[Amended 12-14-65]
The Village Engineer shall report any violation of §
294-1 of this chapter to the Village Manager, and the Village Manager may, by notice mailed to the owner or owners of such tree, shrub, fence, wall or other structure, order such owner or owners, on or before a date fixed in such notice, to cause such tree, shrub, fence, wall or other structure to be removed or so trimmed that it shall cease to be a violation and may direct the Village Engineer to cause the same to be removed unless the owner or owners thereof shall do so on or before such date.
In case such owner or owners shall fail to cause such tree, shrub, fence,
wall or other structure to be removed or so trimmed on or before such date,
the Village Engineer shall cause the same to be removed.
Any such owner or owners, including any individual, partnership or corporation owning such tree, shrub, fence, wall or other structure, alone or in common with another or others, who shall fail to comply with an order made pursuant to §
294-2 of this chapter or shall resist or obstruct the Village Engineer or any other person or persons acting under his direction in removing or trimming any tree, shrub, fence, wall or other structure pursuant to §
294-3 of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
