The Town Board of the Town of Lockport finds
that defraying the cost to the Town for the issuance of certain permits,
reviews, providing information, etc., will be in the best interests
of the health, safety and welfare of the citizens and property of
the Town and to that end a schedule of fees shall be established.
This chapter shall be entitled the "Town of
Lockport Fee Schedule."

The following fees shall be charged by the Town
of Lockport, its departments and agencies for the permits, reviews,
provision of records, and services until modified in accordance with
the provisions of this chapter.
(If any action or request involves more than one fee, each fee
shall be applicable.)
A. Documents
and information copies.
(1) Copies of documents from office: $0.25 per page.
(2) Maps.
(a)
Colored zoning, small: $6.
(e)
Election, school, fire district zoning, large: $15.
(3) Ordinances, laws and regulations.
(b)
Zoning Code, including map: $30.
(c)

D. Application
for rezoning: $500 plus $100 per acre or any fraction thereof over
one acre.
E. Demolition
of structure. NOTE: The basement area will be calculated into the
square footage.
(1) Zero to 500 square feet: $25.
(2) Five hundred one square feet to 3,000 square feet: $50.
(3) Three thousand one square feet to 6,000 square feet: $75.
(4) Six thousand one square feet to 9,000 square feet: $100.
(5) Nine thousand one square feet to 12,000 square feet: $120.
(6) Over 12,000 square feet: $120 plus $0.01 per square foot.
F. Public
improvement permit.
(1) Fee for review and approval of plans and specifications by engineers
(including review, comment letter, second review and approval letter)
and the review and approval and acceptance of insurance, bonds, easements,
dedications, other documents and agreements by the Town Attorney.

(2) Multi-phase residential and commercial development projects.
(a)
When the entire project is first being reviewed and approved
by the municipality, the single phase residential and commercial development
project schedule above shall be used to determine an initial fee based
on the entire acreage of the project to be developed in several phases.
(b)
An additional $500 for each subsequent phase after the first
initial phase shall be collected at the beginning of the development
of each subsequent phase and used for construction inspection.
All fees shall be paid prior to the provision
of permits, information, reviews and performance of services covered
thereby.
The Town Board may from time to time, by resolution
without public hearing, modify the fees set forth herein and provide
for additional fees for other matters.
Any existing fees inconsistent with the fees herein established are superseded in whole by this chapter, and any existing fees not inconsistent with the fees set forth herein shall remain in effect, but such fees may be amended or modified as set forth in §
90-5.

A. Legislative intent and findings.
(1) The Town of Lockport has experienced rapid growth
in its population for two decades and is expected to continue this
trend in the foreseeable future. This growth has brought with it an
increasing demand for recreation opportunities for the Town's residents.
Trends in recreational sports have been changing, leading to an increased
demand for active recreational facilities for organized sports such
as baseball and softball, soccer and other activities. Further, increased
demands have developed for recreation, including nature trails and
parks, walking and biking facilities and preserved land for passive
recreation, picnics, and the ability to enjoy undeveloped spaces.
The Town presently does not have sufficient facilities, parks and
recreation areas to address the present and future needs of its residents.
As the population continues to grow, and as more residential subdivisions
and site plans are approved, the recreational needs will significantly
increase. At the same time, as vacant land in the Town is developed
for housing and other purposes, the availability of land that is suitable
and appropriate for park and recreational facilities is rapidly disappearing.
(2) The Town Board is attempting to address this deficiency
in a comprehensive manner but is hampered by the constraints of the
unavailability of suitable lands and upward-spiraling land costs and
by the costs of developing parks and recreation areas. The Town needs
to address this deficiency adequately because of the specific needs
that pertain to properly sited and planned active and passive recreational
facilities. Scattered collections of small individual parks often
would not be suited to meet the Town's recreational needs. In order
to be suitable to meet these needs, some facilities must be large
enough to provide several active recreational facilities for the sake
of cost efficiency and to reduce transportation and other impacts
and centrally located so as to be readily accessible to the greatest
percentage of the Town's population, and some should be located in
various areas of the Town to enhance quality of life in neighborhoods
and groups of neighborhoods, and to provide passive recreational activities.
(3) Therefore, the Town Board deems it necessary to establish
fees charged to developers of new residential subdivisions and site
plans where such developers cannot provide suitable and appropriate
lands for development as parks. In this way, the Town can fiscally
plan for the recreational needs of the residents in these new subdivisions
and residential sites and ameliorate the additional strain these new
residents place on the already limited park and recreational facilities
of the Town.
B. Fee
schedule. The following fees shall be charged by the Town of Lockport
pursuant to Town Law § 277, Subdivision 4, and § 274-a,
Subdivision 6, where imposed in accordance with such sections:

(1) For each building lot within a residential subdivision consisting
of four lots or less: $250.
(2) For each building lot within a residential subdivision consisting
of five or more lots: $400.
(3) For each dwelling unit within a residential site plan: $400.
(4) For each mobile home lot within a mobile home park: $400. This fee
is in addition to private recreation areas established in a mobile
home park as required by the Town's law and regulations. If,
for any reason, such private recreation area is not developed, the
fee shall be $400 for each lot. This section does not authorize waiver
of required private recreation areas.
C. Applicability. This fee shall apply to any residential
subdivision or site plan which has not been finally approved and filed
as of the effective date of this section.
D. Changes. The amount of the fees established herein may be increased or decreased in the manner prescribed in §
90-5. The fees established herein shall become part of the Fee Schedule established in §
90-3.
E. Savings clause. If any clause, sentence, paragraph,
section or part of this chapter shall be adjudged by any court of
competent jurisdiction to be invalid, such judgment shall not affect,
impair or invalidate the remainder thereof but shall be confined in
its operation to the clause, sentence, paragraph, section or part
thereof directly involved in the controversy in which such judgment
shall have been rendered.
F. When effective. This section shall take effect immediately
upon its filing in the Office of the Secretary of State in accordance
with the Municipal Home Rule Law.
