No person shall operate any motorboat or any boat propelled by any gas motor-propelling device in Wickapogue Pond, Phillip's Pond, Old Town Pond, Agawam Lake, Cooper's Neck Pond or Halsey's Neck Pond.
No person shall land, cause to be landed, bring to rest or cause to be brought to rest any aircraft, whether seaplane, landplane, amphibian or otherwise, upon any of the foregoing ponds or lakes.

No person shall land, cause to be landed, bring to rest or cause to be brought to rest any airplane, helicopter or other aircraft anywhere in the Village of Southampton except in case of emergency and except at a location which the Board of Trustees, by resolution thereof, designates as an authorized location for the landing of aircraft.

A. 
As used herein the term "inboard boat" shall have the indicated meaning:
INBOARD BOAT
Every type or description of watercraft or other contrivance having an inboard motor as a source of motive power for operation on water. The term "inboard boat" includes an inboard boat designed to be operated by a person sitting, standing or kneeling on or being towed behind the boat as well as an inboard boat designed to be operated by a person sitting or standing inside the boat.
B. 
No person shall launch or retrieve any inboard boat less than 16 feet in length from the terminus of any Village road or Town Trustee road unless there is an existing launching ramp at the terminus of said road.

A. 
Purpose. The Village heliport is situate on the north side of Meadow Lane (a/k/a "Beach Road" or "Dune Road") on the parcel designated on the Suffolk County Tax Map as District 904, Section 21, Block 1, Lot 2, such parcel being owned by the Village of Southampton. The Village heliport was previously designated by the Village Board of Trustees as an authorized location for the landing of helicopters. The purpose of § 39-5 is to regulate use of the Village heliport. The regulations set forth in § 39-5 are established by the Village Board of Trustees pursuant to the Village's proprietary power.
B. 
Landing restrictions.

(1) 
From May 1 through September 15:

(a) 
Helicopter landings are only permitted between the hours of 8:00 a.m. and 7:00 p.m.
(b) 
No helicopter shall land at the Village heliport prior to 8:00 a.m. on any day.
(c) 
No helicopter shall land at the Village heliport after 7:00 p.m. on any day.
(2) 
From September 15 through October 31:

(a) 
Helicopter landings are only permitted between the hours of 8:00 a.m. and 6:00 p.m.
(b) 
No helicopter shall land at the Village heliport prior to 8:00 a.m. on any day.
(c) 
No helicopter shall land at the Village heliport after 6:00 p.m. on any day.
(3) 
From November 1 through December 31:
(a) 
Helicopter landings are only permitted between the hours of 7:00 a.m. and 4:00 p.m.
(b) 
No helicopter shall land at the Village heliport prior to 7:00 a.m. on any day.
(c) 
No helicopter shall land at the Village heliport after 4:00 p.m. on any day.
(4) 
From January 1 through the last day of February:
(a) 
Helicopter landings are only permitted between the hours of 7:00 a.m. and 5:00 p.m.
(b) 
No helicopter shall land at the Village heliport prior to 7:00 a.m. on any day.
(c) 
No helicopter shall land at the Village heliport after 5:00 p.m. on any day.
(5) 
From March 1 through April 30:
(a) 
Helicopter landings are only permitted between the hours of 7:00 a.m. and 6:00 p.m.
(b) 
No helicopter shall land at the Village heliport prior to 7:00 a.m. on any day.
(c) 
No helicopter shall land at the Village heliport after 6:00 p.m. on any day.
C. 
Other restrictions.

(1) 
Helicopters having a gross weight in excess of 15,000 pounds are prohibited from landing at the Village heliport.

(2) 
All landing approaches must be overwater approaches from Shinnecock Bay, and all departures must proceed directly from the helipad to and over Shinnecock Bay until at least one nautical mile from the Village heliport prior to turning east or west. Arrival and departure tracks must be on a vector that is less than 30° off a line perpendicular to the coastline adjacent to the heliport extending into Shinnecock Bay. Takeoffs and landings from or to the east or west over land or along the coastlines of either Shinnecock Bay or the Atlantic Ocean are inherently unsafe and are prohibited.
(3) 
Helicopters shall not sit on the helipad while awaiting the arrival of passengers.

D. 
Landing fees.

(1) 
Landing fees in the amount of $100 per landing for helicopters weighing less than 5,000 pounds and in the amount of $150 per landing for helicopters weighing from 5,000 pounds to 15,000 pounds are hereby established for helicopter landings at the Village heliport.

(2) 
The owner of a helicopter landing at the Village heliport shall be responsible for payment of the landing fee to the Village.
(3) 
The landing fee for a helicopter landing at the Village heliport shall be due and payable upon the occurrence of such landing and shall be transmitted to the Village Clerk's office promptly after such landing.
(4) 
Landing fees shall be used by the Village for the maintenance, safe operation and management of the Village heliport, including employment of personnel and purchase of equipment to monitor use of the heliport for compliance with the provisions of § 39-5.
(5) 
The provisions of this Subsection D may be amended from time to time by resolution of the Village Board of Trustees.
E. 
Exceptions.

(1) 
The restrictions set forth in subsections B and C above and the landing fees set forth in Subsection D above shall not apply to any helicopter actively in the service of any federal, state or local government agency.
(2) 
The restrictions set forth in Subsections B and C above and the landing fees set forth in Subsection D above shall not apply to any helicopter involved in an emergency landing. As used herein, the term "emergency" shall mean and include a medical emergency, an operational emergency, a police, military or civil defense emergency, or other similar emergency.

Any person who violates this article or fails to comply with any of its requirements shall, upon conviction thereof, be subject to the penalties provided in Article II of Chapter 1 of the Code of the Village of Southampton.
