There is hereby created the office of Municipal Court Public Defender who shall be nominated by the Mayor, with the advice and consent of the Council, at the organizational meeting, or at any time thereafter, in the event such appointment by the Mayor and Council is deemed advisable or necessary.
The term of office of the Municipal Court Public Defender, whose office is herein created, shall be at the pleasure of the Mayor and Council, but in any event shall expire on December 31 of the year in which said Municipal Court Public Defender is appointed.
The Municipal Court Public Defender shall provide all necessary and desirable legal counsel and advice required for the defense of cases in the Municipal Court of the Borough of Shrewsbury on behalf of those indigent defendants who are entitled by law to appointment of counsel and as approved by the Municipal Court Judge.
Every person who makes application to the Shrewsbury Borough Municipal Court for representation by the Public Defender in any matter pending before the Court shall pay an application fee of not more than $200. The Municipal Court may waive the required application fee, in whole or in part, if the Court determines that the application fee imposes an unreasonable burden on the person seeking representation.

The compensation of the Municipal Court Public Defender shall be such as shall, from time to time, be fixed by resolution of the Borough Council or by the Borough's Salary Resolution.[1]
