In accordance with the provisions of N.J.S.A.
39:4-197, 39:4-197.6, 39:5A-1, 39:5A-4, and 40:48-2.46, the following
regulations apply to parking spaces reserved for handicapped persons.
Whenever any words and phrases are used in this
section, the meanings respectively ascribed to them in N.J.S.A. 39:4-204
through N.J.S.A. 39:207.8 shall be deemed to apply to such words and
phrases used herein.
The locations described in Schedule 21 of Article
X, attached to and made a part of this chapter, are established as designated restricted parking spaces for handicapped persons.
Notice in the form of a sign containing wording
and other markings identifying the restricted parking space for handicapped
persons shall be erected in the form and at the location as required
by law.
No person shall park a vehicle in the locations
reserved for handicapped parking except those persons who have been
issued a special vehicle identification card by the Division of Motor
Vehicles pursuant to N.J.S.A. 39:4-205 and then only when using a
motor vehicle on which there is displayed a certificate for which
a special vehicle identification card has been issued pursuant to
N.J.S.A. 39:4-206.
Any motor vehicle which is parked unlawfully
in a parking space which is restricted for use by a handicapped person
may be removed and stored at the request of a police officer. It shall
be the obligation of the owner of the motor vehicle to pay the reasonable
costs of removal and storage which may result from the removal.
The penalties for violations of the handicapped
parking section of these regulations shall be as follows: first offense,
fine of $100; second or subsequent offense shall be a fine of $100
and up to 90 days' community service on such terms and on such form
as the Municipal Court shall deem appropriate.
