurisdiction.

§ 238-5 Effect of ordinance.

If any part or parts of this article are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this article.

§ 238-6 Repeal.

All former traffic ordinances of the Borough of Florham Park are hereby repealed, and all of the ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this article are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this article.

Adoption of the Manual on Uniform Traffic Control Devices for Streets and Highways.

When the Borough of Florham Park Council finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations and utility work, above or below ground, which requires blocking the street and obstructing the normal flow of traffic, and that such obstructions are or can become dangerous when not properly controlled, in order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through and around construction and maintenance zones and to provide safety for the work forces performing these operations.

The Borough of Florham Park, in the County of Morris, State of New Jersey, does hereby adopt the current Manual on Uniform Control Devices of Streets and Highways hereafter known as the MUTCD, except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor or utility who fails to comply with the provisions of the MUTCD while performing such work is in violation of this section.

Preconstruction meetings. It shall be the responsibility of the person, contractor, or in the case of the public utility as required under the public utility agreement, Section 16:25-9.2, wishing to conduct work on, under or above the street to contact the Police Department of the Borough of Florham Park in order to arrange a preconstruction meeting in order to submit plans for the safe movement of traffic during such period of construction or work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or those whose plans are not approved by the Police Department of the Borough of Florham Park is in violation of this section.

Hazardous conditions. The person, contractor or utility shall provide at least two emergency phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If, for any reason, emergency contact be made, or if the emergency contact person does not respond to the call from the Police Department to correct such hazardous conditions, the Borough may respond to correct the hazardous condition(s). The reasonable fees for such emergency services by the Borough shall be charged to the person, contractor or utility responsible for the condition.

Hours. There shall be no construction, maintenance operations or utility work on any roadway in the Borough before the hour of 9:00 a.m. or after 4:00 p.m. The time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the officer in charge of the Township Police Department. If it is determined by the officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. to 4:00 p.m.

Road closing. Road closing and/or traffic detours shall not be permitted unless approved by the Borough Police Department.

Traffic directors. Traffic directors shall be posted at all construction or maintenance sites when determined by the Borough Police Department that same is necessary to provide for the safety and expeditious movement of traffic.

Stop work. The Borough Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, backfilling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any other violation of this section.

Site preparation. It is to be expressly understood that no materials, vehicles or equipment are to be placed in the roadway or sidewalk until all construction signs, light devices and pavement markings are installed.

Violations and penalties.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for the first offense, pay the fine of not less than $100 nor more than $500 and/or be imprisoned in the county jail for a term not exceeding 90 days. For a second offense, upon conviction thereof, pay a fine of no less then $250 and/or be imprisoned in the county jail for the term not exceeding 90 days.

§ 238-8 Parking regulations not exclusive.

A separate offense shall be deemed committed on each day during or on which violation occurs or continues.

The provisions of this article imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

§ 238-9 Parking prohibited during state of emergency.

Upon declaration of an emergency, there shall be no parking upon the streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.

The effectiveness of this section is contingent upon the signs being erected as required by law.

§ 238-10 Temporary parking prohibition for snowplowing and removal.

Removal.

Whenever snow has fallen and the accumulation is such that it covers streets and highways, an emergency shall exist, and no vehicle shall be parked on the streets or highways or portions thereof indicated.

§ 238-11 Stopping or standing prohibited during certain hours on certain streets.

The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.

Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable cost of the removal and storage which may result from such removal before regaining possession of the vehicle.

§ 238-12 Parking time limited on certain streets.

No person shall park a vehicle for longer than the time limit between the hours listed on any day (except Sundays and public holidays) upon any of the streets or parts of streets described.

§ 238-17 Parking of certain trucks, vehicles and trailers prohibited.

§ 238-19 Routes for trucks over four tons.

Pursuant to N.J.S.A. 40-67 -16.1, the streets or parts of streets as described are hereby designated as routes for vehicles over four tons. All trucks having a total combined registered gross weight of vehicle plus load in excess of four tons shall be excluded from all streets, except from those streets listed which form a part of the system of truck routes. Vehicles will be permitted on all streets for the purpose of the pickup and delivery of materials.

§ 238-25 Multi-way stop intersections.

§ 238-25.1 Stop/yield intersections.

Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections herein described are designated as stop/yield intersections. Stop signs or yield signs shall be installed as provided herein.

