This article shall be known as the "Number of Planning Board Members of the Town of Fort Edward."
The Town Board of the Town of Fort Edward hereby determines that the character of the Town of Fort Edward has changed and, as a result, there is vast additional work required of the Planning Board members. The Town Board further determines that it is appropriate to expand the number of members of the Planning Board from five to seven.
This article is hereby enacted pursuant to the authority granted by § 271 of the New York State Town Law.
The Town Board of the Town of Fort Edward being so empowered establishes the number of members of the Fort Edward Planning Board at seven.

The Town Board shall appoint two alternate members of the Planning Board to substitute for any regular member in the event of a conflict of interest or other factor such as illness, vacation or other absences. The alternate member(s) shall be appointed by resolution of the Town Board for terms of three year(s). The Chairperson of the Planning Board may designate an alternate member to substitute for a regular member when such regular member is unable to participate in an application or matter before the Board. When so designated, the alternate member shall possess all of the powers and responsibilities of such regular member. Such designation shall be entered into the minutes of the initial Planning Board meeting at which the substitution is made. All provisions relating to Planning Board member training and continuing education, attendance, conflict of interest, compensation, eligibility, vacancy in office, removal and service on other boards shall also apply to alternate members.

With at least 20% of the area of the Town of Fort Edward being devoted to agricultural pursuits, the Town Board of the Town of Fort Edward, pursuant to Town Law § 271, Subdivision 2, is hereby empowered to appoint an additional member to said Planning Board for a term of five years from and after his appointment. Said additional member shall be required to be a person who derives more than 1/2 his annual income from agricultural pursuits.
As used in this article, the following terms shall have the meanings indicated:

The growing, producing, processing or selling of the products of agriculture.
