No water shall be provided for internal or external use to any residential, commercial, industrial, agricultural, recreational, governmental, or public building or structure of any kind which is constructed or remodeled and in which plumbing, water piping or water fixtures are to be installed, extended or altered in any way, and for which construction a permit is required in any way, and for which construction a permit is required to be obtained from the Township of Kidder or would be required but for an exemption from a permit requirement for public or governmental agencies, unless the new, extended or altered plumbing, water piping and other water using fixtures therein conform to the requirements and standards of §
171-2 of this chapter. The provisions of this chapter shall apply to any such building or structure for which such a building permit is issued, or would otherwise be required to be issued but for such an exemption, on or after November 18, 1993.
The Board of Supervisors may, from time to time, modify, add to, or
remove from the standards and restrictions herein.
It shall be a misdemeanor for any person to use or apply water within
Township of Kidder contrary to or in violation of the restrictions herein.
Any person who violates or permits a violation of this chapter shall, upon
being found liable therefor in a civil enforcement proceeding commenced by
the township before a District Justice, pay a fine of not more than $600,
plus all court costs, including reasonable attorney's fees, incurred by the
township in the enforcement of this chapter. No judgment shall be imposed
until the date of the determination of the violation by the District Justice.
If the defendant neither pays nor timely appeals the judgment, the township
may enforce the judgment pursuant to the applicable Rules of Civil Procedure.
Each day a violation exists shall constitute a separate offense. Further,
the appropriate officers or agents of the township are hereby authorized to
seek equitable relief, including injunction, to enforce compliance herewith.
