No person who owns, possesses or harbors a dog
(male or female) shall permit or allow such dog to run loose or at
large in any street, sidewalk, lane or public place in the Village
of Great Neck Estates or upon any private property without the consent
of the owner or person in possession of said property. No dog shall
be permitted at any time to be on such street, sidewalk, lane or public
or private place unless effectively restrained in the immediate custody
and control of the owner or custodian of the dog by a chain or leash
not exceeding six feet in length.
A person who owns, possesses or controls a dog,
cat or other animal shall not permit the animal to commit a nuisance
on a sidewalk of any public place, or a floor, wall, stairway or roof
of any public or private premises used in common by the public, or
on a fence, wall or stairway of a building abutting on a public place.
The term "sidewalk" shall mean the area between the curbline and the
property line of the abutting property owner. Notwithstanding the
foregoing, the provisions hereof shall not be deemed to supersede,
replace or repeal the provisions of Local Law No. 4-1975.

Any dog found at large in any street, sidewalk,
lane or public place and not under effective restraint by a chain
or leash, as aforesaid, may be seized by any duly appointed Animal
Control Officer, peace officer or duly authorized officer or representative
of the Town of North Hempstead and confined and impounded in the public
pound maintained by the Town of North Hempstead in the County of Nassau.
A dog seized by either a Village Animal Control Officer or independent
contractor hired by the Village shall be impounded as a responsibility
of the Village. Any dog so found at large not under effective restraint,
as aforesaid, that cannot be safely seized may be destroyed by such
Animal Control Officer, peace officer or duly authorized officer.

A. Any dog so impounded may be dealt with as provided
in § 14-9 of the Town of North Hempstead Code and the Agriculture
and Markets Law of the State of New York.
B. The Animal Control Officer of the Town of North Hempstead,
and any other person duly authorized by law, may issue and serve appearance
tickets for violation of this article.

Any person violating any of the provisions of
this article, or any part thereof, shall be subject to a fine or penalty
not to exceed $50 for the first such violation, $100 for the second
such violation, and $250 for the third and each subsequent violation.
Each day that a violation is permitted shall constitute a separate
offense. Such fine or penalty shall be in addition to any redemption
fee required by law.
