Appeals from decisions of the Commission may be commenced by mailing
to the Commission Chairperson, by registered or certified mail, a written
request, subscribed by the appellant, that the Commission prepare formal findings
of fact upon which its decision was made and shall file a copy of such request
in the office of the Village Clerk at the time it is mailed to the Commission
Chairperson. Requests must be received within 60 days from the date of hearing
at which the decision was made. Within 60 days after the request is so filed
with the Village Clerk, the Commission shall prepare formal findings of the
fact to the applicant at the address set forth in the request, by registered
or certified mail, and shall file a copy thereof in the office of the Village
Clerk. At the next succeeding regular meeting of the Commission, the appellant
may submit formal proof in answer to the findings. Within 60 days after such
meeting, the Commission shall approve or disapprove the appeal.
The answer of any appellant to formal findings of fact on an appeal
shall include any submissions specifically mentioned in the findings and may
include any other submission permitted by these regulations. Such formal proof
may be made orally or in writing.
A party may appear in person on any appeal or by a representative designated
in the request for formal findings of fact or in the notice of appeal.
In the event that a franchise agreement sets forth its own procedures
with respect to appeal or review of any Commission decisions related thereto,
those procedures will govern such matters rather than the procedures set forth
in this article.