The intersection of Brooklake Road and Hanover Road is hereby designated as a stop/yield intersection. A stop sign shall be installed on the southbound approach of Hanover Road at Brooklake Road controlling the left turn movement from southbound Hanover Road to eastbound Brooklake Road. A yield sign shall be installed on the southbound approach of Hanover Road at Brooklake Road controlling the right turn movement from southbound Hanover Road to westbound Brooklake Road.[1]

Editor's Note: Former Subsection B, designating the intersection of Columbia Turnpike and Fernwood Road as a stop/yield intersection, which immediately followed this subsection, was repealed 5-21-2002 by Ord. No. 8-02.

§ 238-26 Yield intersections.

Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described are hereby designated as yield intersections. Yield signs shall be installed as provided therein.

§ 238-27 Turn prohibitions.

No person shall make a turn at any location listed and only in the manner described, with the exception of authorized emergency vehicles, and only in the manner described.

Signs, pavement markings, installation and maintenance. The owners of the premises referred to in §§ 238-37C, D and E shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Florham Park. The owner shall be responsible for the repair and restoration of same.

§ 238-38 Control for the movement and the parking of traffic on public and private property.

Regulation for the movement and the parking of traffic on municipal property and Board of Education property. In accordance with the provisions of N.J.S.A. 39:4-197, the following municipal and Board of Education property shall have the movement of traffic controlled by the type of regulation indicated. No person shall operate or park a vehicle in violation of the regulations indicated.

Article II Electric Scooter and Electric Bicycle Regulations

§ 238-45 Intent and purpose.

The purpose and intent of this article is to establish regulations and guidelines for the operation of low-speed electric bicycles and low-speed electric scooters within the Borough of Florham Park. It is not primarily intended to penalize individuals who operate electric bicycles or scooters in violation of the provisions contained herein, but rather to educate both children and adults regarding proper and safe riding practices, to ensure their safety and welfare, the safety and welfare of motorists and pedestrians, and to make riding an enjoyable experience.

§ 238-46 Applicability of this article.

The provisions of this article shall apply to all roadways under the jurisdiction of the Borough of Florham Park and subject to regulation by the Mayor and Council of the Borough of Florham Park, and all facilities, parks, property and public sidewalks within the Borough owned by, or under the control or supervision of, the Borough of Florham Park.

This article shall not apply to, nor shall it be construed to regulate, directly or indirectly, in any manner, the use or operation of any powered or motorized wheelchair, medical device, mobility scooter or similar mobility assisting devices designed for use by persons with disabilities, medical conditions or by persons whose ambulatory mobility has been impaired by age or illness.

Nothing in this article shall be construed to apply, regulate or prohibit activity that is exempt from, or not subject to, Borough regulation pursuant to state law. If any provision of this article is inconsistent with the statutes and/or regulations of the State of New Jersey, the state statutes and/or regulations shall prevail. Nothing in this article is intended, nor shall be construed, to supersede any applicable state laws.

§ 238-47 Definitions.

As used in this article, the following words, terms and their derivations shall have the following meanings unless their use in the text of this article clearly demonstrates a different meaning:

BOROUGH FACILITY, PARK OR PROPERTY

Shall mean and include all buildings, facilities, structures, parks, recreation facilities, playgrounds, athletic fields, beaches, parking lots and other lands and real property owned or under the control or supervision of the Borough of Florham Park upon which the public is invited or upon which the public is permitted, including but not limited to any parking area, driveway or drive aisle.

LOW-SPEED ELECTRIC BICYCLE

Shall mean and include a two- or three-wheeled vehicle with fully operable pedals and an electric motor of less than 750 watts, that meets the requirements of one of the following classifications: "Class 1 low-speed electric bicycle," which means a low-speed electric bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle reaches the speed of 20 miles per hour; or "Class 2 low-speed electric bicycle," which means a low-speed electric bicycle equipped with a motor that may be used exclusively to propel the bicycle, and that is not capable of providing assistance when the bicycle reaches the speed of 20 miles per hour. This term shall not include: electric personal assistive mobility devices, motorized wheelchairs, mobility scooters or similar mobility assisting devices used by persons with physical disabilities, or persons whose ambulatory mobility has been impaired by age or illness.

LOW-SPEED ELECTRIC SCOOTER

Shall mean and include a scooter with a floorboard that can be stood upon by the operator, with handlebars, and an electric motor that is capable of propelling the device with or without human propulsion at a maximum speed of less than 19 miles per hour. This term shall not include: electric personal assistive mobility devices, motorized wheelchairs, mobility scooters or similar mobility assisting devices used by persons with physical disabilities, or persons whose ambulatory mobility has been impaired by age or illness.

