The Town of Southold provides bathing beaches and recreational facilities and parking areas adjacent thereto at various locations within the Town for the use and enjoyment of residents of the Town of Southold. The Town also has many road ends which provide access to the water. The use of such facilities by persons other than residents has increased to such an extent that such facilities have become overcrowded, with the result that residents are denied the use thereof. The Town Board therefore declares it to be the policy of the Town of Southold to restrict and regulate the parking of vehicles in the parking areas adjacent to the bathing beaches, road ends and recreational facilities described in this article in accordance with the provisions hereof.

A. 
The following beach parking areas are hereby designated as Town of Southold "Parking by Southold Town Permit Only" areas:
(1) 
Parking area adjacent to the bathing beach located at the terminus of Manhanset Avenue, Gardiners Bay, Greenport, known as and referred to herein as "Norman E. Klipp Marine Park."
(2) 
Parking area adjacent to the bathing beach located approximately 100 feet east of the intersection of County Route 48 and Sound View Avenue, Long Island Sound, Southold, known as and referred to herein as "Southold Town Beach."
(3) 
Parking area adjacent to the bathing beach located at the terminus of Horton's Lane, Long Island Sound, Southold, known as and referred to herein as "McCabe's Beach."
(4) 
Parking area adjacent to the bathing beach located at the terminus of Kenney Road, Long Island Sound, known as and referred to herein as "Kenny's Beach."
(5) 
Parking area adjacent to the bathing beach located adjacent to North Bayview Road, Town Harbor, Southold (east of Goose Creek Bridge), known as and referred to herein as "Goose Creek Beach."

Parking area located at the terminus of Mill Road, Long Island Sound, Peconic, known and referred to herein as "Goldsmith's Inlet Beach."

E. 
Failure to have or to properly display a Town parking permit shall be a violation of this Code.

The parking of vehicles is hereby prohibited between the hours of 10:00 p.m. to 6:00 a.m. in all of the parking areas designated in § 189-2.

Parking permits for parking vehicles in the parking areas designated in § 189-2 of this article shall be issued as follows:
A. 
Resident parking permit.
(1) 
A resident parking permit shall be issued by the Town Clerk or a person designated by the Town Clerk to all persons who are qualified residents of the Town of Southold. Persons applying for a resident parking permit shall be requested to submit for inspection the following as proof of residence:
(a) 
A valid tax receipt stub for the current year for any taxable real property within the Town of Southold assessed in the name of the applicant.
(b) 
A valid motor vehicle registration in the name of the applicant and to an address located within the Town of Southold or to an address corresponding to the address of a validated tax receipt stub for the current tax year for any taxable real property within the Town of Southold affixed to the application.
(c) 
Such other proof of residence as is satisfactory to the Town Clerk.
(2) 
The Town Clerk or a person designated by the Town Clerk shall inspect such proof of residence to determine that the applicant is a qualified resident of the Town. Upon approval, a resident parking permit shall be issued and inscribed with the vehicle license registration number. Such permit shall not be transferred to any other vehicle.
(3) 
Resident parking permits for motor vehicles shall be permanently affixed to the vehicle in a way and place to be determined by Town Board resolution.

