The Council-Manager Plan and common provisions of the Optional
Municipal Charter Law as adopted by the voters of the Township February
19, 1985, N.J.S.A. 40:69A, Articles 2, 9 and 17, and all applicable
provisions of general law.
An enactment of Council in continuing, uniform regulation
of public or governmental conduct. It shall be written, published
and adopted after public hearing at a meeting following the one at
which it was introduced (reference: N.J.S.A. 40:69A-18off and 40:49-1ff).
An action expressing the sense or will of Council on a matter
of special or temporary interest. It shall be written and may be adopted
at the meeting at which it is introduced, without publication or public
hearing (reference: N.J.S.A. 40:69A-18off and 40:49-1).
Construction. For the purpose of this chapter and
any other ordinances or resolutions heretofore or hereafter adopted,
except as the context may otherwise require:
The masculine gender includes the feminine and the
neuter, but the composite "he/she" and its correlatives may also be
used when appropriate to the context
The time within which an act is to be done shall be
computed by excluding the first and including the last day, and if
the last day is Saturday, Sunday or a legal holiday, that day shall
be excluded.
The word "Charter" shall mean Council-Manager Plan
of the Optional Municipal Charter Law, N.J.S.A. 40:69A-1 et seq.,
and all applicable provisions of the general law.
It is the intent of Council in enacting this chapter
to exercise fully the powers delegated by the Charter to organize
and regulate its internal affairs, and the provisions of the chapter
shall be construed liberally to that end.
The chapter shall be interpreted and administered
so as to maintain the separation of legislative and administrative
powers as provided in the Charter.