MOTORIZED BICYCLE

Means and includes a pedal bicycle having a helper motor characterized in that either the maximum piston displacement is less than 50 cc. or said motor is rated at no more than 1.5 brake horsepower or is powered by an electric drive motor and said bicycle is capable of a maximum speed of no more than 25 miles per hour on a flat surface or a pedal bicycle having an electric motor that is capable of propelling the bicycle in excess of 20 miles per hour with a maximum motor-powered speed of no more than 28 miles per hour on a flat surface. This term shall not include a low-speed electric bicycle or low-speed electric scooter as defined in this article.

MOTORIZED SCOOTER

Means and includes a miniature motor vehicle and includes, but is not limited to, pocket bikes, super pocket bikes, scooters, mini-scooters, sport scooters, mini choppers, mini motorcycles, motorized skateboards and other vehicles with motors not manufactured in compliance with Federal Motor Vehicle Safety Standards and which have no permanent Federal Safety Certification stickers affixed to the vehicle by the original manufacturer. This term shall not include: electric personal assistive mobility devices, motorized bicycles, low-speed vehicles, low-speed electric bicycles, or low-speed electric scooters; or motorized wheelchairs, mobility scooters or similar mobility assisting devices used by persons with physical disabilities, or persons whose ambulatory mobility has been impaired by age or illness.

PEDESTRIAN

Means and includes a person who is a foot and who is not operating, seated on, riding, occupying, entering into or alighting from a low-speed electric bicycle, low-speed electric scooter, vehicle or other motor propelled device.

SIDEWALK

Means and includes any sidewalk owned, controlled or maintained by the Borough. The term shall not include sidewalks or walkways on private property in shopping centers, apartment complexes, office building sites or any other private property.

§ 238-48 Application of traffic laws to low-speed electric bicycles and low-speed electric scooters.

Every person operating a low-speed electric bicycle or low-speed electric scooter upon any roadway shall, independent of this article, be granted all the rights and shall be subject to all the duties applicable to the driver of a vehicle pursuant Chapter Four of Title 39 of the New Jersey Revised Statutes and the Borough Code, except as to those provisions thereof which by their nature can have no application to such persons.

§ 238-49 Operation of low-speed electric bicycles and low-speed electric scooters.

Obedience to traffic control devices.

Any person operating a low-speed electric bicycle or low-speed electric scooter on any Borough roadway shall observe and obey all traffic control signals, signs and other control devices in the same manner and to the same extent as required of the operator of a motor vehicle, except and unless otherwise directed by a police officer or exempted pursuant to the provisions of this article or official signage.

Whenever authorized signs are posted indicating that a turning movement is restricted, no person operating a low-speed electric bicycle or low-speed electric scooter shall disobey the direction of any such sign, except where the operator dismounts from the low-speed electric bicycle or low-speed electric scooter to make the turn, in which event such person shall then obey the regulations applicable to pedestrians.

No person shall ride or operate a low-speed electric bicycle or low-speed electric scooter in any direction on any Borough roadway, except that permitted of vehicular traffic traveling on the same side of the roadway.

A person operating a low-speed electric bicycle or low-speed electric scooter on a Borough roadway is not required to register the low-speed electric bicycle or low-speed electric scooter, furnish proof of insurance, or have a driver's license.

Riding on Borough roadways and bicycle paths generally.

Any person operating a low-speed electric bicycle or low-speed electric scooter upon a Borough roadway shall ride as near to the right-hand side of the traveled roadway as practicable under the circumstances, exercising due care when passing a standing vehicle or one proceeding in the same direction.

No person shall ride or sit as a passenger on a low-speed electric bicycle or low-speed electric scooter while the device is in motion on any Borough roadway unless there is proper seating for both rider and passenger and each such person under 17 years of age is wearing a properly fitted and fastened protective helmet.

Any person operating a low-speed electric bicycle or low-speed electric scooter on a Borough roadway shall stop for pedestrians in crosswalks.

No person operating, riding on or using a low-speed electric bicycle or low-speed electric scooter, or other similar powered device, shall connect or attach themselves, any passenger or the low-speed electric bicycle or low-speed electric scooter on which they are riding to any vehicle upon a Borough roadway.

No person operating or riding on any low-speed electric bicycle or low-speed electric scooter shall tow or pull any object of any kind while such device is in motion on any Borough roadway.

