[HISTORY: Adopted by the Mayor and Council of the Borough of Hamburg 3-7-1977 as Ch. VII of the 1976 Revised General Ordinances. Amendments noted where applicable.]
Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight saving time as may be in current use in the Borough.
The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

A.
Parking during snowstorms. No person shall stop or park any automobile or other vehicle on or upon any public street or roadway or municipal parking lot or on or upon any street or roadway where the Borough provides snow plowing services to a qualified private community pursuant to N.J.S.A. 40:67-23.3 during a snowstorm or when roads are snow-covered at any time; nor shall any person stop or park any automobile or other vehicle so as to interfere in any way with the plowing and removal of snow from any public street or roadway or municipal parking lot or street or roadway where the Borough provides snow plowing services to a qualified private community pursuant to N.J.S.A. 40:67-23.3.
B.
Vehicle removal. Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.

Hamburg Elementary School.
(1)
No person shall park a vehicle at any time in that area designated as a fire lane on the premises of the Hamburg Elementary School, located at 30 Linwood Avenue, Hamburg, New Jersey. Said fire lane areas are shown and designated as "Drop Off Zone" on a certain plat prepared by Maser Consulting, P.A., dated October 31, 2001, latest revision December 21, 2001, Sheet 4 of 10, said map entitled “Preliminary and Final Major Site Plans for Borough of Hamburg Board of Education Proposed School Expansion, Dimension Plan, Lots 3, 6, and 7, Block 25, Borough of Hamburg, Sussex County, New Jersey. A copy of the aforesaid map is on file in the Municipal Clerk’s office in the Borough of Hamburg and is available for inspection during regular business hours.

In addition to the prohibition against parking a vehicle in a fire lane as designated in § 203-5.1A, no person shall park a vehicle at any time in the following area designated as a fire lane on the premises of the Hamburg Elementary School, located at 30 Linwood Avenue, Hamburg, New Jersey: that area marked in cross-hatched fashion as "FIRE LANE" on the opposite side of the drop-off zone on the access road shown and designated on a certain plat prepared by Maser Consulting, P.A., dated October 31, 2001, latest revision December 21, 2001, Sheet 4 of 10, said map entitled "Preliminary and Final Major Site Plans for Borough of Hamburg Board of Education Proposed School Expansion, Dimension Plan," Lots 3, 6, and 7, Block 25, Borough of Hamburg, Sussex County, New Jersey. A.
No person shall park a motor vehicle as defined in N.J.S.A. 39:1-1 on the front yard of any residence except on asphalt or concrete surfaces; provided, however, gravel surfaces in use for parking at the time of the passage of this section may continue to be used for parking but not expanded.
B.
"Front yard" shall mean an area extending across the full width of a lot lying between the abutting street line and the nearest part of the residential building on the lot.
C.
The terms of this section shall not apply to qualified private communities as defined in N.J.S.A. 40:67-23.2e.

No person shall park a vehicle at the municipal parking lot located at 16 Wallkill Avenue, Hamburg, New Jersey, except for Hamburg Borough officials and employees and persons while doing business at the municipal building.

As used in this section, the following terms shall have the meanings indicated:
A. ENGINE BRAKING
Definitions.
The use or operation of any mechanical exhaust device designed to aid in the braking, decompression or declaration of any motor vehicle which results in the excessive, loud, unusual or explosive noise from such vehicle.
B.
Prohibition. It shall be unlawful for the driver of any motor vehicle to use or operate or cause to be used or operated, at any time and on any road within the Borough of Hamburg, any mechanical exhaust or decompression device which results in the practice known as "engine braking."
C.
Exceptions. The provisions of this section shall not apply where engine braking is necessary for the protection of persons and/or property which cannot be avoided by application of an alternative braking system. Noise caused by the application of engine compression brakes, otherwise known as "engine braking," which is effectively muffled, or if the application is necessary for the health, safety and welfare of the community, is exempt from the provisions of this section. Sounds created by emergency equipment for emergency purposes are also exempt.
D.
Posting of signs. The Borough is hereby authorized to post, at reasonable locations within the Borough, signs indicating the prohibition of engine braking.
E.
Violations and penalties. Unless another penalty is expressly provided by New Jersey statute, any person convicted of a violation of this section shall be punished, for a first conviction thereof, by a fine of not more than $100 or by imprisonment for a period not to exceed 10 days, or by both such fine and imprisonment. For a second such conviction, such person shall be punished by a fine of not more than $200 or by imprisonment for a period not to exceed 20 days, or by both such fine and imprisonment. Upon the third or any subsequent conviction, such person shall be punished by a fine of not more than $500 or by imprisonment for a period not to exceed six months, or by both such fine and imprisonment.

A.
Hamburg Village. The provisions of Subtitle One, Title 39,[1] of the revised statutes of New Jersey shall be made applicable to the semipublic roads, streets, driveways and parking lots at the Hamburg Village located in the Borough of Hamburg, County of Sussex, State of New Jersey, and the following regulations shall be enforceable:

All vehicles must park only in designated areas and between the lines provided.
(2)
Handicapped parking. All stalls shall be 12 feet wide as shown on the attached site plan[2] and signed with R7-8 (reserved parking sign and penalty plate), in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

Falcon Ridge "Phase I." Subtitle One of Title 39[3] of the revised statutes of New Jersey is made applicable to the semipublic roads, streets, driveways and parking lots at Falcon Ridge "Phase I," Hamburg, New Jersey, which area is particularly shown and designated on a map entitled "Final Site Plan for Falcon Ridge 'Phase I' as-built," prepared by Canger and Cassera, dated April 5, 1989, and the following regulations shall apply:

No person shall park a vehicle on Block 5, Lots 6, 6X and 7 where the parking space is designated for parking for emergency service personnel, Borough employees and other designated personnel as may be determined from time to time by resolution of the Mayor and Council.

The Chief of Police or his/her designee is hereby authorized to temporarily close the vehicle traffic on any street or portion thereof and/or prohibit parking on any street or portion thereof, whenever in his/her judgment such action is necessary for:

Such temporary closures or parking restrictions shall remain in effect only for the duration of the condition requiring such action.

Enforcement and penalties:
(1)
No person shall operate or park a vehicle in violation of any regulation established pursuant to this section.
(2)
In addition to any fine or penalty that may be imposed, any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and any police officer may provide for the removal of such vehicle and storage thereof. The owner shall be responsible for costs and fees as provided by § 197-4 and as the same may be amended.
