The purpose of this article is to regulate the manner in which all persons shall conduct themselves on the Maurice River Bicycle and Walking Trail to insure the protection of the public health, safety and welfare, and the protection of private and public property, including the protection of the animal and plant environment.
As used in this article, the following terms shall have the following meanings unless the context clearly indicates that a different meaning is intended.
BICYCLE
A transportation vehicle with two wheels, one in front of the other, steered by a handlebar and driven by pedals propelled solely by human power.
DAWN
The first appearance of daylight in the morning.
DUSK
The state or period of partial darkness between day and night.
MAURICE RIVER BICYCLE AND WALKING TRAIL
Being within a linear strip of public lands designated as a pedestrian and bikeway trail and further described as being located along the westerly side of the Maurice River running for a distance of approximately one mile from Brandriff Avenue to Sharp Street Park including intermediate access points at Mulford Avenue and Main Street (Mount Pleasant vicinity). Said trail facility in its entirety also includes all public infrastructure, including but not limited to asphalt paving, stone particle surfaces, timber bridges, timber pilings, underdrain pipes, and vegetated edges.
PERSON
A natural person, association, corporation, firm, partnership, trust, or other legal entity.
TRICYCLE
A transportation vehicle with three wheels, steered by a handlebar and driven by pedals propelled solely by human power.
A. 
Bicycles and tricycles are vehicles permitted to be operated on the trail.
B. 
Every person operating a permitted vehicle on the trail shall do so at a safe speed and in a safe manner so as not to endanger the safety of themselves or others or to cause damage to any private or public property including the environment.
C. 
No person shall operate a device or a vehicle on the trail that is propelled in any way other than by human power.
D. 
Emergency vehicles and work vehicles shall be permitted on the trail, provided the operators are engaged in the performance of official duties.
E. 
No person shall litter (as defined in Chapter 60 of the Municipal Code) on the trail or on the adjacent lands and waterways.
F. 
No person shall leave the trail to trespass on wetlands adjacent thereto.
G. 
No person shall damage or injure the asphalt trail, boardwalks, or adjacent lands, trees and vegetation.
H. 
No person shall harass or harm the animal life located on the trail or the adjacent lands or waterways.
I. 
No person shall camp or sleep on the trail or the adjacent lands.
J. 
No person shall ride a horse or other similar animal on the trail or the adjacent lands.
K. 
No person shall swim in the waterways adjacent to the trail.
L. 
No person shall possess or consume alcoholic beverages on the trail or on the adjacent lands or waterways.
M. 
No person shall sell or offer for sale beverages, food, merchandise, or other tangible personal property on the trail or on the adjacent lands or waterways.
N. 
No person shall move or remove any temporary or permanent barriers, directionals, fences, gates, or signs from the trail or the adjacent lands.
O. 
No person shall be on the trail or the adjacent lands between dusk and dawn.
Any person violating any of the provisions of this article shall, upon conviction thereof, be subject to the penalties set forth in Chapter 1, General Provisions, Article III.
