No building or premises shall be used and no building or part of a building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the following, which shall be permitted, conditional upon approval as to use by the Planning Board in accordance with the procedures and subject to the general conditions set forth in Chapter
218, Site Development Plan, and all such establishments shall have at least one person in attendance during hours of operation. Permitted uses are as follows:
A. Retail stores, such as but not limited to drugstores,
food stores, luncheonettes, variety stores or combinations thereof.
B. Billiard parlors and personal service stores, such
as but not limited to barbershops, beauty parlors and tailors.
C. Service establishments furnishing services other than
of a personal nature, but excluding motor vehicle storage, repair
or service except as accessory to a permitted motor vehicle service
station.
D. Motor vehicle service stations, subject to the supplementary regulations as set forth in §
275-48C.
E. Railroad and public utility rights-of-way and structures
necessary to serve areas within the Borough, subject to such conditions
as the Planning Board may impose in order to protect and promote the
health and safety and general welfare of the community and the character
of the neighborhood in which the proposed structure is to be constructed.
F. Signs necessary to an establishment located on the same lot, provided that such signs shall be limited as set forth in Article
XIV and as follows:
(1) Not more than one such sign shall be permitted for
each tenant on the premises on each wall fronting on a street.
(2) The aggregate area, in square feet, of all signs on
any wall shall be no greater than 1/2 the length, in feet, of such
wall.
(3) Such sign or signs shall be parallel to the face of
the building, and no part thereof, including any illuminating devices,
shall project more than 12 inches beyond the face of the wall to which
applied nor any distance beyond or above the building in any other
direction.
G. Professional office uses.
H. Multifamily dwellings, both market rate and affordable, restricted
to the second and third floors only. Within the Commercial Zone, only
permitted nonresidential uses shall occupy the ground level or first
floor in a mixed-use building.

In a C Commercial Zone, the operation of medicinal and retail
marijuana establishments, which includes retail marijuana and/or marijuana
paraphernalia stores, marijuana cultivation facilities, marijuana
products manufacturing facilities, and marijuana testing facilities,
and the operation of retail marijuana social clubs are prohibited
within the Borough of Cresskill and, therefore, all activities related
to the above-mentioned retail uses such as, but not limited to, cultivation,
extraction, manufacturing, processing, storing, laboratory testing,
labeling, transporting, delivering, dispensing, transferring and distributing
are expressly prohibited in any zone within the Borough of Cresskill.
All permitted uses and all storage accessory
thereto, other than off-street parking, shall be carried on in buildings
fully enclosed on all sides.

A. All uses not listed in §
275-19 are prohibited.
B. Marijuana establishments, prohibition. The operation of medicinal
and retail marijuana establishments, which includes retail marijuana
and/or marijuana paraphernalia stores, marijuana cultivation facilities,
marijuana products manufacturing facilities, and marijuana testing
facilities, and the operation of retail marijuana social clubs are
prohibited within the Borough of Cresskill and, therefore, all activities
related to the above-mentioned retail uses such as, but not limited
to, cultivation, extraction, manufacturing, processing, storing, laboratory
testing, labeling, transporting, delivering, dispensing, transferring
and distributing are expressly prohibited in any zone within the Borough
of Cresskill.
Site development plan approval, in accordance with Chapter
218, Site Development Plan, shall be required prior to the issuance of building permits for the erection or enlargement of all structures and related accessory structures and prior to the issuance of certificates of occupancy for any change of use.
All uses are subject to performance standards as set forth in Article
XV.
