MOBILE
Means any transportable automobile, trailer, container, or equipment that may be used as mobile food vending equipment.
MOBILE FOOD VENDING EQUIPMENT
Means any automobile, trailer, or other equipment designed and used for cooking, preparation, assembling, and/or serving of a full or limited menu of single service food or beverage items from the vehicle for use by consumers.
MOBILE FOOD VENDOR
Means the owner of any mobile food vending equipment and/or any person driving and/or selling food items from the mobile food vending equipment.

A. 
All persons, merchants, operators, owners, and persons driving and/or selling food items from mobile food vending equipment shall, before selling any item, product, merchandise, or commodity, complete an application for a license or a renewal and pay the required fee as provided in the city's fee schedule, including any investigative fee in the amount as proved in the City's fee schedule for new applicants. Such a mobile food vendor may commence business upon issuance of the license.
B. 
Any operator, owner, or person driving and/or selling food items from mobile food vending equipment shall be required to pay gross receipts on their sales.
C. 
To obtain a business license, the applicant must adhere to the requirements of Chapter 605 regarding business licenses with additional requirements as follows:
1. 
An inspection by the County Health Department must be completed which indicates the facility and foods served are following all State and local laws.
2. 
Provide proof of a general liability policy, in the name of the business owner, insuring the amount outlined in the City's risk management policy and provide proof of vehicular insurance coverage on units required to be licensed by the State Department of Revenue.
D. 
Such license shall specifically designate the location of the mobile food vendor's operation and shall in no way authorize or empower the holder thereof to block or impede the flow of vehicular or pedestrian traffic upon the public rights-of-way of the City. It shall be unlawful for any mobile food vendor to operate without the location designated in the license.

A. 
No mobile food vendor shall operate on City streets in residential areas or impede commercial business by blocking roadways or signage. If directed by a Police Officer, or any other authorized public personnel, operations may be suspended and a mobile food vendor may be ordered to move, even if located in a mobile food vending zone, to avoid congestion or impeding traffic.
B. 
No mobile food vendor can sell within a City facility.
C. 
No mobile food vendor may offer for sale or display a food item on any public property, including streets and parking lots, unless the mobile food vendor has received permission from City Council as it pertains to a special event. In any case, the mobile food vending equipment shall not be left unattended in a public right-of-way, nor parked overnight in a public right-of-way.
D. 
Mobile food vending equipment must be located on an approved hard surface on a property with an active primary business. Parking is not allowed on grass or other landscaped areas.
E. 
Exceptions for mobile food vendors, such as ice cream trucks, shall be allowed to sell merchandise on the public right-of-way under the following circumstances:
1. 
The operator does not stop on the public right-of-way for a period longer than five minutes; and
2. 
The operator does not impede the flow of traffic.
F. 
The use of outdoor amplifying equipment, lights, or any other illuminated or noisemaking devices is prohibited, except for the lighting of the menu attached to the side of the mobile food vending equipment providing only enough light for customers directly in front of or nearby to the menu to read or the in the ordering area. All signage shall have a professional appearance. Exceptions may be requested and made with City Council approval.
G. 
There shall be no gray water drains coming from the mobile food vending equipment. All gray water must be disposed of properly offsite.
H. 
All mobile food vendors shall have at least one (1) trash receptacle provided for public use immediately adjacent to the mobile food vending equipment. The mobile food vendor shall contain all refuse generated from the vendor's operation and dispose of grease and trash appropriately.
I. 
All power required for the mobile food vendor equipment shall be self-contained and shall not draw power from the public right-of-way unless approved by the City Council. The mobile food vendor shall be responsible for containing and maintaining power cords or other power equipment in a safe manner for the public. No power cable or equipment shall be extended at grade or overhead across any public street, alley, or sidewalk.
J. 
All water sources must be approved by the County Health Department and maintained in a safe manner for the public. No water lines or sources of water shall be extended above grade across any public street, alley, or sidewalk. Any water lines or sources of water on private property that are extended above grade must not present a trip hazard and shall be installed in a safe manner.
K. 
All mobile food vendors shall provide access to a restroom or sanitary facility within a reasonable distance for employee use. If there is only one (1) employee, that restroom facility must be adjacent to the mobile food vendor equipment.
L. 
All mobile food vending equipment must be presentable and considered an asset to its location. It must be serviceable and in good repair to promote a positive look and feel.
M. 
Mobile food vending operations are prohibited within one hundred (100) feet from the front door of a restaurant unless the vendor is otherwise provided written consent.
N. 
Mobile food vending operations are prohibited in spaces adjacent to bus stops, disabled loading zones, or directly in front of a business entryway.
