No person shall drive a taxicab for hire, and no person who owns or
controls a taxicab shall permit it to be so driven, unless the driver of such
taxicab shall have first obtained and shall have in force and effect a taxicab
driver's license pursuant to the provisions of this chapter.
A taxicab driver's license shall be valid for not more than one
year and shall expire on the 31st day of December, unless suspended or revoked
prior to the expiration of such period.
Each applicant for a taxicab driver's license shall fulfill the
following qualifications:
A. Hold a New York State chauffeur's license.
B. Be 18 years of age or over.
C. Be of sound physique, with good eyesight, and not subject
to epilepsy, vertigo, heart trouble or any other infirmity of body or mind
which might render such applicant unfit for the safe operation of a motor
vehicle.
D. Be able to speak, read and write the English language.
E. Be clean and neat in appearance, including but not limited
to clean, neat clothing such as clean trousers and shirt and clean outer garment
in cold or rainy weather.
F. Must completely abstain from use of narcotic drugs, as
defined in the New York State Public Health Law, and must not be addicted
to the use of intoxicating liquor.
G. Produce, on forms provided by the Village Clerk, affidavits
of the applicant's good character from two responsible residents of the
county and a recommendation as to the applicant's good character from
the applicant's last employer, unless, in the opinion of the Chief of
Police or the Village Manager, sufficient reason is given for the omission
of such affidavits or recommendations.
Each applicant for a taxicab driver's license must file three two-inch-by-two-inch
photographs of the applicant, in such a pose as the Chief of Police may direct,
taken within 30 days preceding the filing of the application. One photograph
shall be attached to the application, one to the license when issued and one
shall be placed on file with the Police Department. One photograph shall be
filed with each application for renewal of a taxicab driver's license
and shall be attached to the renewal license when issued. When an application
for a license is denied, two of the photographs shall be returned to the applicant
by the Village Clerk.
Each applicant for a taxicab driver's license shall be fingerprinted and investigated pursuant to Chapter
192, Licensing, of this Code. No license shall be issued under the provisions of this chapter until the Chief of Police has filed a written report with the Village Clerk stating the results of said investigation.
If the applicant satisfactorily meets the requirements for the issuance
of a taxicab driver's license and if the Chief of Police deems the applicant
to be fit and proper to drive a taxicab in the village, the Village Clerk
shall issue to the applicant a taxicab driver's license.
The form, size and content of the taxicab driver's license shall
be prescribed by the village.
No licensee shall deface, remove, change or obliterate any official
entry made upon said license in any respect whatsoever, and, if such official
license card shall be defaced, obliterated or changed in any respect, the
licensee shall report the same immediately to the Village Clerk, who may issue
a new license card and cancel the old card which shall be surrendered by the
licensee.
The Village Clerk, upon payment of the fee prescribed for renewal, may renew a taxicab driver's license from year to year, subject to the requirements of §§
272-16,
272-18 and
272-19 of this chapter. A taxicab driver, in applying for a renewal of a taxicab driver's license, shall make such application not less than 30 days next preceding its expiration, upon a form to be supplied by the Village Clerk and containing such information as the Village Clerk may require.
