A fine not to exceed $1,000, plus costs of prosecution, and, upon refusal to pay such fine and costs, imprisonment in the Dauphin County Jail for a period not exceeding 30 days shall be the sentence, upon conviction thereof, for any person who shall, in violation of this article, unreasonably make, continue or continue or cause to be made or continued any noise disturbance hereby prohibited, annoying or disturbing a reasonable person of normal sensitivities.
A. 
Hereby prohibited is operating, playing or permitting the operation or playing of any radio, television set, phonograph or similar device which produces, reproduces or amplifies sound in such a manner as to create a noise disturbance (any sound which annoys or disturbs a reasonable person of normal sensitivities) across a real property boundary. A real property boundary means an imaginary line along the ground surface and its vertical extension, which separates the real property owned by one person from that owned by another person, but not including intrabuilding real property divisions.
B. 
Also prohibited is owning, possessing or harboring any dog or animal which howls, barks, meows or makes other sounds frequently or for continuous duration which create a noise disturbance. To the end that no person in Middletown shall be deprived of or suffer unreasonable interference with peace, quiet, rest or sleep, this prohibition shall apply broadly, as in the July 1977 City of Harrisburg Ordinance No. 15, to any owner, any person having a right of property in such animal, any person who keeps or harbors such animal or has it in such person's care or any person who permits such animal to remain on or about any premises occupied by such person. Any person who violates this Subsection B shall be given notice thereof, either in writing or orally, by the Borough police. Any person who violates this Subsection B after receiving one warning shall, upon conviction thereof, be sentenced as hereinbefore provided in the first sentence of § 185-1.
