[HISTORY: Adopted by the Mayor and Council
of the Borough of Hamburg 3-7-1977 as Ch. VII of the 1976 Revised General Ordinances. Amendments
noted where applicable.]
Whenever any words and phrases are used in this
chapter, the meaning respectively ascribed to them in Subtitle I of
Title 39 of the revised statutes of New Jersey shall be deemed
to apply to such words and phrases used herein.
Whenever certain hours are named in this chapter,
they shall mean either Eastern standard time or Eastern daylight saving
time as may be in current use in the Borough.
The provisions of this chapter imposing a time
limit on parking shall not relieve any person of the duty to observe
other more restrictive provisions prohibiting or limiting the stopping,
standing or parking of vehicles as set forth in N.J.S.A. 39:4-138,
any other New Jersey statute or as hereinafter provided.

A. Parking during snowstorms. No person shall stop or
park any automobile or other vehicle in or upon the public streets
and roadways or municipal parking lots during a snowstorm or when
roads are snow-covered at any time; nor shall any person stop or park
any automobile or other vehicle so as to interfere in any way with
the plowing and removal of snow from the public streets and roadways.

B. Vehicle removal. Any unoccupied vehicle parked or
standing in violation of this section shall be deemed a nuisance and
a menace to the safe and proper regulation of traffic and any peace
officer may provide for the removal of such vehicle. The owner shall
pay the reasonable costs of the removal and storage which may result
from such removal, before regaining possession of the vehicle.

A. Hamburg Elementary School.
(1)
No person shall park a vehicle at any time in
that area designated as a fire lane on the premises of the Hamburg
Elementary School, located at 30 Linwood Avenue, Hamburg, New Jersey.
Said fire lane areas are shown and designated as "Drop Off Zone" on
a certain plat prepared by Maser Consulting, P.A., dated October 31,
2001, latest revision December 21, 2001, Sheet 4 of 10, said map entitled
“Preliminary and Final Major Site Plans for Borough of Hamburg
Board of Education Proposed School Expansion, Dimension Plan, Lots
3, 6, and 7, Block 25, Borough of Hamburg, Sussex County, New Jersey.
A copy of the aforesaid map is on file in the Municipal Clerk’s
office in the Borough of Hamburg and is available for inspection during
regular business hours.

In addition to the prohibition against parking a vehicle in a fire lane as designated in §

As used in this section, the following terms shall have the
meanings indicated:
A. Definitions.
ENGINE BRAKING
The use or operation of any mechanical exhaust device designed
to aid in the braking, decompression or declaration of any motor vehicle
which results in the excessive, loud, unusual or explosive noise from
such vehicle.
B. Prohibition. It shall be unlawful for the driver of any motor vehicle
to use or operate or cause to be used or operated, at any time and
on any road within the Borough of Hamburg, any mechanical exhaust
or decompression device which results in the practice known as "engine
braking."
C. Exceptions. The provisions of this section shall not apply where
engine braking is necessary for the protection of persons and/or property
which cannot be avoided by application of an alternative braking system.
Noise caused by the application of engine compression brakes, otherwise
known as "engine braking," which is effectively muffled, or if the
application is necessary for the health, safety and welfare of the
community, is exempt from the provisions of this section. Sounds created
by emergency equipment for emergency purposes are also exempt.
D. Posting of signs. The Borough is hereby authorized to post, at reasonable
locations within the Borough, signs indicating the prohibition of
engine braking.
E. Violations and penalties. Unless another penalty is expressly provided
by New Jersey statute, any person convicted of a violation of this
section shall be punished, for a first conviction thereof, by a fine
of not more than $100 or by imprisonment for a period not to exceed
10 days, or by both such fine and imprisonment. For a second such
conviction, such person shall be punished by a fine of not more than
$200 or by imprisonment for a period not to exceed 20 days, or by
both such fine and imprisonment. Upon the third or any subsequent
conviction, such person shall be punished by a fine of not more than
$500 or by imprisonment for a period not to exceed six months, or
by both such fine and imprisonment.

A. There is hereby established within the Borough of
Hamburg a speed limit of 35 miles per hour on the following roadways:
(1) New Jersey State Highway Route 23.
(2) New Jersey State Highway Route 94.
(3) Sussex County Route No. 517.
B. All other roadways located within the Borough of Hamburg
shall have a speed limit of 25 miles per hour.
C. Regulatory and warning signs shall be erected and
maintained to effect the above-designated speed limits as authorized
by the Department of Transportation.
Unless another penalty is expressly provided
by New Jersey Statute, every person convicted of a violation of a
provision of this ordinance or any supplement thereto shall be liable
to a penalty of not more than $50 or imprisonment for a term not exceeding
15 days or both.

A. Hamburg Village. The provisions of Subtitle One, Title
39, of the revised statutes of New Jersey shall be made applicable
to the semipublic roads, streets, driveways and parking lots at the
Hamburg Village located in the Borough of Hamburg, County of Sussex,
State of New Jersey, and the following regulations shall be enforceable:
(1) All vehicles must park only in designated areas and
between the lines provided.
(2) Handicapped parking. All stalls shall be 12 feet wide
as shown on the attached site plan and signed with R7-8 (reserved parking sign and penalty
plate), in the designated parking areas for persons who have been
issued the handicapped parking permits by the Division of Motor Vehicles.
(3) Speed limits.
(a)
The speed limits for both directions of traffic
in the parking lots shall be 15 miles per hour.
(b)
The speed limits for both directions of travel

B. Falcon Ridge "Phase I." Subtitle One of Title 39 of the revised statutes of New Jersey is made applicable
to the semipublic roads, streets, driveways and parking lots at Falcon
Ridge "Phase I," Hamburg, New Jersey, which area is particularly shown
and designated on a map entitled "Final Site Plan for Falcon Ridge
'Phase I' as-built," prepared by Canger and Cassera, dated April 5,
1989, and the following regulations shall apply:
(1) General parking.
(a)

between the lines provided.

Restricted parking. No person shall stop or

personnel, Borough employees and other designated personnel as may
be determined from time to time by resolution of the Mayor and Council.
