On and after the effective date of this chapter, no person, firm or
corporation shall cause to be occupied, transferred or the change
of ownership of any house, dwelling, residence, apartment or other building
within the Township of Kidder without first having obtained a permit for occupancy
therefore from the Township Building Inspector. As utilized in this chapter,
all such structures shall be included in the term "premises."
Every person, firm or corporation seeking a permit for occupancy, transfer
or change of ownership of any premises shall file an application not later
than 10 days prior to occupancy, transfer or change of ownership with the
Township Building Inspector setting forth the owner of said premises, location
of the premises and nature of the proposed use of the premises. Such permit
shall be secured from the Building Inspector of the Township of Kidder and
a fee, as established by resolution of the Board of Supervisors of the Township
of Kidder, from time to time, shall be charged for said permit.
Prior to the issuance of said permit, the Building Inspector, upon information
supplied on said application for permit, shall inspect the premises which
are the subject of the application for permit for compliance with the 2003
International Property Maintenance Code to insure that said premises are in
compliance with said Code.

Registration on forms provided by the Township for an annual inspection
shall be made not later than the 30th day of June of each year for each hotel,
motel, public boardinghouse, all commercial businesses operating within the
Township, and all rental or time sharing units within the Township. The annual
inspection required under this section shall be automatically waived for one
year in the event that the previous year's inspection of structures and premises
subject to licensing under the provisions of this chapter reveal no violations
or deficiencies as set out herein. A fee as determined from time to time by
resolution established by the Board of Supervisors of Kidder Township shall
be established in order to keep the license current if the annual inspection
fee is waived under this section. There are hereby established reinspection
fees associated with dwelling unit inspection fees as established and authorized
by this chapter. The fee schedule for reinspection fees performed shall be
established from time to time by resolution of the Board of Supervisors.
Any person who violates or permits a violation of this chapter shall,
upon being found liable therefor in a civil enforcement proceeding commenced
by the township before a District Justice, pay a fine of not more than $600,
plus all court costs, including reasonable attorney's fees, incurred by the
township in the enforcement of this chapter. No judgment shall be imposed
until the date of the determination of the violation by the District Justice.
If the defendant neither pays nor timely appeals the judgment, the township
may enforce the judgment pursuant to the applicable Rules of Civil Procedure.
Each day a violation exists shall constitute a separate offense. Further,
the appropriate officers or agents of the township are hereby authorized to
seek equitable relief, including injunction, to enforce compliance herewith.
The terms and the language utilized herein, if not specifically defined
herein, shall be construed to have a meaning consistent with their common
usage and definition.
The terms and provisions of the 2003 International Property Maintenance
Code are incorporated herein and made a part hereof.
