The provisions contained in this chapter are enacted pursuant to the municipal regulatory authority conferred in N.J.S.A. 40:48-1 and the municipal police power conferred in N.J.S.A. 40:48-2. They are also enacted pursuant to Title 45 of the New Jersey Statutes Annotated titled "Professions and Occupations."
It shall be the duty and responsibility of the Bureau of Permits and Inspections to enforce the provisions of this chapter.
A. 
The Bureau of Permits and Inspections shall have those powers which are necessary to carry out the purpose and intent of the regulations contained in this chapter, including, but not limited to, the following enumerated powers.
(1) 
To investigate commercial, industrial, institutional and residential uses within the community to determine which premises and structures have activities or uses which are regulated by this chapter.
(2) 
To inspect those premises and structures which have activities or uses regulated by this chapter to insure compliance with the regulations contained herein.
(3) 
To coordinate with and obtain information from other employees of the City who have relevant information or overlapping duties with respect to the activities or uses regulated by this chapter.
B. 
The Construction Official, subcode officials and inspectors of the Bureau are authorized to enter the premises and structures of any properties regulated by this chapter to inspect those premises or structures subject to constitutional restrictions on unreasonable searches and seizures. If entry is refused or not obtained, the code official or inspector is authorized to pursue and obtain an order from the Municipal Court or any other court of competent jurisdiction to authorize entry.