(6)

No person shall use a wireless telephone or other electronic communication device while operating a low-speed electric bicycle or low-speed electric scooter on any Borough roadway, except when the telephone is a hands-free wireless telephone or the electronic communication device is used hands-free, provided that its placement does not interfere with the operation and the operator exercises a high degree of caution.

Every person operating a low-speed electric bicycle or low-speed electric scooter on a bike path that is about to enter or cross a roadway shall yield the right-of-way to all traffic on such roadway.

(8)

No person operating a low-speed electric bicycle or low-speed electric scooter on a Borough roadway shall carry any package, bundle, or article which prevents the operator from keeping both hands upon the handlebars.

(9)

Any group of two or more persons operating any low-speed electric bicycle or low-speed electric scooter shall travel in single file, except and unless the volume of vehicles and traffic conditions are such that side by side travel is safe under the circumstances.

(10)

Whenever a bicycle lane has been established on a Borough roadway, any person operating a low-speed electric bicycle or low-speed electric scooter shall ride within the bicycle lane.

No person under 17 years of age shall operate, or ride upon, a low-speed electric bicycle or low-speed electric scooter as a driver or passenger on any Borough roadway, unless that person is wearing a properly fitted and fastened protective helmet.

Operation on sidewalks.

No person shall use or operate any low-speed electric bicycle, low-speed electric scooter, motorized bicycle, motorized scooter, motor vehicle or any other motor powered or equipped device on any sidewalk within the Borough, except that this prohibition is not intended to regulate or prohibit pedestrian activity, nor the use or riding of bicycles and other non-motor-equipped wheeled devices that are powered to motion exclusively by human muscle, on the sidewalk.

Bicycles and other non-motor-equipped wheeled devices that are powered to motion exclusively by human muscle shall be permitted on sidewalks within the Borough.

Any person operating a low-speed electric bicycle, low-speed electric scooter, motorized bicycle or motorized scooter, upon dismounting from such low-speed electric bicycle, low-speed electric scooter, motorized bicycle or motorized scooter, may stand, walk and travel freely on and about the sidewalk with, and while walking or pushing, a low-speed electric bicycle, low-speed electric scooter, motorized bicycle or motorized scooter.

The operator of a low-speed electric bicycle or low-speed electric scooter emerging from an alleyway, driveway, or building shall, upon approaching a sidewalk area extending across any alleyway or driveway, yield the right-of-way to all pedestrians or bicyclists approaching on the sidewalk or sidewalk area. Upon entering the Borough roadway, the user shall yield the right-of-way to all vehicles approaching on the roadway.

Operation on and within Borough facilities, fields and property.

The operation and use of low-speed electric bicycles, low-speed electric scooters, motorized bicycles or motorized scooters on, within or upon any Borough facility, park and property, including recreational areas, fields, lawns, trails, grass or pathways owned or controlled by the Borough, as well as any driveway, parking lot or other paved surface therein, regardless of the surface of such area, is prohibited, except in such areas where explicitly permitted by way of an official Borough sign posted at such location.

Parking, generally.

Low-speed electric bicycles and low-speed electric scooters are permitted to be secured on any bicycle rack located at Borough facilities.

When available, low-speed electric bicycles and low-speed electric scooters shall be parked in designated, marked parking areas when on any Borough property or facility.

Low-speed electric bicycles and low-speed electric scooters may be attached or secured to the bicycle rack with a U-lock, chain lock, or any type of lock made specifically for bicycles and/or low-speed electric bicycles and low-speed electric scooters. No person shall attach or secure a low-speed electric bicycle or low-speed electric scooter to any fixed object not suited for electric scooter or electric bicycle parking.

§ 238-50 Abandonment of low-speed electric bicycles and scooters.

No person shall leave low-speed electric bicycle or low-speed electric scooter lying on or standing upon a sidewalk in such a manner as to block or impede pedestrians. A person may temporarily leave a low-speed electric bicycle or low-speed electric scooter parked on the sidewalk, provided that it does not block or impede the safe and orderly movement of pedestrians upon the sidewalk and provided further that the low-speed electric bicycle or low-speed electric scooter shall be parked to side of the paved surface area.

No person shall leave or park a low-speed electric bicycle or low-speed electric scooter on or at any Borough Property or business or private property within the Borough where prohibited by the owner.

(6)

No person shall leave or park a low-speed electric bicycle or low-speed electric scooter in such a manner as to block or impede access, entry or pedestrian travel to or from any Borough facility.

