A. 
It is hereby declared to be the policy of the Town of Lockport that the subdivision and development of land for residential, commercial, and industrial purposes shall be guided and regulated in such a manner as to meet the following requirements for orderly and harmonious growth:
(1) 
Land to be subdivided or developed shall be of such character that it can be used safely without danger to health or peril from fire, flood, erosion, excessive noise or smoke, or other menace.
(2) 
Proper provisions shall be made for drainage, water supply, sewerage, and other appropriate utility services.
(3) 
The proposed streets shall provide a safe, convenient, and functional system for vehicular circulation and shall be properly related to the Master Plan of the area. Streets shall be of such width, grade and location as to accommodate prospective traffic as determined by existing and probable future land and building uses.
(4) 
Buildings, lots, blocks and streets shall be arranged as to afford adequate light, view and air, to facilitate fire protection, and to provide ample access for firefighting equipment to buildings.
(5) 
Land shall be subdivided or developed with due regard to topography so that the natural beauty of the land and vegetation shall be protected and enhanced.
(6) 
Adequate sites for schools, parks, playgrounds, and other community services shall be located so that residents of all neighborhoods shall have convenient access to such facilities.
B. 
It is the further purpose of these regulations to promote and protect the health and welfare of the Town of Lockport and its residents.
Pursuant to the provisions of § 276 of the Town Law, the Planning Board of the Town of Lockport is authorized to approve preliminary and final plats of subdivisions showing lots, blocks or sites with or without streets or highways in the Town of Lockport and to review and approve the development of previously filed plats which are entirely or partially undeveloped. All land subdivisions shall hereafter be subject to the provisions of Town Law §§ 276 and 277 as well as the following regulations.
Unless otherwise expressly stated, the following terms shall, for the purpose of these regulations, have the meaning indicated. Words defined in the Town of Lockport Zoning Regulations[1] shall have the definition set forth therein. Words defined in Town Law § 276 shall have the definition set forth therein.
A. 
General. Words in the singular include the plural, and words in the plural include the singular. The word "person" includes a corporation or unincorporated association, and "building" includes "structure" and shall be construed as if followed by the words "or part thereof." The word "street" includes "road," "highway" and "land"; and "watercourse" includes "drain," "ditch," and "stream." The word "shall" is mandatory unless otherwise indicated.
B. 
As used in this chapter, the following terms shall have the meanings indicated:
ALLEY
A strip of land over which there is a right-of-way, municipally or privately owned, on which no building fronts, serving as a secondary means of access to two or more properties.
FINAL PLAT
A plan prepared in accordance with these regulations for final approval by the Planning Board and as further defined by Town Law § 276.
MASTER PLAN or COMPREHENSIVE PLAN
The Comprehensive Plan, or a part thereof, of the Town of Lockport adopted pursuant to Town Law § 272-a.
OFFICIAL MAP
A map established by the Town Board under § 270 of the Town Law.
OWNER
The owner of the land proposed to be subdivided, or his agent or other person having control of or legal interest in such land.
PLANNING BOARD
The Planning Board of the Town of Lockport.
PRELIMINARY PLAT
A plan prepared in accordance with these regulations for preliminary approval by the Planning Board, and as further defined by Town Law § 276.
STREET
A way for vehicular traffic, whether designated as a street, highway, thoroughfare, parkway, road, avenue, boulevard, land, drive, place or other similar designation.
SUBDIVIDER
A person who is the owner, as defined herein, of land proposed for subdivision.
SUBDIVISION
The division of any lot, tract or parcel of land into four or more lots, tracts or parcels of land during any ten-year period measured from the initial division of any lot, tract or parcel of land, or a part thereof, including changes in street lines or lot lines, for the purpose, whether immediate or future, of transfer of ownership or of building development; provided, however, that division of land for agricultural purposes into parcels of more than five acres, not involving a new street or easement of access, shall not be included within the meaning of "subdivision."

TOWN ENGINEER
Unless otherwise hereinafter indicated, the duly designated Engineer of the Town of Lockport or, if there is no such official, a licensed professional engineer retained or employed by the Town Board.
