A. 
Except as provided in Subsection B of this section, no person or franchisee shall be permitted to construct, operate or maintain a cable system within the Village without having first obtained a franchise from the Village. Such franchises shall be awarded on a nonexclusive basis only.
B. 
No franchise shall be required for the Village or any local or municipal authority affiliated with it for operating as a cable system in the Village.
A. 
A franchise agreement shall be in sufficient detail to clearly delineate the rights and duties of both the franchisee and the Village. Each franchise agreement shall be in full compliance with the rules and regulations of the Commission.
B. 
Each franchise agreement shall contain provisions on at least the following subjects:
(1) 
A sufficiently detailed definition to provide a determination of the base annual revenues upon which the franchise fee will be based;
(2) 
The term or duration of the franchise;
(3) 
Indemnity and hold harmless clauses;
(4) 
An insurance clause;
(5) 
Details of performance and completion bonds;
(6) 
Remedies and/or penalties for violations of the franchise agreement by the franchisee;
(7) 
Construction, upgrade or rebuild schedule, where appropriate;
(8) 
Franchise fee compensation to the Village;
(9) 
Continuity of service in case of emergency;
(10) 
Assignment of an existing franchise;
(11) 
Disposition of prior franchise agreements;
(12) 
A severability clause;
(13) 
Any exemptions or relief granted, or clarifications noted with respect to the operation of the franchised cable system;
(14) 
Any other provisions that are required to be included in such an agreement by applicable law.
(15) 
Restoration of private and public property;
(16) 
Quality construction and maintenance;
(17) 
Consumer protection and customer service;
(18) 
Safety requirements;
(19) 
Provision of channel capacity for public, educational or governmental use and the provision of equipment, technical assistance and/or funds to use in the operation of such channels and provision of such programming
The Commission may develop rules and regulations with respect to the submission and processing of franchise applications, designed to determine the legal, financial, technical and character qualifications of the applicant.