(4) 
A resident parking permit shall be valid for two years. The first two-year permit period shall commence January 1, 2018, and terminate on December 31, 2019. Thereafter, a new two-year permit period shall commence on January 1 of every even-numbered year.
(5) 
The fee for the residential parking permit period, or any part thereof, shall be prescribed by resolution of the Southold Town Board.
B. 
Lessee parking permit.
(1) 
A lessee parking permit shall be issued by the Town Clerk or a person designated by the Town Clerk to all persons who lease or rent property within the Town of Southold but do not qualify as residents as defined in § 189-3A hereof. Persons applying for a lessee parking permit shall present a fully executed lease/rental agreement signed by the lessee and the owner of the property, setting forth:
(a) 
The location of the leased or rented property.
(b) 
The persons occupying the same.
(c) 
The term of such tenancy.
(d) 
Copy of current rental permit issued from the Southold Town Building Department or the Village of Greenport Building Department.
(2) 
Upon a determination by the Town Clerk or person designated by the Town Clerk that the applicant is entitled to a lessee parking permit and upon the payment of the permit fee, such permit shall be issued and inscribed with the vehicle license registration number and shall be affixed to the vehicle in the same manner as provided in § 189-3A(3) hereof.
(3) 
The fee for the issuance of a lessee parking permit shall be such fee as shall be prescribed by resolution of the Southold Town Board.
C. 
Hotel-motel parking permits.
(1) 
Hotel-motel parking permits shall be issued by the Town Clerk or a person designated by the Town Clerk to the owners or their designated managers of hotels, motels, bed-and-breakfasts, rooming houses or boardinghouses and trailer parks for use by the paying guests temporarily residing therein. Persons applying for a hotel-motel parking permit shall present an application to the Town Clerk in affidavit form, signed by the applicant, setting forth:
(a) 
The number of rental units available at the applicant's premises.
(b) 
The number of permits applied for.
(c) 
The designated business name, if any, of the premises applied for.
(2) 
Upon a determination by the Town Clerk or a person designated by him that the applicant is entitled to such permits and upon payment of the required permit fee, permits shall be issued; provided, however, that the number of permits issued shall not exceed the number of rental units available at the premises applied for. Such permits shall be inscribed with the name of the applicant or the designated business name of the applicant's premises and shall be used only by paying guests occupying the premises for which such permits are issued.
(3) 
Hotel-motel parking permits shall be transferable and shall be displayed on the dashboard on the passenger side of the vehicle. The owner or manager to whom such permits are issued shall make no charge for the use of such permits by such guests, but may require a deposit to ensure return of a permit.
(4) 
The fee for the issuance of a hotel-motel parking permit shall be such fee as shall be prescribed by resolution of the Southold Town Board.
D. 
Guest permits.
(1) 
Guest parking permits shall be issued by the Town Clerk or a person designated by the Town Clerk to all persons who are qualified residents of the Town of Southold, as defined in § 189-3A hereof, for use by guests temporarily residing in the dwelling of such resident. A resident applying for a guest parking permit shall present the following:
(a) 
The location of the property to be occupied by the guests.
(b) 
The names and permanent addresses of the guests.
(c) 
The length of time of the guest occupancy.
(2) 
Upon a determination by the Town Clerk or person designated by the Town Clerk that the applicant is entitled to a guest parking permit and upon the payment of the permit fee, such permit shall be issued and inscribed with the vehicle license registration number and shall be displayed in the vehicle in the same manner as provided in § 189-3A(3) hereof.
(3) 
The fee for the issuance of a guest parking permit shall be such fee as shall be prescribed by a resolution of the Southold Town Board.
E. 
Night fishing parking permit. For the purpose of ensuring fishermen and shell fishermen parking access to the beaches, creeks and waters within the Town of Southold when such parking access is normally closed (10:00 p.m. to 6:00 a.m.), the following exception to § 189-2F is hereby created:
(1) 
Night fishing parking permit. A night fishing parking permit shall be issued by the Town Clerk or a person designated by the Town Clerk to all persons who hold a resident, lessee or guest parking permit.
(2) 
Any motor vehicle having a night fishing parking permit shall be deemed not to be in violation of § 189-2F where both the night fishing permit and the resident, lessee or guest parking permit are properly displayed.
(3) 
The following rules and regulations apply:
(a) 
At the time a motor vehicle with a night fishing permit is parked at a location during a time in which parking is normally prohibited by § 189-2F, the occupants of the vehicle must have fishing equipment and be actively engaged in fishing. The permit is nontransferable and valid only for vehicles bearing the license plate number on the permit.
(b) 
Fees. There shall be no annual fee for night fishing permits.
(c) 
Duration of permits. All night fishing permits provided for in this section shall expire at the same time as the resident, lessee or guest parking permit.
(4) 
Other regulations. Persons using parking areas pursuant to the provisions of this section shall comply with all other laws, ordinances, rules, regulations and restrictions thereto.

