Pursuant to the provisions and procedures of § 22-2200 of the Village Law, the Downtown Infrastructure Improvement District is hereby established as described in the assessment district map filed under § 143-4 of this chapter for the purposes set forth herein.
As used in this chapter, the following terms shall have the meanings indicated:
BENEFITED PROPERTY
A property located within the Downtown Infrastructure Improvement District pursuant to the assessment district map filed under § 143-4.
INFRASTRUCTURE IMPROVEMENTS
Improvements made to streetscape, lighting, signage, sidewalks, curbing and parking and planning and design work associated with such improvements.
TOTAL COST
The cost of design, construction and installation of infrastructure improvements made, including the cost of any borrowing prior to assessment of the benefited properties.
Pursuant to the provisions of Municipal Home Rule Law § 10, Subdivision 1(ii)e(3), the Board of Trustees of the Village of Scarsdale hereby acts pursuant to the provisions of Municipal Home Rule Law § 10, Subdivision 1(ii)a(11) and (14), to establish the Downtown Infrastructure Improvement District for the following purposes:
A. 
To perform a traffic study to improve traffic circulation and to provide additional on-street parking.
B. 
To design and construct infrastructure improvements in the Downtown Improvement District.
C. 
To redesign and reconstruct the intersection of Popham Road and Chase Road.
Pursuant to § 22-2200, Subdivision 1, of the Village Law, a map of the Downtown Infrastructure Improvement District entitled "Special Assessment Tax District Boundary Map for Scarsdale Infrastructure Improvements," as prepared by Ferrandino & Associates, Inc., and dated October 6, 1997, showing the lands to be benefited in the assessment district shall be filed in the Office of the Village Clerk.
A. 
The village shall bear 2/3 of the total cost of up to $4,000,000, and the benefited properties shall bear 1/3 of the total cost in accordance with the formula described herein.
B. 
The assessment of each benefited property shall be according to the following formula:
Assessment = [(Frontage of Benefited Property / Total Frontage in District) + (Lot Area of Benefited Property / Total Lot Area in District)] / 2 x (One-third of Total Cost)
C. 
The Board of Trustees is authorized to borrow and bond the total cost of such infrastructure improvements for a period not to exceed 20 years. The assessments for each benefited property shall be levied and paid in accordance with the provisions of Village Law § 5-518, Subdivision 3b, et seq.
D. 
Pursuant to § 22-2200, Subdivisions 1 and 2, of the Village Law, the assessment of each benefited property will be established by resolution after the final determination of the total cost as provided for in § 22-2200, Subdivision 2, of the Village Law and in accordance with the notice provisions of said section.
This chapter shall supersede § 22-2200 of the Village Law, as last amended, to the extent that the provisions thereof conflict with or are contrary to the provisions of this chapter.
