Traffic control signals shall be installed and operated at the intersections of those streets set forth herein.[1]

A. 
It shall be unlawful to operate or cause to be operated a motor vehicle, trailer or semitrailer with a gross weight, including chassis, body and load, in excess of 18,000 pounds over, upon and across any hard-surfaced road under the jurisdiction of the Borough of Franklin Park, except as hereinafter set forth.
B. 
When, in the opinion of the Superintendent of Public Works of the Borough, any Borough street, road or bridge would not, by reason of deterioration, rain, snow or other climatic conditions, be seriously damaged or destroyed, he may issue or cause to be issued a special hauling permit to enable motor vehicles, trailers or semitrailers with a gross weight in excess of 18,000 pounds to be operated over, upon and across such hard-surfaced road, street or bridge under the jurisdiction of the Borough of Franklin Park.
C. 
Any person, firm or corporation or other entity desiring to operate such motor vehicle, trailer or semitrailer over, upon or across any hard-surfaced road, street or bridge under the jurisdiction of the Borough of Franklin Park shall apply for a special hauling permit upon a form of application prepared by the Borough Manager and shall execute concurrently therewith a bond in form and amount as shall be determined by the Superintendent of Public Works, which bond shall be conditioned upon and shall assure unto the Borough that the applicant shall and will, upon notice from the Borough, repair any damage to any road, street or bridge under the jurisdiction of the Borough of Franklin Park, which damage shall have been occasioned as the result of the operation of such motor vehicle, trailer or semitrailer weighing in excess of 18,000 pounds, including body, chassis and load.
D. 
Each such application shall be accompanied by a special hauling permit fee as set from time to time by resolution of Borough Council. The permit shall remain in effect for six months after its issuance. The Borough Council, the Superintendent of Public Works or a duly authorized representative of the Borough Council may revoke the special hauling permit at any time that the Borough Council, in its sole and complete discretion, may determine for any reason whatsoever.[1]

E. 
The limitations, restrictions and prohibitions set forth herein shall be designated by official signs erected and maintained at each end of that portion of any road, street or bridge affected hereby and at the intersection thereof.[2]

F. 
The provisions of this section shall not apply to Police Department equipment, snowblowers, ambulances and building equipment owned by the Borough of Franklin Park, or operated by or on behalf of the Borough of Franklin Park, or owned and/or operated by members of the Franklin Park Volunteer Fire Company No. 1, and/or owned and/or operated by members of the Emergency Medical Services Authority.
G. 
Any person, firm or corporation refusing to unload excess weight, when so ordered by a peace officer in uniform, or violating any of the provisions of this section shall, upon summary conviction before a Magisterial District Judge, be sentenced to pay a fine of not less than $100 nor more than $1,000 plus costs, including reasonable attorneys' fees incurred by the Borough, and, in default of payment of said fine and costs, to a term of imprisonment to the extent permitted by law for the punishment of summary offenses. A separate offense shall arise for each day or portion thereof in which a violation of this section is found to exist or for each provision of this section found to have been violated. The Borough may also commence appropriate actions in equity or other to prevent, restrain, correct, enjoin or abate violations of this section. All fines and penalties collected for violation of this section shall be paid to the Borough Treasurer. The initial determination of ordinance violation is hereby delegated to the Borough Manager, the Police Department, the Borough Staff, the Borough Building Inspector/Zoning Officer, the authorized designee of the Borough Manager and to any other officer or agent that the Borough Manager or the Borough Council shall deem appropriate.[3]