A. 
The use of recreational areas on Fishers Island by persons other than residents has increased to such an extent that such area has become overcrowded with the result that residents are denied the use thereof. The Town Board therefore declares it to be policy of the Town of Southold to restrict and regulate the parking of vehicles at recreational facilities.
B. 
No person shall park any type of vehicle in any parking area designated here in this section as a "Parking by Permit Only" area unless such vehicle displays a valid parking permit duly issued for such vehicle in accordance with the provisions of Subsection D. In addition to the areas listed in Subsection A above, the following areas of Fishers Island are designated "Parking by Permit Only":

C. 
The Town of Southold will erect and maintain a sign at each designated location indicating "Parking by Permit only."
D. 
Parking permits for any vehicles in the parking areas designated on Fishers Island shall be issued as follows:
(1) 
Resident parking permit.
(a) 
A resident parking permit shall be issued by a Fishers Island designee of the Southold Town Clerk to all persons who are qualified residents of the Town of Southold. Persons applying for a resident parking permit shall present for inspection the following proof of residency: a valid tax receipt stub for the current year for any taxable real property within the Town of Southold assessed in the name of the applicant, or a valid motor vehicle registration in the name of the applicant at an address located within the Town of Southold, or such other proof of residence as is satisfactory to the designee.
(b) 
Upon determination by the designee that the applicant is a qualified resident of the Town, and upon payment of a fee, previously determined by Town Board resolution, a resident parking permit shall be issued and inscribed with the vehicle license registration number. Such permit shall be affixed to the right front bumper and shall not be transferred to any other vehicle.
(2) 
Lessee parking permit.
(a) 
A lessee parking permit shall be issued by the Fishers Island designee to all persons who lease or rent property within the Town of Southold but do not qualify as residents defined in Subsection D(1). Persons applying for a lessee parking permit shall indicate the location of leased or rented property, the persons occupying the same and the term of tenancy and must present to the designee as proof of tenancy verification from the property owner or managing realtor.
(b) 
Upon determination by the designee that the applicant is entitled to a lessee parking permit, and upon payment of the fee, such permit shall be issued and inscribed with the vehicle license registration number and shall be affixed to the right front bumper and shall not be transferred to any other vehicle.
(3) 
A guest parking permit shall be issued by the Fishers Island designee to all persons who are qualified for residential or lessee parking permits as defined in Subsection D(1) and (2) hereof for use by guests temporarily residing in the dwelling of such resident or lessee. The resident or lessee applying for a guest parking permit shall indicate the location of property to be occupied by the guest, the names of the guests and the length of time and guest occupancy. The guest parking permit shall be displayed in the right front dashboard area of the vehicle, shall not be transferred to any other vehicle and shall be valid during guest occupancy only.
E. 
The following beach parking areas are hereby designated as Town of Southold "No Overnight Parking" areas:
(1)

Any vehicle parked in violation of the provisions of this section or any other law, ordinance, rule, regulation or resolution may be removed or be caused to be removed by the Fishers Island Constables or the New York State Troopers.

Unless otherwise specified, all parking permits provided for in this article shall expire on December 31 of the year in which issued.
Persons using parking areas pursuant to the provisions of this article shall comply with all laws, ordinances, rules, regulations and resolutions applicable thereto.
Any vehicle parked in violation of the provisions of this article or any other law, ordinance, rule or regulation may be removed or caused to be removed by a police officer of the Town of Southold and, after such removal, stored or caused to be stored in a suitable place at the expense of the owner. The owner or person in charge of such vehicle may redeem the same upon payment to the Southold Town Police Department of the amount of all actual and necessary expenses incurred in the removal and storage of such vehicle. The said Police Department shall ascertain, to the extent possible, the owner or person in charge of such vehicle and shall notify him of the amount which will be required to redeem the same.

A. 
Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation punishable by a fine as set forth below not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
B. 
Penalty schedule.
(1) 
Fine: $75.
(2) 
Penalty at 30 days: $100.
(3) 
Penalty at 60 days: $150.
(4) 
Penalty at 90 days: $170.
