The uses permitted in the DU Dual Use Zone shall
be as follows:
A. Business and professional offices; agents' and brokers'
offices; banks and trust companies; medical offices for doctors, dentists
and health therapists; professional offices and studios for accountants,
attorneys, architects, engineers and artists; and studios for the
teaching of dance, drama, fine arts, language, music and photography.
B. Uses permitted in the RA Residential Apartment Zone pursuant to §
275-29. All development shall consist of joint professional office and apartment construction.
C. Public buildings structures and utilities, not including
dumps, owned and operated by the Borough, the Board of Education or
a higher governmental authority.
D. A garden center primarily involved in the retail sale
of agricultural products and related accessories shall be a conditional
use permitted in the DU (Dual Use) Zone, provided that any enlargement,
alteration or modification of the use, or the structures or buildings
on the property so used, shall require a site plan approval from the
Planning Board. Nothing contained herein shall be deemed to prevent
such a conditional user from applying to the Planning Board for a
variance if the proposed enlargement, alteration or modification is
contrary to the requirements of this chapter.

In a DU Dual Use Zone, the operation of medicinal and retail
marijuana establishments, which includes retail marijuana and/or marijuana
paraphernalia stores, marijuana cultivation facilities, marijuana
products manufacturing facilities, and marijuana testing facilities,
and the operation of retail marijuana social clubs are prohibited
within the Borough of Cresskill and, therefore, all activities related
to the above-mentioned retail uses such as, but not limited to, cultivation,
extraction, manufacturing, processing, storing, laboratory testing,
labeling, transporting, delivering, dispensing, transferring and distributing
are expressly prohibited in any zone within the Borough of Cresskill.

B. In a DU Dual Use Zone, the operation of medicinal and retail marijuana

transporting, delivering, dispensing, transferring and distributing
are expressly prohibited in any zone within the Borough of Cresskill.
All uses are subject to performance standards as set forth in Article
XV.
Site development plan approval, in accordance with Chapter
218, Site Development Plan, shall be required prior to the issuance of building permits for the erection or enlargement of all structures and related accessory structures. Such approval shall also be required prior to the issuance of certificates of occupancy for a change of use.
