The purpose of this article is to establish requirements to control littering in the City of Millville, so as to protect the public health, safety and welfare, and to prescribe the penalties for the failure to comply.
As used in this article, the following terms shall have the following meanings unless the context clearly indicates that a different meaning is intended:
LITTER
Any used or unconsumed substance or waste material which has been discarded, whether made of aluminum, cloth, glass, paper, plastic, rubber, wood or other natural or synthetic material, or any combination thereof, including but not limited to containers or packaging made from the aforesaid materials, such as any bag, bottle, box, can, or jar and the cap, lid, tab or top from a container or packaging. It also includes any construction material, debris, garbage, refuse, rubbish or trash, together with any cigarette, cigar, match, or any flaming or glowing material. It does not include the waste from the primary processes of farming, logging, manufacturing, mining or other resource extraction processes, or sawmilling.
LITTER RECEPTACLE
A container suitable for the depositing of litter.
PERSON
Any individual, corporation, company, partnership, firm, association, or political subdivision of this state subject to municipal jurisdiction.
A. 
It shall be unlawful for any person to discard, drop, throw or otherwise place any litter of any nature upon private property or public property other than in litter receptacles or, having done so, to allow such litter to remain.
B. 
Whenever any litter is discarded or thrown, or allowed to fall from a boat or motor vehicle in violation of this article, the operator or owner, or both, of the boat or motor vehicle also shall be deemed to have violated this article.
