The orderly and uninterrupted governmental operations and functions of the City government of the City of Mount Vernon have been and are severely hampered and restricted by the concerted and continuing refusal of retail gasoline service station owners or operators to sell automotive fuels to motor vehicles owned and operated by the City of Mount Vernon. Such refusals have caused and will continue to cause the City of Mount Vernon to limit and restrict police, sanitation and other vital services, resulting in the total curtailment of such services and thereby seriously endangering the public health, safety and welfare.
It is hereby declared to be unlawful for any individual, partnership, company, association or corporation owning or operating a retail gasoline service station, within the City of Mount Vernon, and every officer, agent, employee or servant in responsible charge thereof to refuse to sell automotive fuels, oil and other lubricating substances to any motor vehicle owned by or operated on behalf of the City of Mount Vernon.
Any person violating any of the provisions of this article shall be guilty of an offense and shall be liable to a fine which shall not exceed $150 in amount, or to imprisonment not exceeding 15 days, or to both such fine and imprisonment.
