[HISTORY: Adopted by the Board of Trustees of the Village of North Hills 12-28-1994 by L.L. No. 5-1994 (Ch. 41, Part 2, Art. II of the 1982 Code). Amendments noted where applicable.]
The Village of North Hills is committed to the development and maintenance of a drug-free work environment and, in accordance with the Drug-Free Workplace Act of 1988, will not tolerate the unlawful or improper possession or use of controlled substances on its premises. In furtherance of such commitment, and in accordance with applicable requirements of federal law, the Village Board of Trustees hereby finds and concludes that the adoption of a formal policy for a work environment free of substance abuse is appropriate. In addition to the provisions of this chapter, the Village will seek to encourage such an environment by making available to its employees, on a continuing basis, information on substance abuse, as well as other health and safety standards, and will encourage its employees who have substance abuse problems to seek confidential assistance and counseling through any available agencies.
A. 
In order to maintain and encourage a work environment which is free from substance abuse, the following regulations shall apply in the Village of North Hills:
(1) 
No Village employee shall work or report to work while impaired by the illicit or improper use of a controlled substance.
(2) 
Any Village employee who is convicted of any violation of a statute involving the use or abuse of a controlled substance which occurred at such employee's workplace in the Village or during the course of the employee's work on behalf of the Village shall notify the Village Administrator within five days after such conviction. Within 10 days after receiving any such notification of such conviction and if the work of the employee reporting the conviction is funded in whole or in part by federal funds, the Village Administrator shall promptly notify the federal agency providing such funds, such notification to be given by the Village through the appropriate agency of the State of New York or any political subdivision thereof responsible for managing said federal funding.
B. 
A violation of any of the foregoing regulations or policies shall lead to appropriate disciplinary action, including discharge, through normal disciplinary procedures.
