As used in this article, the following terms shall have the meanings indicated:
SUPERMARKET
A place of business for the retail sale of meats, groceries, provisions, dry goods, merchandise or goods and chattels of any kind and wherein said goods are displayed for sale by means of stands or counters operated by tenants or subtenants of the overall operator, and which said business requires overall more than four persons as principals, tenants or employees to conduct or carry on the same.
Within the limits of the Township of South Hackensack, no person, firm or corporation shall conduct or carry on the business of the sale of merchandise, goods and chattels by a supermarket or work in, occupy or utilize, directly or indirectly in any manner whatsoever, any place or premises in which is conducted or carried on such supermarket, unless and until there shall be granted by the Township Committee of the Township of South Hackensack, in accordance with the terms of this chapter, and shall be in force and effect a license to conduct said business for the place and premises in or at which said business shall be conducted and carried on.
Each supermarket shall have and maintain at all times a vacant and unobstructed building setback, side yard areas and a rear yard area of not less than 40 feet between each exterior line of such structure comprising said supermarket and the exterior property line of such supermarket.
Said license shall be applied for by written application filed with the Township Committee. Such application shall set forth the full name and address of the applicant, the location of the place and premises in or at which the business is to be conducted, the kind and character of the supermarket to be conducted and a diagram of such place. Said application shall also be accompanied with a deposit to cover the license fee for the current year in the amount hereinafter provided.

There shall be charged and collected for said license an annual fee as provided in Chapter 108, Fees. Said license shall expire on January 1 of each year. Said license fee shall be payable in advance for each year or part thereof. The Township Committee may revoke any such license for any violation of this chapter, after notice and hearing.
Such licensed place or premises shall at all times comply with all proper police and fire regulations imposed by the Township police and fire authorities. Said business and the place and premises where conducted shall be subject to reasonable inspection by the police, fire and health authorities of the Township of South Hackensack.
A. 
Any person, firm or corporation who shall violate any terms or provisions of this chapter shall, upon conviction thereof, be subject to a fine not exceeding $2,000, imprisonment for a term not exceeding 90 days, a period of community service not exceeding 90 days, or any combination thereof.

B. 
Each day that a violation of any of the terms or provisions of this chapter shall continue shall constitute a separate offense.
