The Mayor and Council hereby find and determine that:
A. The making, creation and maintenance of loud, unnecessary,
unnatural or unusual noises are a detriment to the peace, comfort, health
and welfare of the residents of the Borough.
B. The provisions herein are necessary to the public interest
and are for the purpose of securing and promoting the peace, health and general
welfare of the residents of the Borough.
It shall be unlawful for any person to make, continue or cause to be
made any loud, unnecessary or unusual noise which disturbs, injures or endangers
the comfort, peace, repose, welfare, safety or welfare of other persons within
the limits of the Borough.
The following acts, among others, are declared to be loud, disturbing,
unnecessary noises in violation of this chapter, but said enumeration shall
not be deemed to be conclusive:
A. Radios, televisions, phonographs and the like. The operation
of any radio, television, musical instrument, phonograph or other machine
or device for the producing or reproducing of sound in such a manner as to
be audible at the distance of 50 feet from the building, structure, vehicle
or place where it is located between the hours of 9:00 p.m. to 7:00 a.m. Monday
through Friday and between the hours of 10:00 p.m. and 8:00 a.m. on Saturdays,
Sundays and holidays.
B. The erection, excavation, demolition, alteration or repair
of any building, structure or land or the excavation or repair of any street
other than between the hours of 7:00 a.m. and 10:00 p.m. on weekdays and 8:00
a.m. and 10:00 p.m. on Saturday, unless in case of urgent necessity in the
interest of public health and safety and then only after obtaining a permit
from the Building Inspector.
C. The use or operation of any power equipment out-of-doors
such as any pile driver, steam or gasoline shovel, pneumatic hammer, derrick,
electric hoist, lawn mowing machine between the hours of 9:00 p.m. and 7:00
a.m., Monday through Friday, and between 10:00 p.m. and 8:00 a.m. on Saturdays,
Sundays and holidays.
The provisions of this chapter shall not apply to any function or activity
sponsored or under the direction of the Borough of Hamburg which shall be
specifically exempted by the governing body by resolution wherein the governing
body shall find that the good of the Borough outweighs any temporary inconvenience
caused by a violation of this chapter.
Violations of the provisions of this chapter shall be punished as provided in Chapter
1, General Provisions, Article
III.
