Article II Traffic Regulations

§ 300-12 Maximum speed limits established on certain streets.

Maximum speed limits are established on portions of specified streets, as follows, and it shall be unlawful for any person to drive a vehicle on any part of a street where a maximum speed limit applies at a higher speed than the maximum prescribed for that part of the street:

§ 300-13 Traffic signals at certain locations.

At the following locations, traffic signals as indicated below shall be erected (or are ratified if previously erected), and traffic at those locations shall be directed by those signals.

Any driver of a vehicle who disobeys the directions of any traffic signal shall, upon conviction, be sentenced to pay a fine as established by state law and costs.

§ 300-14 Intersections where turn prohibited on red signal.

The following are established as intersections where drivers of vehicles headed in the direction or directions indicated are prohibited from making a right turn (or a left turn from a one-way street into another one-way street) on a steady red signal:

§ 300-16 No-passing zones established.

The following are established as no-passing zones, and it shall be unlawful for the driver of any vehicle to overtake or pass another vehicle or to drive on the left side of the roadway in any no-passing zone:

§ 300-17 Through highways established.

The following highways are established as through highways, thus authorizing stop or yield signs to be erected facing traffic approaching every intersection with the through highway except for those intersections with traffic signals, or with exceptions or modifications as indicated below. Every driver of a vehicle approaching a stop or yield sign authorized by this section shall stop the vehicle or yield right-of-way as required by Section 3323(b) or (c) of the Vehicle Code,[1] as the case may be, and shall not proceed into or across the through highway until he has followed all applicable requirements of that section of the law:

§ 300-18 Stop intersections established.

The following intersections (in addition to intersections with the through highways established by § 300-17 [1]) are established as stop intersections, and official stop signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching the second-named street (the intersecting or through street) on the first-named street (the stop street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first-named or stop street, in the direction indicated in each case, shall stop the vehicle as required by Section 3323(b) of the Vehicle Code and shall not proceed into or across the second-named or intersecting or through street until he has followed all applicable requirements of that section of the law.

§ 300-19 Yield intersections established.

The following intersections (in addition to intersections with the through highways established by § 300-17 [1]) are established as yield intersections, and official yield signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching the second-named street (the through street) on the first-named street (the yield street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first-named or yield street, in the direction indicated in each case, shall slow down or stop the vehicle as required by Section 3323(c) of the Vehicle Code and then yield the right-of-way as required by that subsection of the Vehicle Code.

§ 300-20 Operation and use of recreation vehicles.

Definitions: for the purpose of this section, words and term listed in this subsection, as follows, shall have the following meanings:

OCCUPANT

A person who regularly resides on the property in question.

OWNER

Any person who has legal or equitable title to the property on which a recreational vehicle is being operated.

PERSON

An individual, group of individuals, a partnership, firm, association, or any other entity.

RECREATIONAL VEHICLE

(1)

All motorized vehicles, designed or redesigned or otherwise being used for off-road recreational use, including but not limited to the following:

(a)

Motorcycles.

(b)

Trail bikes.

(c)

All-terrain vehicles (ATVs).

Go-carts.

Pocket rockets.

Snowmobiles.

Any other similar motorized vehicle.

(2)

The term "recreational vehicle" shall not include motorized vehicles for law enforcement, fire, emergency, military, or other governmental purposes, or off-road motorized vehicles used as utility vehicles for agricultural, husbandry, lawn care, snow removal, business operations.

(3)

Golf carts shall not be included in the recreational vehicle restrictions when being used on an established golf course and in accordance with the establishment's golf cart use guidelines or in a community designed to accommodate the use of golf carts when used on designated cart paths and in accordance with golf cart use guidelines.

Operation and use of a recreational vehicle on private property. The following regulations shall apply for the use of a recreational vehicle on private real property:

(1)

Owner or occupant. Only the owner or an occupant shall be permitted to operate a recreational vehicle on private real property.

(2)

Setback requirements:

(a)

General rule. A person operating a recreational vehicle must remain at least 250 feet from any adjoining or adjacent property line and must remain at least 300 feet from an off-site residential dwelling.

(b)

Exception. A person may operate a recreational vehicle closer than 250 feet from any adjoining or adjacent property line or 300 feet from an off-site residential dwelling provided that the following additional requirements are followed:

For each 1/2 hour period of operation of a recreational vehicle, there must be a rest period of at least three hours in between the next operation of a recreational vehicle;

[2]

No more than two recreational vehicles may be operated at the same time;

[3]

A minimum setback of 100 feet from the property line must be maintained.

(c)

Time period. A person shall operate a recreational vehicle between the hours of 10:00 AM to 7:00 PM, prevailing time.

(d)

Dust. A person shall not generate or permit to be generated, as a result of the use of any recreational vehicle, any dust to cross over onto an adjoining or adjacent property that will interfere with the reasonable use and enjoyment of the residential use of the property, either inside or outside of the residence.

(e)

Stormwater erosion and impervious surface. A person shall not generate or permit to be generated, as a result of the use of any recreation vehicle, a surface impervious by stormwater or a condition that creates soil erosion.

Operation and use of a recreational vehicle on Township property. No person shall operate a recreational vehicle on Township property without the express written consent of the Township.

Enforcement and penalty.

(1)

A violation of this section shall be deemed to be a public nuisance and shall subject the owner of the property and/or any person operating a recreational vehicle in violation of this section to summary enforcement proceedings.

(2)

The Police Department granted jurisdiction by the Board of Commissioner, the Code Enforcement Officer, Zoning Officer, and Township Manager are authorized to make an initial determination of a violation of this section, and to enforce the provisions of this section. An initial determination of a violation of this section shall result in a verbal warning to the owner, occupant or operator of the recreational vehicle.

(3)

A second or subsequent violation shall be subject to summary enforcement proceedings and upon being found guilty thereof shall subject the violator to a fine of not less than $100 and not greater than $1,000 per violation, and in default of payment of such fine may be subject to imprisonment to the extent allowed by law for the punishment of summary offenses. Each day that a violation continues or each section of this section that is found to be violated shall be considered a separate violation.

§ 300-21 Skates, coasters, sleds and other toy vehicles.

See Chapter 255 of the Code of the Township of Spring Garden, providing for conduct with regard to skateboarding in Spring Garden Township, York County, Pennsylvania.

§ 300-22 Right turns prohibited at all times in certain locations.

The following are established as no-right-turn intersections, and it shall be unlawful for the driver of any vehicle to make a right-hand turn as set forth below:

Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine as established by state law and costs.

§ 300-23 Turns prohibited.

The following are established as intersections with turning restrictions, and it shall be unlawful for the driver of any vehicle to make a turn as set forth below:

Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine as established by state law and costs.

§ 300-24 Maximum speed limits established on certain streets during certain times.

The following are established as pedestrian crossing zones, and it shall be unlawful for the driver of any vehicle to enter a pedestrian crossing zone while a pedestrian is within said zone:
