As used in this article, the following terms
shall have the meanings indicated:
DOG
Any dog, bitch or spayed bitch.
DOG OF LICENSING AGE
Any dog which has attained the age of six months or which
possesses a set of permanent teeth.
KENNEL
Any establishment where the business of boarding or selling
dogs or breeding dogs for sale is carried on, except a pet shop.
OWNER
When applied to the proprietorship of a dog, shall include
every person having a right of property in such dog and every person
who has such dog in his or her keeping.
PET SHOP
Any room or group of rooms, cage or exhibition pen, not part
of a kennel, where dogs are kept for sale or display.
POUND
Any establishment for the confinement of dogs seized either
under the provisions of this chapter or otherwise.
Within the limits of the Township of South Hackensack,
no person, firm or corporation shall have or keep more than two dogs
at or upon any one premises unless and until there shall be granted
by the Township Committee of the Township of South Hackensack, in
accordance with the terms of this article, and shall be in force and
effect a license so to do for the place or premises in or upon which
the same shall be kept.
Said license shall be applied for by written
application filed with the Township Committee. Said application shall
set forth the full name of the applicant, the location of the premises
in or at which said dogs are to be kept and a detailed description
of the structure or structures thereon. Said application shall also
be accompanied with a deposit to cover the license fee for the current
year in the amount hereinafter provided.

There shall be charged and collected for said license an annual fee as provided in Chapter
108, Fees. Said license shall expire on January 1 of each year, and in the case of the first license issued to any applicant hereunder, the fee therefor shall be prorated as to the balance of the year then remaining. Said license fee shall be payable in advance for each year or part thereof and is hereby expressly declared to be imposed for revenue.
For sufficient cause, after notice and hearing,
the Township Committee may refuse to grant any application for a license
hereunder or may revoke any such license previously granted for any
violation of this article. No dogs in premises licensed or to be licensed
shall be kept in the open or otherwise permitted in the open except
on a leash under the control of an adult. No license shall be granted
and any license heretofore issued shall be revoked if the structure
on the licensed premises where such dogs are to be kept is or would
be within 250 feet of any public street or within 250 feet of the
line of any other property owner. Such licensed place or premises
shall at all times comply with the proper police, health and zoning
regulations imposed by the Township of South Hackensack, and said
place or premises shall at all times be subject to inspection by the
police, health and building authorities of the Township of South Hackensack.

A. Any person, firm or corporation who shall violate
any of the terms or provisions of this article shall, upon conviction
thereof, be subject to a fine not exceeding $2,000, imprisonment for
a term not exceeding 90 days, a period of community service not exceeding
90 days, or any combination thereof.

B. Each day that a violation of any of the terms or provisions
of this article shall continue shall constitute a separate offense.
