Upon the section of Magnolia Avenue which has been marked for angle parking, vehicles shall be parked at the angle to the curb indicated by such marks and within a space indicated for parking, and not otherwise.

It shall be unlawful for the operator of a vehicle to park within a parking space reserved by an appropriate reservation sign for the use of any department of the city.

It shall hereafter be unlawful for any truck-tractor, trailer or semi-trailer (as those terms are defined by Texas Transportation Code, section 621.001) in excess of two (2) tons gross weight (as that term is defined in the Texas Transportation Code to be parked or left standing on any public street in the corporate limits of the city for more than two (2) hours.

(a) 
Purpose.
This section establishes regulations for the temporary parking and short-term occupancy of recreational vehicles (RVs) on private property within the City which shall only be allowed during major renovations and/or new construction. Its purpose is to protect public health and safety, preserve neighborhood character, and prevent long-term habitation of RVs outside approved zoning districts.
(b) 
Definitions.
For the purposes of this section:
Extended Stay:
Placement or occupancy of an RV on private property beyond the temporary parking allowance but authorized by permit.
Private property:
Any lot or parcel of land not owned by a governmental entity.
Recreational vehicle (RV):
A motorhome, travel trailer, fifth-wheel trailer, camper, or similar vehicle designed for temporary living quarters.
Temporary parking:
Placement of an RV on private property for a limited duration without permanent utility connections during and/or building of primary home.
(c) 
No temporary parking without a special use permit.
An RV may be parked on private property with a special use permit under the following conditions:
(1) 
Duration limits.
(A) 
Parking duration shall be determined by City Council.
(2) 
Occupancy.
(A) 
Occupancy is allowed only during time specified by City Council.
(B) 
The RV may not be used as a long-term dwelling or rental unit.
(3) 
Utilities and sanitation.
(A) 
Water connection is permitted on a temporary basis only.
(B) 
Wastewater discharge onto the ground or into storm drains is prohibited.
(C) 
Generator use must comply with applicable noise ordinances.
(4) 
Location requirements.
(A) 
The RV must be parked on a driveway or other improved surface.
(B) 
The RV must not block sidewalks, alleys, or public rights-of-way.
(C) 
The RV must comply with zoning setback requirements.
(d) 
Temporary RV stay permit (extended stay permit).
(1) 
Permit duration.
(A) 
A temporary RV stay permit may authorize an extended stay of up to 14 consecutive days.
(B) 
No more than two permits per property per calendar year may be issued.
(C) 
Total permitted occupancy may not exceed 28 days per year.
(2) 
Eligibility requirements.
(A) 
The property must contain a legally established primary address.
(B) 
The RV must be owned by the property owner or a guest of the property owner.
(C) 
The RV must remain roadworthy and capable of being moved at any time.
(D) 
The RV shall only be used during major renovations and/or new construction.
(3) 
Application requirements.
The applicant must provide:
(A) 
Property address and owner information.
(B) 
Requested dates of the extended stay.
(C) 
RV description (make, model, license plate).
(D) 
A plan for wastewater disposal at an approved dump station.
(E) 
Emergency contact information.
(4) 
Conditions of approval.
(A) 
Only one RV is permitted per property.
(B) 
No permanent utility hookups are allowed.
(C) 
No wastewater or graywater may be discharged on the property.
(D) 
The RV must remain on an improved surface.
(E) 
Noise, lighting, and generator use must comply with City ordinances.
(F) 
The RV may not be used as a rental unit or accessory dwelling.
(5) 
Monitoring.
(A) 
The City and/or Building Inspector will monitor the conditions to ensure they are upheld throughout the approved timeframe.
(B) 
A 6-month inspection will require a fee to verify that progress is being made on the new construction or remodel.
(6) 
Revocation.
The City may revoke a permit if:
(A) 
Any condition of approval is violated.
(B) 
The RV becomes a nuisance or safety hazard.
(C) 
False or misleading information was provided in the application.
(e) 
Prohibited uses.
The following uses are prohibited:
(1) 
Long-term habitation of an RV beyond the limits established by City Council.
(2) 
Use of an RV as a permanent residence.
(3) 
Rental or leasing of an RV as a dwelling unit.
(4) 
Permanent utility connections to an RV.
(f) 
Enforcement.
(1) 
Violations of this section may result in citations, fines, or orders to immediately remove the RV and revocation of permit.
(2) 
Each day a violation continues constitutes a separate offense and fine.
(g) 
Exemptions.
This section does not apply to:
(1) 
RV use during declared emergencies or natural disasters when temporary shelter is necessary.
(h) 
Penalty.
Any person found to have violated the provisions of this section shall be guilty of a Class C misdemeanor, which shall be punishable by a fine in accordance with section 1.01.009 of the City Code of Ordinances.