(7)

No person shall park a low-speed electric bicycle or low-speed electric scooter upon a street other than upon the roadway against the curb or in a designated bicycle, electric scooter, or electric bicycle parking area in a rack to support the electric scooter or electric bicycle, or against a building or at the curb.

Lamps and equipment. A low-speed electric bicycle or low-speed electric scooter operated during non-daylight hours shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least 500 feet to the front with a lamp emitting a red light visible from a distance of 500 feet to the rear.

No person shall operate a low-speed electric bicycle or low-speed electric scooter on any business or private property within the Borough where a sign is posted by the property or business owner prohibiting such use or operation.

Prohibited Modifications. Pursuant to Title 39 of the New Jersey Revised Statutes, no person shall tamper with or modify any low-speed electric bicycle or low-speed electric scooter so as to change the motor-powered speed capability or otherwise exceed the maximum speed allowable by law for such device. Notwithstanding any other penalties authorized by law or this article, any low-speed electric bicycle or low-speed electric scooter found to have been unlawfully tampered with or modified shall be subject to impoundment in accordance with § 238-52.

A low-speed electric bicycle or low-speed electric scooter may be deemed abandoned by the Borough if:

It has been parked for a period of three or more consecutive calendar days in the same location; or

It appears visually to be in a state of prolonged disuse such that it has deflated tires, damaged or missing equipment making it inoperable, accumulated leaves and debris associated with it; or

75% or more of the low-speed electric bicycle or low-speed electric scooter is rusted; or

It is found in any other condition in which an electric scooter would be deemed abandoned.

The abandonment by any person of any low-speed electric bicycle or low-speed electric scooter within the Borough shall be strictly prohibited.

In the event that a low-speed electric bicycle or low-speed electric scooter is deemed to be abandoned by the Borough, the Police Department shall have the authority to remove and dispose of the low-speed electric bicycle or low-speed electric scooter if not otherwise removed.

§ 238-51 Enforcement.

The provisions of this article shall be enforceable by the Borough of Florham Park Police Department.

Nothing in this article shall be construed to preclude, restrict or limit any law enforcement officer from exercising their lawful authority and discretion in the enforcement of this article in accordance with the rules and regulations of the Police Department as well as Attorney General's Office and County Prosecutor's Office directives and standard and accepted police practices.

Violations of the provisions of this article may be enforced in any lawful manner the Borough of Florham Park Police Department may deem appropriate, including but not limited to in accordance with the provisions of this article independently and/or in combination with Title 39 of the New Jersey Revised Statutes and other applicable law.

§ 238-52 Violations and penalties.

Notwithstanding and in addition to any violations or penalties authorized by law, this article or the Borough Code, any person found to be in violation of any provision of this article shall, upon conviction, be subject to the following:

Operators over 18. Any person 18 years of age or older who operates a low-speed electric bicycle or low-speed electric scooter in violation of this article, or who otherwise fails to comply with the requirements of this article, shall be shall be subject to a fine of not more than $250 for the first offense, a fine of not more than $500 for the second offense and a fine of not more than $1,000 for a third or subsequent offense.

Operators under 18.

Upon a first offense, the parent(s) or legal guardian(s) of any person under 18 years of age who operates a low-speed electric bicycle or low-speed electric scooter in violation of this article, or who otherwise fails to comply with the requirements of this article, shall be subject to a fine of not more than $250 and/or the potential impoundment of the low-speed electric bicycle or low-speed electric scooter for a period of not more than seven days.

Upon a second offense, the parent(s) or legal guardian(s) of the non-adult offender shall be subject to a fine of not more than $500 and/or the impoundment of the low-speed electric bicycle or low-speed electric scooter for a period of not less than seven days, nor more than 60 days. Any low-speed electric bicycle or low-speed electric scooter impounded by the Borough of Florham Park Police Department shall only be releasable to the parent(s) or legal guardian(s) of the non-adult offender.

Upon a third or subsequent offense, the parent(s) or legal guardian(s) of the non-adult offender shall be subject to a fine of not more than $1,000, and the impoundment of the low-speed electric bicycle or low-speed electric scooter pending a hearing as to the continued impoundment of the low-speed electric bicycle or low-speed electric scooter in accordance with standard practice and procedures. Any low-speed electric bicycle or low-speed electric scooter impounded by the Borough of Florham Park Police Department shall only be releasable to the parent(s) or legal guardian(s) of the non-adult offender.
