A code regulating retail food-handling establishments, providing for the inspection of such establishments and fixing penalties for violations is hereby established pursuant to N.J.S.A. 26:3-69.1 to 69.6. A copy of the code is annexed hereto and made a part hereof without the inclusion of the text herein.
The code established and adopted by this chapter is described and commonly known as the "Retail Food-Handling Establishment Code of New Jersey (1952)."
Three copies of the Retail Food-Handling Establishment Code of New Jersey have been placed on file in the office of the Secretary of the Board of Health for the Borough of Hamburg for examination and use by the public. Printed copies of the code and this chapter shall be available to citizens upon request for a charge to be established by the Board of Health.

A. 
No person shall operate a retail food-handling establishment unless a license or approval of an existing license to operate same shall have been issued by the Board of Health. Such license or approval of license shall be posted in a conspicuous place in the establishment.
B. 
There shall be a charge of $10 for such license or approval of an existing license for nonprofit tax-exempt food establishments. There will be a charge of $25 for such license or approval of an existing license for all other retail food establishments.
C. 
A person conducting an itinerant retail food-handling establishment shall secure a license or, if such is the holder of a license issued by the Board of Health of another jurisdiction, such license may be approved by the Board of Health and there shall be a fee of $25 charged for such licensing or approval.
D. 
No person shall operate a vehicle or wagon used in the distribution or sale of milk or cream in the Borough of Hamburg unless a license to operate same shall have been issued by the Board of Health for such vehicle or wagon.
E. 
Licenses issued or approved under the provisions of this chapter shall expire annually on December 31 of each year and application for renewal thereof shall be submitted together with the required fee prior to December 1 of each year.
F. 
A license or approval of license may be suspended or revoked for a violation by the holder of any provision of this chapter or code after an opportunity for a hearing by the Board of Health or its authorized representative.
G. 
A license or approval of a license issued by another Board of Health is not transferable.
A. 
Maximum penalty. Any person violating any of the provisions of any chapter adopted by the Board of Health of the borough shall, upon conviction thereof, pay a penalty of not less than $5 nor more than $500 for each offense. Complaint shall be made in the Municipal Court of the borough or before another judicial officer having authority under the laws of the State of New Jersey. The Court shall have the power to impose other and additional penalties provided by N.J.S.A. 26:3-77 and 26:3-78.
B. 
Separate violations. Except as otherwise provided, each and every day in which a violation of any of the provisions of any chapter adopted by the Board of Health exists shall constitute a separate violation.
C. 
Collection of fees and penalties. All fees and penalties collected under any provision of any chapter adopted by the Board of Health shall be paid to the Treasurer of the borough.
