As used in this article, the following terms
shall have the following meanings unless the context clearly indicates
that a different meaning is intended.
FIREARM
A weapon that expels a projectile (such as a bullet or pellets)
by the combustion of gunpowder or other explosive.
FIREWORKS
Include any combustible or explosive composition or any substance
or combination of substances or article prepared for the purpose of
producing a visible or an audible effect by combustion, deflagration,
detonation or explosion.
PERSON
A natural person, association, corporation, firm, partnership,
trust or other legal entity.
It shall be unlawful for any person to discharge
a firearm or fireworks within the City except under the following
authorized circumstances.
A. A law enforcement officer acting in the performance
of his or her official duties.
B. A person lawfully hunting during hunting season on
lands authorized for that purpose.
C. A person lawfully target shooting or trap shooting
on lands authorized for that purpose.
D. A fireworks display over lands or water which has
been authorized by the Fire Official.

E. A person lawfully acting in accordance with the provisions
contained in the New Jersey Code of Criminal Justice or other applicable
state law.
A person found guilty of an offense under this
article shall be subject to a fine up to and including $500, or community
service up to and including 30 days or imprisonment up to and including
30 days, in the discretion of the Municipal Court.
