The Board of Trustees hereby finds it to be in the public interest and
declares it to be a municipal purpose for the Village of Scarsdale, Westchester
County, New York, in which property or other facilities of a railroad are
located, to acquire the same, except rolling stock, tracks and platforms,
upon such terms and conditions as may be appropriate to ensure continued operation
thereof and public use thereof in the transportation of persons or property.
The Board of Trustees is hereby authorized to acquire, by gift, purchase,
lease, condemnation or otherwise, real property and other facilities, except
rolling stock, tracks and platforms, located in the Village of Scarsdale from
the New York and Harlem Railroad Company or any successor to it for municipal
purposes, including but not limited to the use of such property for parking,
playground, parks, streets, access by the general public to property of said
railroads and the maintenance of facilities for the convenience of the general
public.
The expenses incurred in connection with such acquisition and the charges,
expenses or costs incurred in maintaining such property shall be a village
charge and may be paid for by appropriation of moneys available therefor or
may be financed in whole or in part pursuant to the Local Finance Law. The
period of probable usefulness of any indebtedness contracted pursuant to this
section shall be 30 years.
The action authorized by this article shall be taken by the Board of
Trustees by resolution, and such resolution may be amended from time to time.
In the event that railroad service through the Village of Scarsdale
shall be discontinued or in the event that the Board of Trustees shall hereafter
decide that property theretofor acquired by the village pursuant to this article
is no longer required as a matter of public convenience and necessity, such
property, either real or personal, may be sold or leased in whole or in part
and the proceeds or rentals retained or distributed in accordance with law.
