A certain document, three copies of which are on file in the Office of Life Safety and Code Enforcement for the Borough of Downingtown, being marked and designated as the "BOCA National Fire Prevention Code, Ninth Edition, 1993," as published by the Building Officials and Code Administrators International, Inc., is hereby adopted as the Fire Prevention Code of the Borough of Downingtown in the Commonwealth of Pennsylvania for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Fire Prevention Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with additions, insertions, deletions and changes, if any, prescribed in § 146-2 of this chapter.
The following sections are hereby revised as follows:
A. 
In Section F-101.1 (page 1, second line), insert "the Borough of Downingtown."
B. 
Amend Section F-112.3 (page 5, fourth line) to read ". . . shall be guilty of a summary offense . . ."
C. 
Sections F-113.1 through F-113.7 shall be deleted in their entirety, and the following provision shall constitute Section F-113.1: "Any person shall have the right to appeal a decision of the code official, and said appeal shall be heard by the Borough's Board of Administrative Appeals in accordance with Ordinance No. 86-20 of December 30, 1986, contained in Chapter 4 of the Code of the Borough of Downingtown."
D. 
Section F-308.1.1 (page 13). Add new section as follows: "All fuel-burning devices shall be connected to an approved chimney or vent, discharging to outside air."
E. 
Amend Section F-308.2.1 (page 13, second line) to read ". . . shall be deemed a summary offense . . ."
F. 
Amend Section F-313.1 (page 14, entirety) to read "All elevators utilized for emergency fire-fighting or rescue operations shall comply with Rule 211.3 of ASME A17.1 listed in Chapter 44."
G. 
In Section F-403.3 (page 17, line 3), add the following: ". . . and to provide heat for outside workers."
H. 
In Section F-403.4 (page 17, line 5), delete "providing heat for outside workers."
I. 
Amend Section F-503.4.2 (page 21, second line) to read ". . . AC primary power source with built-in battery backup or a . . ."

F-403.3.1. Approved Containers: Outdoor fireplaces, smokeless firepits, outdoor cooking grills, outdoor patio stoves, chimineas, and factory-built metal novelty stoves may be used upon private property within the R-1, R-2, R-3, R-4 and R/C Infill Development Zoning Districts, provided such use is consistent with the container's intended purpose and is in accordance with Section F-403.5.

F-403.3.2. Burning of Waste Prohibited: The use of outdoor fireplaces, smokeless firepits, outdoor cooking grills, outdoor patio stoves, chimineas, and factory-built metal novelty stoves for the burning and disposal of leaf waste, yard waste, or any recyclable material is prohibited per § 243-5 of the Borough Code.
O. 
On page 17, add and amend the following definitions within Section F-403.2 to read as follows:

Approved container: An outdoor fireplace, smokeless firepit, outdoor cooking grill, outdoor patio stove, chiminea, or factory-built metal novelty stove.
Recreational fire: An outdoor fire utilized to cook food for human consumption or an outdoor fire within an approved container.
The limits referred to in Section F-3003.2 of the BOCA National Fire Prevention Code/1993, in which the storage of explosive materials is prohibited, are hereby established as follows: the political boundary of the Borough of Downingtown.
